I am unable to attend the BOCC hearing scheduled for November 25, 2015 as I am out of the area for an extended period. I attended the Planning Commission hearing on November 3, 2015 and provided comments during the public comment portion of the hearing. I would provide comments at the BOCC hearing as well if I was in attendance. This request just is NOT a good fit for this location. The request to insert Industrial use in the proposed location is categorically INCOMPATIBLE with the surrounding area and is in direct conflict with surrounding jurisdictions' Growth Management Areas contemplated in their respective Comprehensive Plans. The ONLY way this USR can possibly work is with extensive mitigation measures to protect the surrounding property owners. During the Planning Commission hearing the commissioners heard that the applicant has already begun parking construction equipment on the property. This behavior clearly indicates the applicant is not willing to comply with County guidelines and respect the process of seeking appropriate approval to operate a business in compliance with well defined guidelines prior to commencement of operations. Additionally, the applicant indicated that the demand for the fly ash that initially made the access to railroad delivery attractive may not be practical as the previously available supply of the product is diminishing which would increase the truck delivery method to unacceptable levels. Add to the mix that the location selected is serviced by a gravel road currently considered by Weld County as a local road. I respectfully request that you DENY this USR application. Should you determine that this request is compatible for the proposed location I urge you to consider requiring comprehensive conditions of approval to at least protect the surrounding property owners. I ask that you consider requiring residential noise standards, paving WCR56 to minimize road degradation and dust generation, effective visual screening and exterior lighting restrictions to limit light pollution. Johnstown had a comprehensive plan that was ignored and scoffed at because it was not executed fast enough . In contrast. how is it right to throw industry into this area without planning? This is clearly a trans-loading operation that will affect the health and safety of the surrounding residents and farm families since major issues are not addressed : • Health risks associated with fly ash (an industrial byproduct of burning coal ash ) : A September 2010 report by Physicians for Social Responsibility, states ". . . coal ash commonly contains some of the world's deadliest toxic metals: arsenic. lead . mercury. cadmium . chromium and selenium . These and other toxicants in coal ash can cause cancer and neurological damage in humans. "The report goes on to say, ". . . coal ash toxins have the potential to injure all of the major organ systems. damage physical health and development, and even contribute to mortality. " The EPA officially considers fly ash non-hazardous waste. Even so. its website acknowledges fly ash contains "contaminants like mercury. cadmium and arsenic associated with cancer and various other serious health effects." The website also says, "EPA's risk assessment and damage cases demonstrate that without proper protections, these contaminants can leach into groundwater and often migrate to drinking water sources, posing public significant health concerns. Fly ash is composed of very small , fine particles. and breathing in fly ash may cause respiratory problems in humans." • Does not meet the intent of Agriculture Land Use Regulations Section 22-2- 10 or Weld County's Section 22-2-20. • No clear direction on how the operation will be maintained . handled . or what preventative actions are in place for hazards. How hazards are reduced , mitigated or eliminated and the process to achieve corrective actions in the event of adverse situations. I2 If however this should be approved then this operation should be entirely contained and subjected to: • Lining fly ash dumps as well as covering them daily • Putting tarps over the trucks that haul the ash • Full disclosure of pollutants in the ash • Rules to control "fugitive dust" • No wet storage ponds (so that in the event of a heavy prolonged rainstorm , fly ash sludge cannot wash downhill into the Little Thompson River like in the Little Blue Run issue in Tennessee) • Continuous monitoring at the dump sites • Pave WCR 56 and widen it (the curve can be very dangerous) • Operate 7 am — 5:00 pm hours . Monday — Friday • No operation on windy days when winds are over 2 mph . • Restrict noise to 50 dB • Create an esthetic environment by screening the facility behind 15ft berms with appropriate and tasteful landscaping • Downward , discrete lighting • Limiting truck traffic to less than 20. Good character is doing the right thing because it is right to do what is right . What we have found dealing with AgrPro and SunHaul on this USR is that these two companies have great character. They were willing to sit down with CLR-34 and surrounding neighbors to discuss our concerns, which allowed all of us to work together to mitigate those concerns . Based on the following, we feel that this USR should be approved. 1 . They are restricting the number of truck whether carrying equipment or flyash to 20 trips in and 20 trips out of their site. 2 . They are imposing a 20 mph speed limit on their truck drivers when on WCR 56. In addition, there would be no use of jake brakes while on WCR 56 . 3 . The reduced speed will help to mitigate the dust issue on 56 and any hazards created by the road not meeting county standards for width. 4. They will work with the neighbors to plant a single row shelterbelt along the west side of their site as a visual barrier. 5 . We understand that the numbers of truck trips and loading/unloading of flyash is not going to be a issue with regards to their hours/days of operation. 6. Keep their haul route to WCR 13 . 7.
