Mary Ann Feuerstein, Recorder RESOLUTION 11- ' WHEREAS, a public hearing was held on September 22, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Thomas Krebs, Route 1, Box 253B Longmont, Colorado, requesting change of zone from "A" Agricultural District to "E" Estates District, Planned Unit Development, of a tract of land as hereinafter recited, all as appears on plat as submitted and made a part hereof by reference, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of petitioner and studied the recommendations of the Weld County L-rn Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the petition of Thomas Krebs, Route 1, Box 253B, Longmont, Colorado, for change of zone from "A" Agricultural District to A- Agricultural District (Eberl Planned Unit Development) of a tract of land as.appears on plat, said area being more particularly described as follows: A tract of land located in the Southwest Quarter of Section 22, Township 3 North, Range 68 West of the 6th P. M. , Weld County, Colorado, being more par- ticularly described as follows: Beginning at a point on the West line of the said South- west Quarter of Section 22 from which the West Quarter corner of said Section 22 bears North 00°43' East, a distance of 1365. 00 feet, all bearings used herein relative to this line and do not necessarily reflect true meridian; thence East a distance of 2508. 28 feet; thence South 00°43' West, parallel to the said West line a distance of 521. 06 feet; thence West a distance of 2508. 28 feet to a point on the said West line; thence North 00°43' East, along said West line a distance of 521. 06 feet more or less to the point of beginning, subject to any existing easements or rights of way of record. Said tract contains 30. 004 acres, more or less, is hereby granted under the conditions following: 1, That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That all official unit development plans and standards shall be followed and complied with in accordance with the official unit development plan as submitted. 4. That said change of zone herein granted is conditional only for a period of twelve months from date hereof on condition that developer pro- ceed with due diligence to begin construction of a one-family residence building upon said subject property; otherwise, the County may take action to rezone the property to its present classification. 5. That a building permit for the erection of a single family dwelling shall be obtained prior to construction thereof. 6. That the present mobile home located upon subject property shall assume temporary status and shall be removed off the premises when construction of the single family dwelling is completed. Tom Krebs , one of said. property owners , needs this for his family. -Summary- A. The total development area is ten ( 10) acres , which will be divided into two five (5) acre lots . B. There will be only one new building site avail- able on this development. C. The water source is residentual and is sup- plied by Longs Peak Water Association. D. The disposal system will be a septic system in accordance with Weld County Health Dept. • The Health Dept. has already issued a permit- /'451. E. Due to the existing size of the parcel of land, its division would have no great affect on the agricultural land inventory. 2. There are no irrigation ditches or canals that would be adversely affected by this project. 3. Due to its relative flat terrain, it should not create any great erosion hazard. 4. The soils are of the Wiley-Colby series and have a moderately heavy textured surface and subsoil, so the septic system should be properly engineered to avoid any pollution of adjacent soil and water.
