HomeMy WebLinkAbout750189.tiff e - 1 RESOLUTION WHEREAS, a public hearing was held on June 9, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the pur- pose of hearing the petition of the Colorado State Highway Department, c/o Leo O'Connor, 1420 Second Street, Greeley, Colorado (Norma Grossaint land), requesting permission to locate a gravel pit operation on the following des- cribed property: Area #1 Northwest Quarter (NW4) Section 22, Southwest Quarter (SW-.1) Section 15, Southeast Quarter (SE4) Section 16 and Northeast Quarter (NE 4) Section 21, Township 5 North, Range 65 West, of the 6th Principal Meridian, in Weld County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point on the east line of Section 16, Township 5 North, Range 65 West of the 6th Principal Meridian, from which the Southeast Corner of Section 16 bears South 0°5'25" East a distance of 382. 9 feet; thence North 87°48'00" East a distance of 350 feet; thence South 1°36'00" West a distance of 313. 5 feet; thence South 26°51'36" East a distance of 468. 8 feet; thence South 71°38'24" West a distance of 631. 3 feet; thence North 58°21 '36" West a distance of 562. 5 feet; thence North 26°38'24" East a distance of 500 feet; thence North 56°38'24" East a distance of 315. 6 feet; thence North 87°48'00" East a distance of 37. 5 feet more or less to the point of beginning. The above tract of land contains 14. 7 acres more or less. Area #2 Southwest Quarter (SW4) of the Southwest Quarter (SW4) of Section 15, South (Si-) of the Southeast Quarter (SE4) of Section 16, Township 5 North, Range 65 West, of the 6th Prin- cipal Meridian in Weld County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point on the East line of Section 16, Township 5 North, Range 65 West of the 6th Principal Meridian, from which the Southeast Corner of Section 16 bears South 0°5'25" East a distance of 782. 8 feet; thence South 87°48'0" West a distance of 910 feet; thence North 46°36'00" East a distance of 446 feet; thence North 58°6'00" East a distance of 375 feet; thence North 88°00'00" East a distance of 1583 feet; thence South 1°00'36" West a distance of 426 feet; thence South 88° 30'00" West a distance of 75 feet; thence South 1°42'00" East a distance of 50 feet; thence South 87°48'00" West a distance of 1235 feet more or less to the point of beginning. The above described parcel contains 21. 1 acres, more or less, and WHEREAS, the Petitioner was present, being represented by Mr. Ken Woods, Materials Engineer for the Colorado State Highway Department, and WHEREAS, there was no opposition to the request of Petitioner for the location of said gravel pit operation, and . , LIDO-33 r 750189 r WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the Petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Department c/o Leo O'Conner (Norma Grossaint land), to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That Petitioner shall proceed with due diligence to effect construc- tion of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when gravel extraction is completed said permittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit excavation and rehabilitation shall be limited to plans as submitted and in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. The owner of the proposed borrow areas is Norma L. Grossaint, Rt. 4, Box 294, Greeley, Colorado. We are requesting permission to remove approximately 950,000 cubic irards of soil (borrow material) for construction of the new State Highway #34, east of Greeley. These areas are adjacent to and seperated by State Highway #34. Description of the borrow areas: Both areas lie in a meadow in the South Platte River flood plain. The material in area no. 1 will be removed by enlarging a pre- viously used borrow pit which is now a small lake. The excavation will start on the west side of the lake and progress westerly to the owners irrigated farmland. It will be bounded on the south by the Patterson Ditch and the South Platte River and on the north by the proposed State Highway #34. The depth of the exca- vation will be approximately 18 feet. All backslopes will be no steeper than 2:1. Area no. 2 is located north of area no. 1 and across the State Highway #34 alignment. This area is bounded on the north by the No. 3 Ditch Company, on the west by irrigated farmland, on the south by State Highway #34 and on the east by a property line. Like area no. 1, the excavation will be approx- imately 18 feet deep, and will result in a small lake. The back- slopes of the lake will not be steeper than 2:1. The water table varies but it is approximately 3 to 4 feet. Therefore, the depth of the water in the lakes will be about 14 to 15 feet deep. The net evaporation is 31" (L2" - 11"). Annual Evaporation to be replaced is 31/12 ft. X 35 acres = 90.1 acre ft. Jalculation of replacement water- The total area cf irrigated land taken out of production on the Norma L. Cressaint property is 73 acres (38 acres was purchased for State Highway #34: Right of Way, and there is 35 acres of surface area on the prcposed lakes). The average annual crop consumption on the land is l.25 ft. of water. This figure is from the 31ane:;-Kriddle hnalysis. It was obtained from the Colorado 2ivision of Water Resources. Therefore, 1.25 ft. The Planning Commission has authorized me to convey to you that they have no objections to either the zoning change or the issuance of a Special Use Permit for the excavation of gravel, as long as the State is required to comply with the requirements for sand and gravel excavation. Concern was expressed by the Commission as to whether this would have an adverse effect on the flood plain, and also as to whether or not the State Highway Department would be required to submit a rehabilitation plan for the site. This concern was expressed due to the fact that the land involved is located in the area that is currently under planning for the State Trails System. No. 275 Dear Mr. Juntunen: This is to acknowledge receipt of material pertaining to the special use permit for a gravel extraction operation along the South Platte River. The material does include a water augmentation proposal to compensate for the evaporation of approximately 77 acre feet of water from the 30 surface acres of ponds that will result from this operation. This proposal does not appear entirely feasible in that most of the irrigation tail water historically returned to the stream system for use by downstream appropriators. If pumping of water from the pit is proposed during mining operations then the effect of this operation on existing wells and the Patterson Ditch should be considered. We have discussed other alternatives with the Division of Highways, such as taking credit for the increased runoff resulting from the construction of the highway and making this additional runoff available to the stream system. While this may be feasible, it will require a Water Court decree in order to make it a valid plan of augmentation. Until an acceptable plan of augmentation is provided, I cannot recommend approval of the Special Use Permit. If additional information is provided, I would be most happy to review it at your request. (Grossaint property) Gentlemen: In the interest of the Delta Irrigation Company, regard- ing the above captioned Special Use Permit, I would like to of- fer the following comments: 1. During the course of the material extraction, we would want to continue to have free access to that portion of the ditch in the area. 2. Vie would hope that banks of the ditch would not be dis- turbed and that no structures would be built over the ditch itself. 3. 1.7hile the operation is in progress we assume that water will have to be pumped from the excavations. The water pumped from Borrow Area #1 we recommend be discharged into the Platte River, above our dam structure. 4. 1.e do not recommend that water pumped from Borrow Area #2 be discharged into the No. 3 Ditch. This ditch terminates at a point where any remaining water in the ditch flows into the Delta Ditch. The No. 3 Ditch runs at capacity most of the time and we feel that any additional water would create problems for our regulatory system. Perhaps water from Borrow Area #2 could be discharged into Borrow Area #1, and thence into the river. 5. Although ve have not consulted a hydrologist, we feel that there may be some loss of water in the ditch after these ex- cavations are completed. Box 350 Greeley, Colorado 30631 This is in reply to your request for soil evaluation for the NE of the NW,; of the NW4 of Sec. 22; Lots 1 and 2 of the SW; of the SW'-, — of Sec. 15 ; Sa of the SE4 of Sec. 16; and the NZ of the N'.', of the NEy Sec. 21, all in T5N, R65W of the 6th P.M. , a : l in vIeld County, Colorado. Evaluation is to determine the suitability of the area for borrow extraction. The soils in this area are deep and loose. The top 6-10 inches ranges from loamy sand to loam. Underlying this to a depth of 60 inches is sand or fine gravelly sand , with thin lenses of sandy loam and loam. As a source of topsoil, the area is- poor, being too sandy. It is a good source of sand. The gravel to be extracted here would be only fair as it is poorly graded. As a source of roadfill, the area is good provided that a binder is added . If extraction of materials is taken from close to the river, care should be taken so as to not pollute the South Platte Rivei . The soil survey is made on the basis of 50-60 inch borings .
