HomeMy WebLinkAbout20152842.tiff RESOLUTION RE: APPROVE CORRECTED DESCRIPTION OF THE BLOCKS AND LOTS BEING REPLATED -- PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF14-0009 - BAREFOOT LAKES, LLC, C/O BROOKFIELD RESIDENTIAL PROPERTIES - AS STATED IN RESOLUTIONS NUMBERS 2015-1214, 2015-2741 AND 2015-2742 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 6, 2015, by Resolution #2015-1214, the Board of County Commissioners approved the application of Barefoot Lakes, LLC, do Brookfield Residential Properties, 188 Inverness Drive West, Suite 150, Englewood, CO 80112, requesting a Site Specific Development Plan and Planned Unit Development Final Plan, PUDF14-0009, for an Amendment to First Filing, PF-1078 - Replat of Lots 1-32, Block 7; Lots 1-11, Block 8; Lots 1-14, Block 9; Lots 10-17, Block 10; Lots 1-7, Block 14 and Tract H, 243 Lots with R-1 (Low Density Residential); C-1 (Neighborhood Commercial); C-2 (General Commercial) Zone Uses and the Vacation of various rights-of-way, and continuing Oil and Gas Production Uses, along with approximately 213.1 acres of open space consisting of a river corridor, private recreational lakes and community parks in the 1-25 Regional Urbanization Area Overlay District - Barefoot Lakes PUD, for a parcel of land located on the following described real estate, to-wit: Part of Sections 25, 35, and 36, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, on August 17, 2015, the Board of County Commissioners approved two additional Resolutions (#2015-2741 concerning a Correction and #2015-2742 concerning an Improvements Agreement for said P.U.D.), which also reflected the same description of the blocks and lots being replatted, and WHEREAS, the applicant has provided a more accurate description of the blocks and lots being replatted in said P.U.D., as follows: A Site Specific Development Plan and Planned Unit Development Final Plan, PUDF14-0009, for an Amendment to First Filing, PF-1078 - Replat of Lots 1-84, Block 1; Lots 1-48, Block 2; Lots 1-18, Block 3; Lots 1-22, Block 4; Lots 1-22, Block 5; Lots 1-35, Block 6; Lots 1-85, Block 7; Lots 1-11, Block 8; Lots 1-14, Block 9; Lots 1-17, Block 10; Lots 1-19, Block 11; Lots 1-18, Block 12; Lots 1-48, Block 13; Lots 1-27, Block 14; Lots 1-39, Block 15; Lots 1-9, Block 17; Lots 1-30, Block 18; Tracts A through C, E through P, 293 Lots with R-1 (Low Density Residential); C-1 (Neighborhood Commercial); C-2 (General Commercial) Zone Uses and the Vacation of rights-of-way as indicated by this plat, and continuing Oil and Gas Production Uses along with approximately 213.1 acres of open space consisting of a river corridor, private recreational lakes and community parks in the 1-25 Regional Urbanization Area Overlay District, as indicated in the application materials on file, and subject to, and governed by, the Conditions of Approval stated hereon and all applicable Weld County regulations, and 2015-2842 PL1815 CC �c9/8 RE: APPROVE CORRECTED DESCRIPTION OF THE BLOCKS AND LOTS BEING REPLATED -- PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF14-0009 - BAREFOOT LAKES, LLC, C/O BROOKFIELD RESIDENTIAL PROPERTIES -AS STATED IN RESOLUTIONS NUMBERS 2015-1214, 2015-2741 AND 2015-2742 PAGE 2 WHEREAS, after review, the County Attorney's Office has determined that said revised description of the blocks and lots being replatted does not change the footprint or formal legal description of the proposal, nor does it cause a deficiency in notification to surrounding property owners. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Resolution #2015-1214, dated May 6, 2015, and Resolutions#2015-2741 and #2015-2742, both dated August 17, 2015, be, and hereby are corrected and amended to incorporate the following as the description of the blocks and lots being replatted in said P.U.D.: A Site Specific Development Plan and Planned Unit Development Final Plan, PUDF14-0009, for an Amendment to First Filing, PF-1078 - Replat of Lots 1-84, Block 1; Lots 1-48, Block 2; Lots 1-18, Block 3; Lots 1-22, Block 4; Lots 1-22, Block 5; Lots 1-35, Block 6; Lots 1-85, Block 7; Lots 1-11, Block 8; Lots 1-14, Block 9; Lots 1-17, Block 10; Lots 1-19, Block 11; Lots 1-18, Block 12; Lots 1-48, Block 13; Lots 1-27, Block 14; Lots 1-39, Block 15; Lots 1-9, Block 17; Lots 1-30, Block 18; Tracts A through C, E through P, 293 Lots with R-1 (Low Density Residential); C-1 (Neighborhood Commercial); C-2 (General Commercial) Zone Uses and the Vacation of rights-of-way as indicated by this plat, and continuing Oil and Gas Production Uses along with approximately 213.1 acres of open space consisting of a river corridor, private recreational lakes and community parks in the 1-25 Regional Urbanization Area Overlay District, as indicated in the application materials on file, and subject to, and governed by, the Conditions of Approval stated hereon and all applicable Weld County regulations. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of August, A.D., 2015.
