BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 12, 2015
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 12, 2015, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Barbara Kirkmeyer, Chair- EXCUSED
Commissioner Mike Freeman, Pro-Tern
Commissioner Sean P. Conway
Commissioner Julie A. Cozad
Commissioner Steve Moreno

• MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of October 7, 2015, as printed. Commissioner Cozad seconded the motion, and
it carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of
Hearings conducted on October 7, 2015, as follows: 1) USR14-0046 - The Estate of Windon Davis, do
Rick Davis 2) USR14-0071 - Timbro Ranch and Cattle Company, LLC, do Whiting Oil and Gas
Corporation, and 3) USR14-0072 - Timbro Ranch and Cattle Company, LLC, do Whiting Oil and Gas
Corporation. Commissioner Conway seconded the motion, which carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed.
Commissioner Moreno seconded the motion, and it carried unanimously.
• PUBLIC INPUT: No public input was given.
BIDS:
0 1) APPROVE BID #B1500152, (CNG) 1/2 TON PICKUP, EXTENDED CAB, SHORT BOX -
DEPARTMENT OF PUBLIC WORKS: Marcia Walters, Department of Purchasing, stated staff
recommends approval of the sole bid from Auto Nation Ford Littleton for the purchase of three (3)

vehicles, in the amount of $125,784.00. Commissioner Moreno moved to approve said sole bid. The
motion was seconded by Commissioner Cozad, and it carried unanimously.
• 2) APPROVE BID #B1500153, (CNG) 1/2 TON PICKUP, CREW CAB SHORT BOX -
DEPARTMENT OF PUBLIC WORKS: Ms. Walters stated staff recommends approval of the sole bid from
Auto Nation Ford Littleton in the amount of$125,784.00. Commissioner Conway moved to approve said
sole bid. Seconded by Commissioner Cozad, the motion carried unanimously.
• 3) PRESENT BID #B1500178, STADIUM LOCKER (COMMUNITY CORRECTIONS FACILITY) -
DEPARTMENT OF JUSTICE SERVICES: Ms. Walters presented the ten (10) bids received and stated
staff will bring back a recommendation on October 26, 2015.
NEW BUSINESS:
• 1) CONSIDER MARKETING SERVICES AGREEMENT AND AUTHORIZE CHAIR PRO-TEM TO
SIGN - DEX MEDIA: Carol Gessner, Department of Information Technology, stated the agreement is for
one year of advertising in the Greeley Dex phone directory in the amount of $198.00 per month.
Commissioner Conway moved to approve contingent upon the agreement including online listings and
authorize the Chair Pro-Tern to sign. The motion, which was seconded by Commissioner Cozad, carried
unanimously. (Clerk's Note: Ryan Rose, Director of Information Technology, confirmed via email the
agreement does include a provision for online listings.)
• 2) CONSIDER CONSTRUCTION AGREEMENT FOR TRM INSTALLATION (EM-BR34-17A AND
EM-BR19.5-36A)AND AUTHORIZE CHAIR PRO-TEM TO SIGN-ALL COWBOY EROSION CONTROL:
Don Dunker, Department of Public Works, explained this agreement is so the flood repair work can be
completed. Commissioner Conway moved to approve said agreement and authorize the Chair Pro-Tem
to sign. Commissioner Moreno seconded the motion, and it carried unanimously.
El 3) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY
AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN IMPROVEMENTS TO COUNTY
ROAD 49 AND AUTHORIZE CHAIR PRO-TEM TO SIGN NECESSARY DOCUMENTS - TOD MOORE:
Leon Sievers, Department of Public Works, reviewed the terms of the purchase agreement for a total of
$28,525.00. Commissioner Conway moved to approve said agreement and authorize the Chair Pro-Tem
to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously.
El 4) ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE INJUNCTION AGAINST
APOLINAR VALLEJO, AND FRANCISCO BARRON FOR VIOLATION OF THE WELD COUNTY CODE
(ZCV14-00172): Frank Haug, Assistant County Attorney, expressed the decision before the Board is to
pursue an injunction and displayed slides of the violation. The property owners have applied for, but not
completed, a Use by Special Review Permit and the daily penalty assessment has not worked to resolve
the issue. Veronica Olivas, representative for the Apolinar Vallejo and Francisco Barron, explained she
is the business manager and hasn't been able to complete the application because the owner has had
personal issues. Kent Peterson, adjacent property owner, stated he represents the other adjacent
neighbors. He submitted a timeline of events for the record. In response to Commissioner Moreno, Mr.
Peterson stated the property owners only put a notice letter without a return address in the Rhoades'
mailbox. Commissioner Conway asked Bethany Pascoe, Zoning Compliance Officer, for her insight on
this violation which she reported the City of Platteville expressed concerns and indicated they are going
to impose a daily fee for the excessive amount of traffic. Mr. Haug made known that Wayne Howard from
the Department of Planning Services told the applicant they need to hire an engineer to obtain a drainage
report. Ms. Olivas requested the Board consider a different option other than shutting down the business.

Commissioner Conway expressed his disappointment in the property owner and the blatant disregard for
neighboring citizens. Bruce Barker, County Attorney, stated the proper language for the motion is to move
to refer the matter to the County Attorney's Office for the immediate filing of an action seeking an
injunction against the business. Mr. Barker reported to Chair Pro-Tem Freeman explaining the time frame
of shutting down the business can take about forty-five (45) days. Commissioner Cozad moved to refer
to the County Attorney's Office topursue an against Apolinar Vallejo and Francisco

Barron. Seconded by Commissioner Moreno, the motion carried unanimously. Commissioner Conway
recommended the owners not move their business to a different location and to start doing the right thing.
Commissioner Moreno expressed that having open communication with the neighbors is of utmost
importance.
5) CONSIDER TEMPORARY CLOSURE OF CR 6 BETWEEN CRS 19 AND 21: Janet Lundquist,
Department of Public Works, stated the temporary closure will be effective October 26, 2015, through
November 6, 2015, for a bridge re-deck. She said staff will use magnesium chloride for dust abatement
on the detour route along with standard road signs and barricades. Commissioner Conway moved to
approve said temporary closure. Commissioner Cozad seconded the motion, and it carried unanimously.
6) CONSIDER TEMPORARY CLOSURE OF CR 33 BETWEEN CR 42 AND U.S. HIGHWAY 85:
Ms. Lundquist requested the matter be continued to October 14, 2015, to allow final details to be worked
out with the applicant. Commissioner Cozad moved to continue this matter to Wednesday, October 14,
2015. The motion, which was seconded by Commissioner Moreno, carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 10:02 a.m.
