This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 76 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. No (ADT) traffic count number at this location. REQUIREMENTS: Weld County Road Access Permit Form: Show the approved access on the plat and label it with the approved access permit number (AP#). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code Traffic: There are two divisions, turf installation and a trucking division. There are two (2) employees on the trucking side that come to the site each day and up to seven (7) persons associated with the turf installation side. There is no parking or staging of vehicles on CR 76. Use on- site parking. Drainage: In the questionnaire, Item E (Stormwater): A water quality feature has been designated for this area. The applicant needs to supply design and calculations. Contact Planning/Engineering Division, Jennifer Petrik, P.E., 970-356-4000, ext. 3552 for review or comments. The historical flow patterns and run-off amounts will be maintained on site. Improvements and Road Maintenance Agreement: Not required for the existing number of trucks and employees. C:\Users\tjuanicorena\AppData\Local\Microsoft\Windows\Temporary Internet Files\Content.lE5\KHSY68N9\USR14-0041- Kay°%20Collins%20&%20Ryan°%20Gallatin[1].docx MEMORANDUM ,EL ) \ TO: KIM OGLE,PLANNING SERVICES N TTY FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR14-0043 DATE: AUGUST 20, 2014 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (landscape turf installation, trucking and truck repair shop along with outside equipment/vehicle storage and staging), provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. The application indicates there are currently 9 employees that come to the site but there may be up to 15 employees in the future. The property is served by North Weld Water District. A letter was provided from the District which indicated no issues with this proposed use. There is a septic system located on the property (SP-0900053) which was sized for 4 bedrooms/8 people. Approval for the addition of a 5th bedroom was granted as the existing field size was within 20 percent of the required field size in accordance with EH policy. The application states the restroom in the house is utilized by employees. Any additional hydraulic load to the existing septic system which exceeds sizing requirements shall require a review by a Colorado registered professional engineer and in the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. Portable toilets can be utilized for employees as it is the policy of this department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. As drivers will be on site for a short duration, in accordance with Environmental Health Services policy, the use of portable toilets is allowed. There is also a residence located on the adjoining parcel addressed as 19316 CR 76 which is served by North Weld Water District and a septic system (G19899071). According to the application the parcel is included in this request since a portion of the parking lot is located on this site. An on sight dust abatement plan was not included with the application and is required. The waste handling plan indicates that Northern Colorado Disposal will provide trash removal. Used oil and other vehicle fluids generated from vehicle maintenance will be taken to Empire Truck Center. The recycling of tires will be done by Schroeder Tire and Rubber. There is a floor drain in the maintenance shop which the applicant has stated is capped. The applicant indicated a watertight vault will be installed and contents will be removed for proper off-site disposal. The application states that no vehicle washing is done onsite. If equipment washing occurs onsite, the wash water discharge must be contained for proper offsite disposal. The fuel tanks on site must have secondary containment in case of a spill. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to recording the plat: 1. The applicant shall submit a Dust Abatement Plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 2 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. In the event the existing septic system is utilized for business use, the septic system shall be reviewed by a Colorado registered professional engineer if the usage surpasses septic permit SP-0900053 sizing limitations. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. 9. Sewage disposal shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the public water supply. (North Weld County Water District) 11.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 3 12. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 13.The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 14.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 4 MEMORANDUM C.= To: Kim Ogle, Planner August 5, 2014 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR14-0043 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV14-00010)was noted. This violation was initiated due to the operation of a Commercial Trucking operation without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have initiated legal action; therefore, an investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied,the Commercial Trucking operation shall be removed from the property within 30(thirty)days of denial or the violation will proceed in court accordingly.
