HomeMy WebLinkAbout20152836.tiff RESOLUTION RE: APPROVE TASK ORDER CONTRACT FOR LEAD SURVEILLANCE COLORADO CHILDHOOD LEAD POISONING PREVENTION PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Task Order Contract for the Lead Surveillance Colorado Childhood Lead Poisoning Prevention Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Colorado Department of Public Health and Environment, commencing September 30, 2015, and ending September 29, 2016, with further terms and conditions being as stated in said task order contract, and WHEREAS, after review, the Board deems it advisable to approve said task order contract, a copy of which is attached hereto and incorporated herein by reference. Wallace, MD, MPH, Executive Director Brief description of the problem/issue: Enclosed for the Board's review and approval is a Task Order Contract for the Lead Surveillance — Colorado Childhood Lead Poisoning Prevention Program between the Colorado Department of Public Health and Environment (CDPHE) and the Board of County Commissioners of Weld County for the use and benefit of the Weld County Department of Public Health and Environment (WCDPHE). The Task Order term is September 30, 2015, through September 29, 2016. WCDPHE currently conducts surveillance, investigation, and reporting of elevated childhood blood lead levels (paid with local dollars). The CDPHE has offered us a contract in the amount of$18,000 to provide operational funding to fund our local program. This funding originates at the U.S. Department of Health and Human Services through the CDC. This is part of a state initiative to provide funding to local public health agencies that experience the largest burden of elevated childhood blood lead cases in Colorado. As a part of this proposed contract, WCDPHE will actively participate in CCLPPP workgroups and meetings to develop efficiencies through the development of systematic guidelines, processes, and reporting requirements for elevated blood lead cases by collaborating with the State and other counties. WCDPHE will continue to conduct case investigations on elevated childhood blood lead levels as we have in the past, however, now our findings will be reported to CDPHE. No additional FTE will be required to provide the grant deliverables. Assistant County Attorney Frank Haug has reviewed this contract and it meets with his approval. What options exist for the Board? (Include consequences, impacts, costs, etc. of options) 1. Continue operating as-is without contractual funding from CDPHE. For the past eight years WCDPHE has operated and funded the Health Department's lead program without State assistance including FTE, equipment, sampling, and investigations of elevated childhood blood lead cases within the county. 2. Approve the contract with CDPHE's CCLPPP to cover program costs including FTE, equipment and equipment maintenance, sampling, and investigations. The funding will fully cover the program's costs and result in saving the County associated expenditures for the program. The instrumentation used for investigations requires maintenance and calibration every four to five years costing $6,500 in 2010. This funding will allow WCDPHE the means to keep the instrumentation in good working order. Recommendation: I recommend approval of this task order contract for our lead surveillance program. STATEWIDE CONTRACT MANAGEMENT SYSTEM[This section shall apply when the Effective Date is on or after July 1, 2009 and the maximum amount payable to Contractor hereunder is$100,000 or higher] By entering into this Task Order Contract,Contractor agrees to be governed,and to abide,by the provisions of CRS§24-102-205,§24-102-206,§24-103-601,§24-103.5-101 and§24-105-102 concerning the monitoring of vendor performance on state contracts and inclusion of contract performance information in a statewide contract management system. Contractor's performance shall be evaluated in accordance with the terms and conditions of this Task Order Contract,State law,including CRS§24-103.5-101,and State Fiscal Rules,Policies and Guidance. Evaluation of Contractor's performance shall be part of the normal contract administration process and Contractor's performance will be systematically recorded in the statewide Contract Management System. Areas of review shall include,but shall not be limited to quality,cost and timeliness.Collection of information relevant to the performance of Contractor's obligations under this Task Order Contract shall be determined by the specific requirements of such obligations and shall include factors tailored to match the requirements of the Statement of Project of this Task Order Contract.Such performance information shall be entered into the statewide Contract Management System at intervals established in the Statement of Project and a final review and rating shall be rendered within 30 days of the end of the Task Order Contract term.Contractor shall be notified following each performance and shall address or correct any identified problem in a timely manner and maintain work progress. Should the final performance evaluation determine that Contractor demonstrated a gross failure to meet the performance measures established under the Statement of Project,the Executive Director of the Colorado Department of Personnel and Administration(Executive Director),upon request by the Colorado Department of Public Health and Environment and showing of good cause,may debar Contractor and Contract_Template_Task_Order_012215.doc Page 3 of 6 • prohibit Contractor from bidding on future contracts.Contractor may contest the final evaluation and result by:(i)filing rebuttal statements,which may result in either removal or correction of the evaluation(CRS §24-105-102(6)),or(ii)under CRS§24-105-102(6),exercising the debarment protest and appeal rights provided in CRS§§24-109-106, 107,201 or 202,which may result in the reversal of the debarment and reinstatement of Contractor,by the Executive Director,upon showing of good cause. 8. This Task Order Contract contains federal funds(see Catalog of Federal Domestic Assistance(CFDA) number 93.753). 2. The United States Department of Health and Human Services("USHHS"),through the Centers for Disease Control and Prevention("CDC")has awarded as of 11/14/2014 anticipated federal funds of$259,275.00 under Notice of Cooperative Agreement Award,hereinafter"NCAA",number lUE1EH001254,to perform the following—Childhood Lead Poisoning Prevention. If the underlying Award authorizes the State to pay all allowable and allocable expenses of a Contractor as of the Effective Date of that Award,then the State shall reimburse the Contractor for any allowable and allocable expenses of the Contractor that have been incurred by the Contractor since the proposed Effective Date of this Task Order Contract. If the underlying Award does not authorize the State to pay all allowable and allocable expenses of a Contractor as of the Effective Date of that Award,then the State shall only reimburse the Contractor for those allowable and allocable expenses of the Contractor that are incurred by the Contractor on or after the Effective Date of this Task Order Contract,with such effective date being the later of the date specified in this Task Order Contract or the date the Task Order Contract is signed by the State Controller or delegee. 3. To receive compensation under the Contract,the Contractor shall submit a signed Monthly CDPHE Reimbursement Invoice Form. This form is accessible from the CDPHE internet website http://www.colorado.gov/cs/Satellite/CDPHE-\lain/CBON/1251622941228 and is incorporated and made part of this Contract by reference.CDPHE will provide technical assistance in accessing and completing the form.The CDPHE Reimbursement Invoice Form and Expenditure Details page must be submitted no later than forty-five(45)calendar days after the end of the billing period for which services were rendered. Expenditures shall be in accordance with the Statement of Work and Budget. Scan the completed and signed CDPHE Reimbursement Invoice Form into an electronic document. Unless otherwise provided for in the Contract,"Local Match",if any,shall be included on all invoices as required by funding source. The Contractor shall not use federal funds to satisfy federal cost sharing and matching requirements unless approved in writing by the appropriate federal agency. 4. Time Limit For Acceptance Of Deliverables. Page 1 of 2 Contract Exhibit-A_AdditionalProvisions_TaskOrder 040715 EXHIBIT A a. Evaluation Period. The State shall have forty-five(45)calendar days from the date a deliverable is delivered to the State by the Contractor to evaluate that deliverable,except for those deliverables that have a different time negotiated by the State and the Contractor. b. Notice of Defect. If the State believes-in good faith that a deliverable fails to meet the design specifications for that particular deliverable,or is otherwise deficient,then the State shall notify the Contractor of the failure or deficiencies,in writing,within forty-five(45)calendar days of: 1) the date the deliverable is delivered to the State by the Contractor if the State is aware of the failure or deficiency at the time of delivery;or 2)the date the State becomes aware of the failure or deficiency.The above time frame shall apply to all deliverables except for those deliverables that have a different time negotiated by the State and the Contractor in writing pursuant to the State's fiscal rules. c. Time to Correct Defect.Upon receipt of timely written notice of an objection to a completed deliverable,the Contractor shall have a reasonable period of time,not to exceed forty-five(45) calendar days,to correct the noted deficiencies. If the Contractor fails to correct such deficiencies within forty-five(45)calendar days,the Contractor shall be in default of its obligations under this Task Order Contract and the State,at its option,may elect to terminate this Task Order Contract or the Master Contract and all Task Order Contracts entered into pursuant to the Master Contract. 5. Health Insurance Portability and Accountability Act(HIPAA)Business Associate Determination. The State has determined that this Contract does not constitute a Business Associate relationship under HIPAA. 6. This award does include funds for Research and Development. 7. Transfer of funds within the Budget: a. Transfer funds between budget lines if the total of all cumulative transfers is less than 25%of the budgeted amount does not require Lead Section approval.However the Contractor shall notify the Section of the changes in writing prior to the transfer of funds. b. When the cumulative total of all transfers equals or exceeds twenty five percent(25%)of the total budgeted amount,the Contractor must obtain written permission from the Lead Section to move any funds between lines.The Contractor shall submit the Lead Section approved budget modification form prior to making revised expenditures.The Lead Section staff will evaluate the request and inform the Contractor of a decision within 15 calendar days of receiving the request. 8. The State may increase or decrease funds available under this Contract using a Grant Funding Letter substantially equivalent to Exhibit D.The Grant Funding Letter is not valid until it has been approved by the State Controller or designee. Target Geographical Area Weld County,Colorado IV. Work Plan: Goal#1: Prevent and ultimately eliminate childhood lead poisoning in Colorado. Objective#1: Provide each child identified with an elevated blood lead level in the target geographical area with proper care, education,and information about lead poisoning in an effort to reduce his/her lead level. Primary Activity#1 The Contractor shall perform exposure investigations in the target geographical area. 1. The Contractor shall conduct exposure investigations to determine the cause of an elevated blood lead level in the home of every child that has a confirmed elevated blood lead level test result,as reported to the Contractor by CDPHE. 2. The Contractor shall notify CDPHE,via email,if there is insufficient staff capacity and ability to perform exposure investigations. a. If the Contractor does not have the staff capacity and/or ability to perform an Sub-Activities#1 exposure investigation,Environmental Protection Specialists from the CDPHE Air Pollution Control Division will assist to coordinate or conduct the investigation. 3. The Contractor shall collect exposure investigation information via the Exposure Investigation Report Form, or an alternate method as approved by CDPHE,and report findings to CDPHE. 4. The Contractor shall report investigation findings via a follow-up letter to the families of the children with elevated blood levels and providers. Primary Activity#2 The Contractor shall compile and share educational materials related to lead poisoning. Sub-Activities#2 I. The Contractor shall research and compile existing educational materials to share with other LPHA's,as directed by CDPHE.The Contractor shall have the option of creating Page 1 of 3 Contract Statement of Work—Exhibit B January 2015 EXHIBIT B new educational materials under this project. 2. The Contractor shall provide the family of every child with an elevated blood lead level with educational materials that promote lead poisoning prevention. Primary Activity#3 The Contractor shall attend trainings and meetings as directed by CDPHE. 1. The Contractor shall attend a minimum of one(1)CCLPPP conference call orientation meeting as directed by CDPHE. Sub-Activities#3 2. The Contractor shall attend and participate in a minimum of six(6)Colorado Lead Coalition meetings as directed by CDPHE.The goal of these meetings shall be to develop efficiencies through the development of systematic guidelines,processes,and reporting requirements for elevated blood lead cases. I. The Contractor shall use a CDPHE-provided Exposure Investigation Report Form, or an alternate method as approved by CDPHE,to collect exposure investigation information to submit to CDPHE. a. V. Monitoring: CDPHE's monitoring of this contract for compliance with performance requirements will be conducted throughout the contract period by the Lead Surveillance Coordinator. Resolution of Non-Compliance: The Contractor will be notified in writing within forty-five(45)calendar days of discovery of a compliance issue. Within forty-five(45)calendar days of discovery,the Contractor and the State will collaborate,when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and time line for completion will be documented in writing and agreed to by both parties. If extenuating circumstances arise that requires an extension to the time line,the Contractor must email a request to the Lead Surveillance Coordinator and receive approval for a new due date.The State will oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution plan, the State may exercise its rights under the provisions of this contract.
