HomeMy WebLinkAbout20150781.tiff WELD COUNTY CODE ORDINANCE 2015-3 IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, AND CHAPTER 3 HUMAN RESOURCES, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as follows. CHAPTER 2 ADMINISTRATION Amend Sec. 2-1-120. Delegation of authority. Pursuant to Section 30-11-107(1)(aa), C.R.S., the Board of County Commissioners establishes policies and procedures regarding entering into contracts binding on the County and the delegation of its powers to enter into such contracts pursuant to such policies and procedures: A. The Chair of the Board is delegated the authority to sign certain personal service contracts and maintenance agreements, when approved as to form by the County Attorney's Office, as follows: 1. All contracts on behalf of the County for personal service contracts under twenty-five thousand dollars ($25,000.00). 2. All change orders to contracts for construction projects of up to five percent (5%) of the original contract amount, not to exceed twenty-five thousand dollars ($25,000.00), as provided in Section 5-4-140.D. All contracts on behalf of the County for all equipment maintenance contracts under twenty-five thousand dollars ($25,000.00). 4. All related contracts and license agreements for computer hardware and software operating in the County and twenty-five thousand dollars ($25,000.00). 5. All computer-related agreements and documents to acquire and maintain computer systems under twenty-five thousand dollars ($25,000.00). B. The Chair of the Board is delegated authority to sign certain agreements with municipalities in Weld County for road and street design, construction and/or maintenance within the jurisdictional boundaries of the municipalities, up to the amount of twenty-five thousand dollars ($25,000.00), whereby the municipality will reimburse Weld County for the entire cost of such work upon completion of the project. C. The Chair of the Board is delegated authority to sign any standard letter of assignment/consent. D. The Chair of the Board is delegated authority to approve and sign all oil and gas division orders and authorizations to receive oil or gas payment, after review by the County Attorney's office for correctness of ownership interest, form and legal description. E. Delegation of authority to Sheriff. 1. The Sheriff is delegated the authority to enter into agreements that are binding upon the County for personal services related to criminal investigations. 2. The Sheriff is delegated the authority to enter into those law enforcement special duty agreements which are estimated to require seventy-two (72) or fewer hours of Sheriff deputies' time. The Board of County Commissioners retains the authority to enter into all law enforcement special duty agreements which are estimated to require more than seventy-two (72) hours of Sheriff deputies' time. F. As stated at Section 2-4-60, the Board of County Commissioners authorized the Assessor to review petitions for abatement or refund and to settle, by written mutual agreement, any such petition for abatement or refund of taxes in an amount of one thousand dollars ($1,000.00) or less per tract, parcel or lot of land, or per schedule of personal property. The Board of County Commissioners will consider any petition under one thousand dollars ($1,000.00) where agreement was not reached between the Assessor and the taxpayer. G. The Department Heads and Elected Officials are delegated the authority to approve invoices for goods or services under twenty-five thousand dollars ($25,000.00), as provided in Section 5-4-60. The Director of the Department of Public Health and Environment is delegated the authority to order the isolation and/or quarantine, including specified monitoring conditions, of any person if, in his or her professional medical opinion, the Director believes necessary for the protection of public health, as permitted by Section 25-1-506, C.R.S. Add Sec. 2-1-125. Delegation of Authority to Sign Standard Form Agreements. The Board of County Commissioners periodically approves, by Resolution, standard form agreements, each of which are available from the Clerk to the Board's Office. A. The Chair to the Board is delegated the authority to sign any agreement in substantial conformance with the following: 1. Standard Form GIS Data License Agreement. 2. Standard Form of License and Exchange Agreement for Geographic Data. 3. Standard Form of Agreement for Access to Clerk and Recorder Data Base. 4. Standard Forms of Agreements for Conduct of Coordinated Elections, including various forms for Master Version, Tabor Version, and School Version of Memorandum of Intergovernmental Agreements for conducting Coordinated Elections. 5. Standard Form of Electronic Recording Memorandum of Understanding. 6. Standard Forms of Memorandum of Understanding Concerning Use of Building. 7. Standard Form for Child Protection Agreement for Respite Care. 8. Standard Form for Addendum to Agreement to Purchase Therapeutic Residential Child Care Facility Services/Residential Child Care Facility Services. 9. Standard Form for Addendum to Agreement to Purchase Child Placement Agency Services. 10. Standard Form for Individual Provider Contract for Purpose of Foster Care Services and Foster Care Facility Agreement and the Addendum to Individual Provider Contract for Purpose of Foster Care Services and Foster Care Facility Agreement. 13. Standard Form of Agreement and Addendums to Agreement to Purchase Out-of-Home Placement Services. 14. Standard Form of Agreement and Addendum to Agreement to Purchase Group Home/Group Center Care Services. 15. Standard Form of Weld County Retired Employee Employment Contract. 16. Standard Form of Agreement for Municipal Jail Services. B. Delegation of authority concerning various forms of standard agreements for Elections Division Facility Usage. As necessary, the Board of County Commissioners may approve, by Resolution, various form agreements for the utilization of locations by the Elections Division for ballot drop off locations, and voter service centers and polling centers. By said Resolution, the Board grants standing authority to the Clerk and Recorder to sign such agreements, after review by the County Attorney to verify that they were completed in accordance with the form approved by the Board. C. The Director of the Weld County Department of Public Health and Environment is delegated the authority to sign any agreement in substantial compliance with the following: Standard Form Agreements for Sampling and Analysis of Drinking Water and/or Wastewater by the Weld County Department of Public Health and Environment. D. The Weed Division Supervisor, Department of Public Works, is delegated the authority to sign any agreement in substantial conformance with the following: 1. Standard Form Agreement for Chemical Weed Control Cost Share Agreement. 2. Standard Form Agreement for Chemical Weed Control Cost Share Agreement Through West Greeley Conservation District. 3. Payday for all employees will be the last working day of the month. If payday falls on a holiday, employees will be paid the last regularly scheduled workday before the holiday. Pay periods are from the sixteenth of the month through the fifteenth of the following month. Remainder of Section - No change. BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 2015-3 was, on motion duly made and seconded, adopted by the following vote on the 23rd day of March, A.D., 2015.
