RESOLUTION WHEREAS, a public hearing was held on May 24, 1976, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Melvin Geib, Pierce, Colorado, (Ayers Land) requesting permission to locate a gravel pit operation on the following described property: That part of the East Half (ED of the Northeast Quarter (NE4) of Section 7, Township 8 North, Range 65 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast Corner of said Section 8, said point being the True Point of Beginning and considering the East line of the Northeast Quarter (NE4) of said Section 7 as bearing South 01°20'50" East, with all bearings contained herein being relative thereto; Thence South 01°20'50" East along said East line 2589. 83 feet; thence South 89°08'48" West 1339. 67 feet; thence North 01°15'20" West 2585. 69 feet, thence North 88°55'53" East 1335. 24 feet to the True Point of Beginning. Said described parcel of ground contains 79. 45 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petition for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Melvin Geib, Pierce, Colorado, (Ayers Land) to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. Staff feels that instead of moving the residence, a better solution would be to move the lot lines a distance of three feet on the left. The residence is being constructed on Lot 2. Lot 3 is currently vacant; both lots are owned by the applicant. Section 6.4 (A) of the Weld County Subdivision Regulations requires resubdivision of land or changes to a recorded plat to be considered as a subdivision and comply with regulations of this particular section. The Weld County Planning Commission staff recommends that this request be approved for the following reasons: 1 ) The replatted lots do not conflict with the Weld County Zoning Resolution requirements for minimum lot area or lot width; 2) no new lots are being created; only one lot line is being changed; 3) drainage ease- ments or rights-of-way reserved for drainage are not being changed; 4) street locations and street rights-of-way are not being changed; 5) this replat will not adversely affect the character of the plat filed and recorded; and 6) letters from all the pertinent utility companies have been submitted and none of them have any objection to this request. RESOLUTION: Be it therefore resolved to recommend to the Board of County ,`Commissioners approval of the Marlynn, Inc. (S-120) replat. Motion by John Weigand. Seconded by Harry Ashley. E' NEq Sec. 7 T8N R65W DISCUSSION: Mr. Geib explained that this is a dry pit. Later, various /` materials will be screened out and a batch plant started in the future. He explained that the market value is good with farmers in the area. The Weld County Planning staff recommends approval _ - -\ for the following reasons : 1 ) The request is in compliance with the adopted policies in Weld County; 2) all requirements of Section 6. 1 (3) of the Weld County Zoning Resolution have been fulfilled; 3) the Colorado Geological Survey found no serious geologic problems involved with the proposed operation; 4) the Weld County Engineering Department has reviewed the application and has not found any problem with the proposal ; 5) the Weld County Health Department recommends approval of the application; and 6) no response has been received from the Pierce Lateral : SUBJECT TO: The Special Use Permit shall be limited to the plans submitted and governed by the extraction standards as stated on the ex- traction plan map and by the reclamation standards as stated on the reclamation plan map. Any changes to the plans, extraction stan- dards and/or reclamation standards shall require approval of another Special Use Permit before such changes shall be allowed. Page 1263 However, it should be clarified on the plat, prior to the Board of County Commissioners ' hearing, that K. Eugene Ayers, property owner, should be made party to the Certificate of Responsibility and Extraction standards. Ernest L. Hagan objected in writing to this application. He has four shallow wells situated in the NW corner of his property in the N2 NWq Sec. 8 T8N R65W which lies directly east of this application. He is afraid that the operation would adversely affect those wells by lowering the water level . It was clarified by Mr. Mr. Geib that the application should be "Melvin Geib" - not "Melvin Geib, Inc. " Mr. Geib explained that the potential depth would not be over twenty feet. Mrs. Hagan explained that the four wells have been adjudicated, one as a domestic well . Her only objection would be if the pit effects the wells. Gil Olson, County Engineering Dept. , made an on-sight inspection and saw no problems with the proposal . Mr. Ayers, owner of the property in question, was in the audience and he stated that he would join with Mr. Geib in this application. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request for a gravel pit (SUP 298) subject to staff recommendations. Motion by Bill Elliott. Seconded by J. Ben Nix. A vote of "aye" by Ashley, Elliott, Heitman, Carlson, and Nix. Heitman abstained. S2 Sec. 31 T1N R66W DISCUSSION: Mr. Vienot wishes to erect a cabinet shop and move his business from Brighton to this area. He owns the two adjoining properties to the north of this area. The Weld County Planning staff recommends approval for the following reasons: 1 ) The Weld County Comprehensive Plan states that "Commercial development should be restricted to the incorporated areas of municipalities." Although this request is not now within the incorporated limits of Brighton, it most certainly will be within the near future; 2) the City of Brighton' s Planning Commission and staff have commented, "The proposed use is not in conflict with our comprehensive land use plan. The City of Brighton has no objections to this proposed zone change and development. " ; 3) Mr. Elmer Fahrenbruck of the Brighton Fire District commented verbally that there was adequate water for fire fighting purposes via a 10" water line installed in conjunction with the Western Company development which lies immediately adjacent to the west; 4) The Weld County Health De- partment recommends approval of the request; 5) the Weld County Engineering Departmenthas reviewed the application and plans. Their comments are as follows: a) the proposed access is okay.
