REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE

A public hearing was conducted on February 18, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 16, 2015, and duly published
January 21, 2015, in the Greeley Tribune, a public hearing was conducted to consider the
request of John and BrandiLynn Greig, for a Site Specific Development Plan and Use by
Special Review Permit, USR14-0076, for a Use permitted as a Use by Right, Accessory Use or
Use by Special Review Permit in the Commercial or Industrial Zone Districts (office for a speech
therapy center) provided that the property is not a lot in an approved or recorded subdivision
plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in
the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter
of record.
e Diana Aungst, Department of Planning Services, presented a brief summary of the
proposal stating this is for a Speech Therapy Center that will have up to ten (10) full time
employees and approximately 25 families visiting per day. She stated 17 referral responses
were sent out and 13 were returned with either no concerns or no response indicated. The site
is not in a flood hazard area; adjacent properties are agricultural with the exception of one USR
within one (1) mile of the site which is for a lanscape supply business. There were no responses
received from surrounding property owners. The site is located within the three (3) mile referral
area of the Towns of Berthoud, Mead, and Johnstown with Johnstown expressing no concerns
and the others had no response. She displayed images of the site and adjacent area to include
the reservoir, plans for the building, landscaping, parking, and accesses, and entered the

favorable recommendation of the Planning Commission into the record as written. In response
to commissioner questions, Ms. Aungst stated: the hours of operation were revised to allow a
margin of time for clients arriving early or staying late, the outdoor parking must be screened
according to the code, there is a large dairy in the area, and light from the light poles must be
shielded.
El Wayne Howard, Department of Planning Services Engineer, provided a brief overview of
the related roadways, right-of-ways, and requirements for setbacks specific to CR 13 which is
an arterial road. Two (2) accesses have been granted and it was noted the site is not in a
geohazard area, the water quality calculation was acceptable, and if more than one (1) acre is
disturbed a Grading Permit will be required. In response to Commissioner Cozad, he said
landscaping efforts should be considered in light of the four right-of-way lines designated on the
site map so as not to affect the right-of-ways.
IR Heather Barbare, Department of Public Health and Environment, reviewed the water and
sewer provisions. Little Thompson Water District will provide water service and the septic
system for the house is approved for up to eight (8) people, therefore, the septic will have to be
evaluated if the use exceeds eight (8) people per day. Water will be used for dust abatement,
and a dumpster will be used for waste handling.
e Brandilynn and John Grieg, applicants, displayed a PowerPoint presentation, Planning
Commission Exhibit #1, and stated they are dedicated to working with the under-served
population of Weld County children ages 3 through 19 with significant disabilities. This business
will provide therapists who assist families in a variety of ways to include advocating for, and
assisting with, the needs of each family member. The therapies offered are speech, physical
and occupational. It is a family-oriented center with the hope of providing services for the
children and respite for the caregivers during therapy sessions. The outdoor area and peaceful
surroundings are beneficial to the children and their families. In response to Commissioner
Conway, Ms. Greig indicated the neighbors are present and know about the time change with
the hours of operation, and in response to Chair Kirkmeyer, she confirmed the northern access
is for the speech therapy center and the other access is primarily for their residence.
El Esther Blaison, neighbor to the south, stated that she and her husband are both retired
and that she worked all her professional years in service as a psychotherapist and they are
excited about the concept and very much support the nature of the business to include the
change in hours.
e In response to Chair Kirkmeyer, Mr. and Mrs. Greig had a question about the landscaping
screening regarding the parking lot and screening views of traffic related to safety. Chair
Kirkmeyer suggested the deletion of Condition of Approval #1.A. Commissioner Cozad agreed
with Chair Kirkmeyer and also expressed her concern with the screening because it may block
the right-of way, and block the view from both directions. The Commissioners agreed with the
following changes: deletions of Conditions of Approval #1.A and #1.6.5, renumbering and
changing the language on Conditions of Approval #1.B.6 and #1.6.7, deleting Development
Standards#7 and #8, and amending Development Standard #6.

e In response to Chair Kirkmeyer, John and BrandiLynn Greig indicated they have reviewed,
and agree to abide by, the Conditions of Approval and Development Standards, as amended.
Commissioner Conway moved to approve the request of John and BrandiLynn Greig for a
Site Specific Development Plan and Use by Special Review Permit, USR14-0076, for a Use
permitted as a Use by Right, Accessory Use or Use by Special Review Permit in the
Commercial or Industrial Zone Districts (office for a speech therapy center) provided that the
property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed
prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards as amended. The motion was seconded
by Commissioner Cozad who commended the public for being present and also the applicant
for meeting a definite need in Weld County. The motion carried unanimously. There being no
further discussion, the hearing was completed at 10:59 a.m.
This Certification was approved on the 23rd day of February, 2015.
