To Mr. Ogle and Weld County Commissioners: I would like to voice my objections to granting JM Trucking LLC EXHIBIT i D approval to operate from 15524 County Road 6. s le -DD 1 County Road 6 is one of the main access roads out for the residents of Country Estates who go to Brighton via Road 31 or continue down Road 6 to HWY 85 . The roads here do not have a good base to them as in this area it's all sand. The public Works Department, late this summer, worked hard to begin to get a good base to Road 6 but all the heavy truck traffic is taking it's toll again and the road becomes washboard rough and the road grader has to blade down to smooth the ruts out. Road 31 between County Roads 4 and 6 in wet weather becomes slimy slick and the heavy vehicles wear deep ruts in the roads. Road 6 west of Road 31 has a very sharp turn and is not designed for larger and longer vehicles. Along this sharp turn a driveways that access Rod 6. There have been some very bad accidents in this area and drivers of large vehicles must use whole width of Road 6 to navigate this blind curve. Having lived in this area since 1982 in Country Estates this area has been building up with some very expensive homes along Road 6 and one property was completely renovated and is now a showplace. Everyone here enjoys the QUIET country lifestyle and a trucking company would destroy this tranquility. Would you want to wake up to the noise early in the morning and in the evening? 2 JM Trucking to gain access to the property must use a shared driveway and to make a turn out or in from Road 6 must use the whole width of the road in making the turns. Other concerns are the damage to the land that is caused by oil dripping from the trucks and possible diesel fuel leakage. The land here is VERY fragile and does not come back from damage quickly. Also any spillage could seep into the Brighton Lateral Ditch. Property owners bought and built homes along Road 6 because of the quiet rural setting. Property values will fall by allowing industrial firms to gain a foothold in this area. This area is zoned Agriculture not Industrial.. Please vote NO to allow JM Trucking a permit to operate in this rural agricultural area. A commercial trucking firm does not fit in this area. Thank You, Kathy Boerema 2091 Tate Avenue Fort Lupton, CO 3 Esther Gesick EXHIBIT From : Barbara Kirkmeyer Sent: Wednesday, December 09, 2015 11 : 14 AM 2a / 5 'CD To : Esther Gesick; Bruce Barker; Tom Parko Jr. Subject: Fwd: 15524 County Road 6 Have a great day Begin forwarded message: From : "EquestrianElegnc@aol.com" <EquestrianElegnc@aol.com> Date: December 8, 2015 at 9: 12:52 PM MST To: "bkirkmeyer@weldgov.com" <bkirkmeyer@weldgov.com>, "mfreeman@weldgov.com" <mfreeman@weldgov.com>, "j cozad@weldgov.com" <jcozad@weldgov.corn>, "sconway@weldgov.com" <sconway@weldgov.com>, "smoreno@weldgov.com" <smoreno@weldgov.com Subject: 15524 County Road 6 Dear Commissioners Kirkmeyer, Conway, Cozad, Freeman and Moreno, I am opposed to JM Trucking LLC operating a business at 15524 County Road 6 Fort Lupton CO. This is a rural, residential, agricultural area. A commercial trucking company does not fit in. There are no other businesses in the immediate area. There are several homes within a couple of hundred feet of this site. The route in and out has many residences with small children plus it is very dangerous to have truck traffic on a winding, curvy, bumpy dirt road that already has a list of accidents including fatalities. And, NO, we don't want our dirt roads paved! In the unfortunate event it is approved, I request that the county consider the following: JM Trucking would be required to: Use Weld County Road 31 to and from the location at 15524 County Road 6 (which is approximately 1 /2 mile east of County Road 31 ) in order to avoid the blind "S" curve at the pond (between Roads 29 & 31 on Road 6) which is already complicated with several driveway entrances. Multiple accidents happen here, including fatalities. For the trucks and trailers to navigate thisportion of the road 6, they mustget over o er into the "wrong" lane in order to accommodate the length of their trailers. For a driver traveling in the opposite direction, it is difficult to observe the situation mail the two vehicles are head to head. Plus, this is complicated by many residential driveways on both the north and south side with traffic entering and exiting Road 6. Speed for all vehicles is concerning. Unfortunately, many drivers on our county roads, don't drive with a cautious speed. Also. at certain times of the year, there is considerable farm implement traffic on Road 6, in our valuable, and respected, "right to farm" county. 1 In addition, there is one property owner that uses the "open range" theory for grazing cattle. The cows and calves are frequently on the road, or grazing alongside. There is an old, barbed wire fence in place but no repairs are made, or will be made, by the landowner or the livestock owner, who has leased this property for many years for grazing cattle. I don't agree with that theory, but all of this happens on the blind "S" curve on Road 6. Allowing or encouraging truck traffic or increased traffic will only further complicate this stretch by many times. FYI ... Neither, the landowner or the livestock owner who is leasing the property, live close by. The livestock is rarely checked on. I can't even begin to remember how many times that I have come across cars and trucks in a ditch or had to call for emergency services because I heard the crash from over a 1 /2 mile away. One property owner (not the "open range folks") is frequently making repairs to his fence from someone who is being careless around the "s" curve. Please don't allow it to become more dangerous. This should be a quiet, respected county road for residential and farm use, as it was originally intended. Daily, frequent truck traffic makes no sense. In addition, a train frequently stops and parks, across the tracks at County Road 6 for long periods of time (near Vestas) and there is no place for the trucks to safely turn around to seek another route. Yet another reason to use Roa d 31 ...there is only one house on Road 31 as opposed to Road 6 which is a densely populated, curvy, dirt road with many small children. The drainage at the intersection of Road 6 and County Road 27 is almost nonexistent on the Road 6 portion which means in a very bad cold, wet winter there will be an ice build up at the stop sign because of a low spot that retains water. This intersection was "improved" due to Vestas, however, if we have severe weather, this will be an extremely dangerous intersection if truck traffic is trying to stop, accelerate and cross the heavily traveled County Road 27. Idling trucks should he limited to 20 minutes. Idling trucks create toxic air pollution plus noise levels that cause serious quality of life concerns to residents. Low frequency vibrations are known to degrade the quality of sleep. Trucks must have Auxiliary Power Systems (APS) or if newer models, a certified clean idle or Y they must be plugged in, so that they don't create smoke pollution in temperatures below 40 degrees. Landscape with maintained, dense evergreens (Spruce or Austrian pine, etc with irrigation) to form a year round screen. Build a minimum 12' berm to buffer the noise Dust control mitigation on the property Hours of operation Monday through Saturday 6am to 6pm 2 No hazardous materials Detention ponds to control run off so that it doesn ' t go into the Brighton Lateral Ditch Lighting should be shielded so that it doesn't effect the neighbors Fuel storage must meet Div of Oil and Gas standards I .imit number of trucks and trips Meet emissions standards Pay a percentage for road maintenance Keep noise to a minimum Residential and agricultural property owners purchased in this area for reasons as it currently exists. Al lowing a commercial trucking company will be changing the entire community, please don't do i t . There are many other options closer to Hwy 85 that are a better, safer choice. The County has an agricultural tradition , as reflected by its ranking as one (1 ) of the most economically productive agricultural producing counties in the nation. Land use changes are occurring , and agriculturally zoned land is being changed to residential, commercial and industrial development. As these new land uses evolve, it is important that the established agricultural businesses and associated infrastructures are allowed to continue to operate without adding excessive constraints. Individuals who move into these areas must realize that they will experience conditions and services unlike an urban setting and must be willing to accept this lifestyle. The Weld County Right to Farm Statement can be found as part of the Agriculture goals and policies and , as a part of this Plan, supports the importance of agriculture in the County. • C. • Fairness in the Land Use Change Procedure. The County has established various regulations for the process of land use change. This process must be fair and equitable to all parties in the following ways: • 1 . It is a timely process. • 3. It provides open communication through the development review process to the applicant, neighbors and communities impacted by proposed changes. • 4. It maintains consistent requirements, coupled with flexibility, within the implementation criteria. • 5. It allows easy access to information about the process, so that affected parties may be adequately informed. • 6. It has an established appeal process. • 7. It allows for approval when all written criteria of the land use regulations are met. • D. Recognition of the County's diversity. The County's nearly four-thousand-square-mile area is diverse geographically, demographically, culturally, socially and economically. Therefore, land use policies must be flexible to adapt to the specific location and circumstances of each proposed land use change. It is also important to weigh the cumulative impacts that specific land use changes will have. • E. Regulations Addressing Land Use Changes. Land use regulations which address land use changes should be written so they protect the rights of private property owners and the public health, safety and welfare. • F. Economic Growth. Land use policies have a significant impact on economic conditions in the County and should be structured to encourage economic prosperity and economic growth. OppositionM a p I I,/ , • _• ••,i.
