The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all inclusive; as other issues may
arise during the remaining application process.
COMMENTS:
Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011)
C Street is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. Jurisdiction for this road is split half and half between Weld County and the City of Greeley. This
road is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line.
59th Avenue is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road has been annexed into and is maintained by the City of Greeley. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future
right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the
59th Avenue right-of-way for full build-out.
REQUIREMENTS:
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code
Traffic Study:
The applicant is indicating in the questionnaire that normally 1 or 2 truck drivers will be on site to load and
unload vehicles. Trucks will use C Street to 59th Avenue, which are both maintained by the City of Greeley.
Drainage Narrative:
Storm water naturally drains off of the hill into and existing pasture. The historical flow patterns and run-off
amounts will be maintained.
Grading Permit:
If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of
construction.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Special Review Permit for an agricultural service establishment
primarily engaged in performing agricultural, animal husbandry or horticultural services
on a fee or contract basis, including uses similar to the uses listed in section 23-3-40 as
Uses by Special Review as long as the use (grinding and storage of wood chips and
logs for livestock bedding) complies with the general intent of the A (Agricultural) zone
district.
"Policy 2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers."
As indicated above, it is the policy of this Department that portable toilets are allowed
when 4 or less part time (20 hour week) employees are located on site. As the
application states there will be 2 to 4 part time employees, in accordance with
Environmental Health Services policy the use of portable toilets is allowed.
An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit may be required for
wood cutting operations that produce air emissions. Information regarding the permit
can be obtained from the Air Pollution Control Division at the Colorado Department of
Health and Environment.
An on-site dust abatement plan was not submitted and is required. The plan shall
address the access and loading area as well as dust blowing from stockpiles.
A waste handling plan was not submitted and is required. Trash disposal for drivers
and employees shall be included in the plan. The application states that waste will be
recycled/composted however the composting facility was not addressed. As the
applicant is accepting and processing logs from third parties the beneficial use
regulations are applicable if they are composting on their property. The applicant will
have to register with Colorado Department of Public Health and Environment and
provide annual reporting for onsite composting.
A noise plan was not submitted and is required. The plan shall address noise control
measures that will be utilized to ensure the non-specified noise level is not exceeded.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment for any use that will
cause air emissions. Alternately, the applicant can provide evidence from the
APCD that they are not subject to these requirements.
2. The applicant shall submit evidence of a Beneficial Use Determination from the
Colorado Department of Public Health and Environment.
3. The applicant shall submit a Dust Abatement Plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment.
Evidence of acceptance shall be submitted, in writing, to the Weld County
Department of Planning Services.

4. The applicant shall submit a Noise Mitigation Plan, detailing noise control
measures, for review and approval, to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment.
Evidence of acceptance shall be submitted, in writing, to the Weld County
Department of Planning Services.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1. A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2. A list of the type and volume of chemicals expected to be stored on site.
3.The waste handler and facility where the waste will be disposed
(including the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved waste handling plan, at all times.
4. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan, at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code.
Additional controls shall be implemented at the request of the Weld County

Department of Public Health and Environment in the event noise levels detected
off site of the facility exceed the Non-Specified Zone level, or in the judgment of
the Weld County Environmental Health Director, there exists a noise condition
requiring abatement. The facility shall be operated in accordance with the
approved noise mitigation plan, at all times.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As there will be up to 4 part
time employees, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained on a
quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed
in Weld County and shall contain hand sanitizers.
8. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00046)was noted. This
violation was initiated due to the operation of a processing and storage of woodchips operation without
first completing the necessary Weld County Zoning Permits. This case has not been presented to the
Weld County Court Magistrate through the Violation Hearing process. Since this application was
submitted prior to an actual court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied,the processing and storage operation shall
be removed from the property within 30 (thirty) days of denial or the violation will proceed in court
accordingly.

General
❑ Advisory. The subject property is located within the City of Greeley's Long Range
Expected Growth Area (LREGA). The LREGA is the range in which the community
anticipates development occurring within the coming 20+ years. Particular care in site
design is encouraged to increase compatibility with the urbanizing nature of this area.
❑ Advisory. This area is particularly sensitive as a large residential subdivision is platted to
the south. There are existing dwellings in the vicinity as well as existing and planned
trails, open space, and parks. It is of high importance to mitigate visual, audial, and
environmental impacts in this area.
Submittal
❑ The applicant should provide a complete site plan to ensure an effective review of the
proposal. All aspects of the proposal should be shown on the site plan with their
respective dimensions. This includes all items existing and proposed such as fences,
landscape areas, driveways, parking lots, storage areas, structures, and drainage elements.
Elevations of proposed structures, including fences, should also be submitted for review
to ensure compatibility of architecture. Additionally, a landscape plan should be
submitted to identify existing and proposed plantings, berms, and fences that will be
utilized to provide visual and audial screening.

Site Design
❑ An extension of C Street is anticipated by the City in the future. Please ensure that all site
improvements are adequately set back from future right-of-way. A typical setback within
the City of Greeley for this type of development is 25 feet from property lines adjacent to
right-of-way. This setback is appropriate along North 59`x'Avenue and future right-of-
way for the extension of C Street.
❑ Outdoor storage of materials, equipment, and vehicles throughout the site should be
completely screened from all adjacent properties. This can be accomplished with berms,
fences,plantings, or a combination thereof, and should be installed outside of the future
right-of-way, as described under the "Streets"heading below, as improvement plans are
not finalized.
❑ A perimeter landscape treatment should be provided which includes one shade tree every
35 feet plus 5 medium shrubs (4-8 ft. tall at maturity) and 10 small shrubs (<4 ft. tall at
maturity) every 100 linear feet along North 59th Avenue. This should be installed outside
of the necessary right-of-way for future improvement of this corridor.
❑ Landscaped buffer yards should be installed as transitions between land uses of different
intensities. A 15 foot wide buffer yard should be installed along the north, west, and
south property lines. This should include 1 shade tree, 1 ornamental tree or large shrub
(>8 ft. tall at maturity), and 5 small shrubs (<4 ft. tall at maturity). Additional street trees
should be installed along the extension of C Street until there is one shade tree every 35
feet.
❑ Measures should be taken to mitigate noise and airborne particles generated by this use.
Berms, fences, and landscaping can be effective agents in reducing these types of
impacts.
❑ All storage should be on an all-weather surface such as compacted gravel or pavement.
Parking areas and driveways should be paved with asphalt or concrete to reduce airborne
dust and tracking of dirt and mud into the right-of-way. Particular attention is requested
towards the eastern portion of C Street as described under the heading"Streets"below.

General Comments
❑ The application indicates that a log fence, loading ramp, and a possible storage building
are some of the proposed onsite improvements. Please submit a site plan showing where
these improvements are proposed to be located. Please be sure that all improvements are
located outside of the 100-year floodplain and future 59th Avenue and C Street right of
way. If these requirements are not met it is requested that the applicant coordinate with
the City of Greeley to address all concerns prior to Weld County approval of the
proposed use.
❑ Advisory. The proposed property is located within the City of Greeley Long Range
Expected Growth Area. If in the future, City of Greeley water and sanitary sewer are
extended to the property, then it will be a requirement to annex into the City of Greeley,
prior to City of Greeley providing utility service.
❑ Advisory. The City of Greeley and North Weld County Water District have adopted a
Water Service Agreement for providing water in this area. The City of Greeley is
agreeable to North Weld Water District providing water service for the current residence,
however, please note that if additional water service is requested then the City of Greeley
will decide if water will be provided by the City of Greeley or North Weld Water District
in accordance to the executed Water Service Agreement.

Floodplain
❑ Advisory. Will any of the proposed improvements be located within the 100-year
floodplain? If any improvements are proposed within the 100-year floodplain please
provide documentation of the proposed impacts to Sheep Draw within the City of
Greeley.
Streets
❑ Advisory. With future development of the property, as a part of the subdivision process,
a minimum of 10' of additional right of way will be required to be dedicated for C Street.
With Subdivision an additional 45' of right of way will be required to be dedicated for
59th Avenue, which has a total right of way width of 150'. Any proposed and future
improvements should be located outside of the future right of way.
❑ Advisory. If now or in the future any additional accesses are requested off of 59th
Avenue approval must be obtained from the City of Greeley.
❑ The City of Greeley has some concerns as it relates to the increased truck traffic on C
Street, which is currently a gravel road. An increase in truck traffic will generate
additional dust on C Street that could become a nuisance to surrounding properties and
accelerate the degradation of the gravel road. It is understood through City of Greeley
Public Works that the City of Greeley maintains the road surface for C Street up to the
existing gate. Therefore, it is requested that at a minimum C Street from 59`1' Avenue to
the gate be improved. The City would be acceptable to access being 20' wide recycled
asphalt road treated with reclamite to minimize maintenance and dust, due to the
increased traffic.
❑ It is our understanding that Weld County maintains the Sheep Draw Bridge on C Street.
Will the bridge be able to support the truck traffic generated by the proposed use?
