RE: DENIAL OF CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
C-UD-COMMERCIAL UNIT DEVELOPMENT DISTRICT FOR LYLE PICRAUX.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 26th day of April,
1978 at 2 :00 o 'clock p.m. for the purpose of hearing the petition
of Lyle Picraux, 7927 West 106th Avenue, Broomfield, Colorado
80020 , requesting a change of zone from A-Agricultural District
to C-UD-Commercial Unit Development District for the following
described parcel of land, to-wit:
That part of the Southwest one-quarter of the Southwest
one-quarter of Section 32, `Ibwnship 1 North, Range 68
West of the 6th Principal Meridian, Weld County, Colorado
described as: Beginning at the Southwest corner of said
Southwest one-quarter of the Southwest one-quarter; thence
N0°27'37" E on an assumed bearing along the West line of
said South west one-quarter a distance of 990.83 feet to
a point 330.00 feet South of the Northwest corner of the
Southwest one-quarter of the Southwest one-quarter of said
Section 32; thence South 89°22'25" E along a line 330.00
feet South of and parallel with the North line of said
Southwest one-quarter of the Southwest one-quarter a dis-
tance of 1,319.91 feet to a point on the East line of
said Southwest one-quarter of the Southwest one-quarter;
thence South 0°20'41" W along said East line a distance
of 989.75 feet to the Southeast corner of said Southwest
one-quarter of the Southwest one-quarter; thence N89°
25'15"W along the South line of said Southwest one-quarter
of the Southwest one-quarter a distance of 1,321.91 feet
to the true point of beginning;
EXCEPT; That part described in Book 86 at Page 273, Weld
County Records.
EXCEPT: That part described in Book 1104 at Page 388, Weld
County Records
Contains: 27.862 acres irore or less.
WHEREAS , the petitioner was present, and
WHEREAS, Section 8 . 2 and 8. 3 of the Weld County Zoning Res-
olution authorizes the Board of County Commissioners to grant a
change of zone upon the showing by the petitioner of certain facts
and,
WHEREAS , the Board of County Commissioners heard the testimony
and statements of those present on behalf of the petitioner and has

studied the recommendations of the Weld County Planning Commission
for denial of the proposed change of zone, and
WHEREAS, the Board of County Commissioners hereby finds that
the petitioner has not met his burden of proof in fullfilling the
requirements of the Weld County Zoning Resolution for a change of
zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the petition of Lyle Picraux
for a change of zone from A-Agricultural to C-UD-Commerical Unit
Development District on the above-described tract of land, be and
hereby is, denied.
BE IT FURTHER RESOLVED by the Board that the reasons for denial
and findings of fact contained in the Weld County Planning Commission
recommendations in this matter dated February 7 , 1978 , be and hereby
are incorporated as the findings of fact and conclusions of law of
the Board of County Commissioners in this matter, as is fully set
forth herein .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
April, A.D. , 1978.

I hereby certify that pursuant to a notice dated March 20 ,
1978 , duly published March 23 , 1978 and April 13 , 1978 in
the Fort Lupton Press, a public hearing was held on the
request of Lyle Picraux for a Change of Zone from A-Agricultural
to C-UD-Commercial Unit Development District. Mr. Picraux
and his Legal Counsel, Lee Wilson, were present and made their
request. Chuck Cunliffe, Tom Honn and Ken McWilliams, of the
Weld County Planning Department, presented the Planning
Commission' s recommendation for denial. After discussion
and receipt of all testimony, Commissioner Steinmark made
a motion to deny the change of zone request to Mr. Lyle
Picraux and that the Planning Commission recommendations
be adopted as part of the record. Commissioner Roe seconded
the motion and it carried with Commissioners Carlson, Roe,
Steinmark and Chairman Dunbar voting aye. Commissioner
Jacobucci voted nay.

Dear Mr. Picraux:
Your request for a CHANGE OF ZONE from A-Agricultural District to
C-DD-Commercial Unit Development District has been recommended unfavorably
to the Board of County Commissioners by the Weld County Planning Commission.
The legal description of the property involved is that part of the Southwest
one-quarter of the Southwest one-quarter of Section 32, Township 1 North,
Range 68 West of the 6th Principal Meridian, Weld County, Colorado.
If you wish to be heard by the Board of County Commissioners, it will
be necessary for you to indicate your request by signing the bottom of this
letter and returning it to this office. Regular hearing procedure will then
be followed. This includes publishing a Notice of Hearing twice in the legal
newspaper, which expenses must be paid by you before the hearing day.

Moved by Percy Hiatt that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the appli-
cation for rezoning from A ( Agricultural District) to
C—UD ( Commercial Unit District covering the following described
property in Weld County, ���'t t,`b-a9l#;" wit:
be recommend ( iAxI '') (unfavorably) to the Board of County Commissioners
for the following reasons:
1. It is the opinion of the Planning Commission that the rezoning
request does not comply with the policies contained in the Weld
County Comprehensive Plan relating to commercial development.
The policies contained in the Weld County Comprehensive Plan
utilized to guide commercial development of this nature state:
"1. Commercial development will not be encouraged in the
unincorporated areas of the county unless it can be
shown by the developer that the proposed commercial
use cannot reasonably be located in an urban area. "
It is the opinion of the Planning Commission that the applicant has not
demonstrated why the proposed commercial use cannot reasonably be
located in an urban area.

2. The Town of Erie Planning Commission has indicated the Town
of Erie objects to the approval of this rezoning request since
it does not conform with the Erie Comprehensive Plan, Therefore,
the Erie Planning Commission has recommended the rezoning
request be denied.
Section 6-2 of the Erie Comprehensive Plan outlines the
criteria and principles adopted by the Town of Erie which act
as guidelines for future development within the area encompassed
by the Erie Comprehensive Plan.
The criteria and principles contained in Section 6-2 of the
Erie Comprehensive Plan which are applicable as guidelines for
commercial development of this nature are:
"A. Provide for orderly development through extensions of
existing land use arrangements and public facilities in
order to prevent requirements for municipal administrative
expenditures and development of physical improvements
beyond the financial means of the community. "
"B. Maintain the business district of Erie as the dominant
retail center of the community, "
As indicated by the Town of Erie Planning Commission, this rezoning
request does not comply with these guidelines.
Further, the proposed rezoning request does not conform with Plate
No. 9 - Land Use Plan, Town of Erie Service Area, which delineates
the future land use designations within the Erie Comprehensive Planning
Area. The property in question is designated on the Erie Land Use
Plan as future suburban residential development with a density of one
dwelling unit per acre. As indicated by the Town of Erie Planning
Commission, this rezoning request does not conform with the future
land use designation for the area in question.
3. It is the opinion of the Planning Commission that the applicant
has not demonstrated compliance with Section 8. 3 of the Weld
County Zoning Resolution which states :
"Request for rezoning of tracts within Weld County should
be supported by detailed and substantial evidence that
such rezoning is necessary. Recent findings and oral

statements by petitioners should show very clearly that
either the original zoning was faulty or that changing
conditions in the area now justify a new classification.
Without the presentation of such supporting documentation,
the County Planning Commission should not recommend a
change of zoning. "
It is the opinion of the Planning Commission that the applicant has
not demonstrated that either the original zoning was faulty or that
changing conditions in the area now justify a new zoning classification.
Section 8. 3 further states : "There must be definite proof that the
area requested for change has unique characteristics which distinguish
it from surrounding lands and thus make its rezoning essential. "
Again, it is the opinion of the Planning Commission that the applicant
has not demonstrated that the property in question has unique
characteristics which distinguishes it from surrounding lands.
Additionally Section 8. 3 states:
"Furthermore, once a change is made, the Planning Commission
must recognize the precedent which is established, both in
the immediate area and in other parts of the county, for
like rezoning of other lands "similarly situated. "
As such, it is the opinion of the Planning Commission that the approval
of this request would constitute "spot zoning" and would establish
an undesirable precedent in the immediate area and in other parts of
the county "similarly situated. "
4. The State Engineer' s Office, Division of Water Resources, recommends
that this rezoning request not be approved. As indicated in a
letter submitted to our office dated January 31, 1978 :
"The developer has submitted a well permit (no. 96121)
as proof of an adequate water supply. We must point
out that this permit was issued for an exempt commercial
well pursuant to CRS 1973 37-92-601(1) (c) , as amended.
This subsection states that the well may be used for
'drinking and sanitary facilities in an individual
commercial business' .
"We feel that use of this well to service the entire
commercial devleopment would be a violation of state
law and the conditions of approval for the permit. It
should also be noted that the permit allows for an
average annual appropriation of one acre-foot . The
water requirement as presented by the developer is 8. 2
acre-feet per year which is 7.2 acre-feet per year in
excess of the allowable appropriation. "

Comments :
Mr. Picraux contacted the Weld County Department of Planning Services
by letter on June 25, 1976, inquiring about the possibility of obtaining
approval for commercial zoning on the property for which this rezoning
application has been submitted. At that time the Department of Planning
Services staff responded to Mr. Picraux 's inquiries informing him of the
applicable policy guidelines contained in the Weld County Comprehensive
Plan. As indicated in the above recommendation, these policy guidelines
indicate commercial zoning is inappropriate for the property in question.
Mr. Picraux was informed of this in June, 1976, by the Department of
Planning Services staff in their response to his inquiry.
Subsequently, Mr. Picraux proceeded to establish an office and
builder' s supply yard on the property in question without first
applying for and obtaining approval of the rezoning which is a necessary
prerequisite to establishing the use on the property. Therefore, Mr.
Picraux knowingly established a use which is in violation of the Weld
County Zoning Resolution. The zoning violation was discovered on
May 31, 1977, and was red-tagged as such on July 29, 1977, subsequent to
discussions with Mr. Picraux on submitting the necessary rezoning
application.

1 . Yes. Land to the west and north is currently being developed
residentially. In addition, an air strip near the development
is currently under construction to serve the residents of the
development.
2. Yes. By developing retail outlets, they would serve the needs
of the residents in the above stated development. Without •
these outlets, the residents would be forced to go to Brighton,
Lafayette, or Boulder for their shopping. We would also hope
that a portion of the employees would be Weld County residents.
3. By approving our request, it would enhance the residential.
developing already under way by supplying close retail outlets.
4. Since we already own the land it would be financially impractical
to request rezoning of another parcel. Our location is 2.5 miles
west of Interstate 25 and 3.5 miles cast of Lafayette on ❑ighway 7.
Highway 7 is already a highly travelled route and our location is situated
so that we can draw business from the northern metro Denver area
and also from Boulder, in addition to other Adams and Boulder county
areas.
5. We feel that our location can draw business from Adams, Weld,
Jefferson, Boulder, and Denver because of its central location.
6. a. The price of the land is so high that making a return on
investment as agriculture is almost impossible.
b. Adjacent property is already zoned residential.
c. To the east of us is a gun club, riding stable, and livestock
sales. Although these are in an agriculture zone, they appear
to us as being businesses that do not conform to an
agriculture zone.
d. We feel if our request is approved it will provide a
buffer for the nearby residential developments.
e. 80% of the land in this area is classified as #4 dryland.
We have been informed that the only crop that could be grown
is wheat. The remaining 20% of the land is suitable only
for grass since it has a 3 to 5% slope.
7. a. The development will increase the county tax base.
b. Sales of both companies are up over 100% from last year.
e. There are no storage facilities, retail outlets, or office
building complexes in the vicinity.
d. We hope to employ as many Weld County residents as possible.
8. a. Lyle's Construction Company, Inc.

These two companies plan to build warehouse and office facilities.
Employment is currently between 60 and 70 persons with annual.

I. Picraux Unit Development (P.U.D. ) is designed for phase development.
The phases are designated as 1, 2, 3, 4, 5, on P.U.D. in coordination
with the developers approach to developing site.
A. Phase 1.
1. Area is to include the existing office building.
2. Will allow for proposed development of builders supply yard,
auto sales, storage units.
3. Construction for water run—off retention pond.
4. 39,874 Square feet, consisting of 3,744 square feet of open storage
and 36, 130 square feet on office and shop building.
5. Anticipate starting within one year of approval.
B. Phase 2.
1. Area to allow for proposed storage units or expansion area
for builders supply yard.
2. 28,800 Square feet of storage facilities.
3. Anticipate starting within two years of approval.
C. Phase 3.
1. Area allows for proposed fenced storage spaces or expansion
for builders supply yard.
2. Area is all open storage

II. Pertaining to the development phase of construction, site pains
must he submitted to acquire permits for building. Plans to
include grading plans, plot plans, and elevations. Zoning commission
will be allowed to approve future development, Phases 4 and 5.
A. Plot.
1. Must acheive propper location of building within limits allowed
on P.U.D. as designated by area units shown.
2. The structures area must meet approval of developer and not
exceeding the maximum area size limit of model units shown on
P.U.D.
3. Parking area is determined on the P.U.D. by model unit size.
(One parking space for every One Hundred square feet of office) .
Any exception must be approved by developer and/or county.
4. it must be noted that model unit size and parking area on P.U.D.
are sclaed to the maximum limit size unless approved by developer and/or
county.
5. Landscaping and sign plans will be submitted.
6. Shaded area is proposed balck top asphalt to be reviewed with each
phase.
B. Grading.
1. Must acheive proper drainage to catch basin or pond as shown on
P.U.U.
C. Elevations.
1. No buildings are to exceed two (2) stories in height.
2. Buildings are to involve steel, concrete, or masonry construction,
building can include any one, or any combination thereof. Such
construction however must meet the approval n1 rlwelnour as to the
architectural value and construction techniques.

3. It should he noted() that all buildings arc to maintain an
architectural similarity with one another to allow for unity of
the total. development.
4. Architectural changes must be approved by the developer, as trends
may allow changes to occur in order to meet asthetic values.
D. At timie of review a more specific detail of usage will he given
such as density of use, size of buildings, and type of buildings.
F. P.U.D. will be one ownership, to be managed and maintained, to hold
or sell as one unit.
F. If at any time of an anticipated sale of a portion of P.U.D. , the proper
procedure for sub—deveision, as outlined by the county, will be followed.
III. Fire Protection.
A. To establish and maintain a retention pond of approximately 155,000
gallons. This level will be maintained by run—off, well or hauling water
in.
B. A piping system for connecting Fire District pumpers will be installed
per requirements of the Fire Cheif, Dacona Fire Protection District.
C. This system will be adequate through phases 1, 2, 3, and 4, .
upon start of phase 5 a review will be needed by the Fire Chief, Dacona
Fire Protection District to determine if a pumping system is required
and fire hydrants installed.
IV. Wells & Septic
A. Phase 1, 2, and 3, approximately 20 peoples, sanitary facilities to
consist of 7 commodes, 3 urnals, 5 restrooms, or minimum requirements
of health department. Phase 4, approximately 200 persons, 12 commodes
6 urnals, 12 restrooms. Pahse 5, approximately 80 persons, 10 commodes
5 urnals, 10 restrooms.
B. Septic to be designed to meet office requirements by health departments
regulations at each phase.
C. Weels will have a capacity of 10-15 gallons per minute. At 10 gpm rate,
24 hours per day, would yeild 14,400 gallons per day. On 300 days per
year usage, the yeild would be 4,320,000 gallons. Our computation of gallons
used per person per day is 30 gallons per day maximum. We estimate the number
of employees within P.U.D. at 300. With 30 gallons per person per day,
used 300 days per year, the water requirement would be 2,700,00 gallons
per day.
V. Maintenance of common area to be maintained by owner/ developer.
VI. Land will be farmed until each phase of development begins.

Dear Mr. Cunliffe:
In order to clarify our letter of January 19, 1978 (a copy of which is
attached) , the Colorado Division of Highways has the following comments regarding
the Lyle- Picraux Zone Change and Commercial Development.
1 . Our projected right-of-way needs for the year 1996 on State Highway 7 show
that a minimum of 150 feet will be needed. We therefore request that an
additional 25 feet of right of way be provided by reservation, setback, or
dedication (preferably the latter) as local zoning laws and regulations
permit. -When added to the existing 50 feet on the north side of the highway
centerline, this 75 feet would provide for one-half of the total projected
needs.
2. As indicated in our previous letter, State Highway 7 should be maintained
as a connector between major generators of traffic, with minimum interference
to through movement. We would prefer that no access be allowed to the high-
way in this area other than that which presently exists. Reasonable access
to this development could be provided to S.H. 7 via County Road 3. In this
case, we would request that a deceleration lane (in the northeast quadrant
of the intersection of S.H. 7 and County Road 3), provided by the developer,
be given consideration. This would allow traffic to safely leave the flow
of traffic from S.H. 7 and enter onto County Road 3.
If the need for access to S.H. 7 is of prime concern to the County and the
developer, we would give consideration to an access to this property at the
eastern property line of the proposed development. We feel that this would
be advantageous in that it would allow for a joint access to this property
and the property to the east, should that property be developed. In this
case, an acceleration lane would then need to be provided by the developer
along his property. Specifications for acceleration/deceleration lanes are
provided on the attached sheet.

A Driveway Permit will need to be issued for construction of this driveway.
This permit is available through Mr. David N. Fraser, District IV Maintenance
Superintendent, P. 0. Box 850, Greeley, Colorado 80631 . Application for
the permit should include four copies of a drawing or sketch giving details
of construction as well as the distance from the section corner, State
Highway, or physical objects. Application should be made 90 days prior
to construction.
3. In order to provide adequate noise protection for commercial structures, we
recommend a minimum of 100-150 feet of setback. This setback assumes that
no walls, earth berms, structural insulated walls or windows are constructed.
4. Provision must also be made for increased runoff generated by this development.
We note that there is a pond to be located at the southwest corner of the
property. If this is to be used for retention of runoff, consideration
must be given to the release of runoff so that the highway will not be
adversely affected. This should also apply to any other on-site retention.
5. Finally, we ask that consideration be given to providing a green space buffer
between the anticipated right-of-way lines and parking on the property. This
would allow for a safer and more aesthetically pleasing appearance of parked
vehicles in relation to the roadways and control encroachment of parked
vehicles onto the public right of way.
If this development is approved, we would appreciate receiving a copy of
the finally approved site plan so that we can maintain an up-to-date record of
development along State Highways.

a commercial development in an unincorporated area, as mentioned on page 129 of
the Weld County Comprehensive Plan.
State Highway 7 is classified as a Minor Arterial according to the 1980
Colorado Division of Highways' Functional Classification Atlas. This classification
calls for maintenance of uniform traffic speeds and minimum interference to through
movement and is meant to be a connector between major generators of traffic, such
as cities, towns, and resorts. Therefore, we believe serious consideration should
be given to limiting additional access onto S.H. 7 and making the major access to
this development onto County Road 3.
If this zone change is granted, we would need to consider drainage, noise,
and access as they impact S.H. 7. We would appreciate the opportunity to comment
on these matters at such time as this property is rezoned.

Dear Ken:
A review of the proposed zoning change from Agricultural to Commercial-
Planned Unit Development has been made by me and I submit the following
comments :
1 . The soils are classified as Ulm clay loam (600) and Midway-
Shingle complex (40 ) . The Ulm soil is a deep to moderately
deep heavy textured surface with a slowly permeable subsoil .
It carries an agricultural land classification of IVe. Using
alternate wheat and fallow, its estimated yield is 28 bushel
per acre under optimum conditions. It would not be considered
prime agricultural land under the present definitions . The
remaining 200 or Midway-Shingle complex is a soil found on
moderately to strongly sloping ridges and hills and is a
shallow, well-drained soil formed in weathered residual calcareous
shale. It has an agricultural classification of Vle. It, of course,
would not be considered prime agricultural land. The latter soil
could have some severe qualities for roads, foundations, etc. , and
an on-site engineering sample and test would be advisable for designing
structures of this type.
2. There are no major irrigation systems involved.
3. Any comments on hydrology will be reserved for the Sketch Plan
phase of development as no topographic or hydrology computations
were submitted.
4. In summary from a strictly soils and water standpoint , we see no
real conflicts from our interests .
