The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Oil and Gas storage facilities with laydown yard
This project is west of and adjacent to CR 45 and is south of an adjacent to CR 66. Parcel number
080327100081
Access is from CR 66.
Roads:
County Road 66 is a paved road and is designated on the Weld County Road Classification Plan as a
local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the plat
the future and existing right-of-way and the documents creating the existing right-of-way. If the existing
right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of
future right-of-way. This road is maintained by Weld County.
County Road 45 is a paved road and is designated on the Weld County Road Classification Plan as a
local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the plat
the future and existing right-of-way and the documents creating the existing right-of-way. If the existing
right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of
future right-of-way. This road is maintained by Weld County.
Traffic:
The latest ADT on CR 66 taken 10/10/13 counted 219 vpd w/16% trucks
The latest ADT on CR 45 taken 5/8/13 counted 179 vpd w/22% trucks
A traffic study was submitted from Gene Coppola and indicated that there will be approximately 260 vpd
with 250 of those being truck roundtrips. The expected traffic routes are CR 66 and distribution of traffic
is estimated to be 80%to the west and 20% to the east.
The report did not consider local intersection impacts at CR 66 and CR 43 and CR 45 in which this sites
truck traffic must utilize to access the site. The 20' -30' turning radii at these intersections will make it
very difficult for the truck traffic to navigate turning movements without crossing into oncoming traffic.
Access:
Access permits has been approved for the access to the site (AP15-00257(Ag and emergency) and
AP15-00352 industrial or small commercial). Several of the existing accesses to existing O&G and homes
were utilized for the proposed site and new lot creations.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s)stopped to open a gate be allowed to create a safety issue for roadway users.
Tracking Control:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
More than 10 round large truck trips/day or more than 50 round passenger vehicles trips/day:
Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft
of asphalt.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
****Surface improvements less than 300 ft may be allowed if site constraints would prohibit meeting
condition.
Improvements and Road Maintenance Agreement:
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), outline when offsite improvements will be triggered, and include a
maintenance agreement for the haul routes.

An Improvements Agreement is required for sites with required offsite improvements. Collateral is
required to ensure the improvements are made.
Road Maintenance is typically included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations included
in the road maintenance agreement may include but are not limited to: dust control, specified haul
routes, damage repairs, and future improvement triggers.
Drainage Requirements:
The drainage code is currently going through changes with the Board of County Commissioners. As of
July 13'h the draft code is to be used in a pilot program mode until August 17'h when finalized.
The draft drainage code is available on the planning-engineering website.

Detention Pond summarized in a Drainage Report:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report
must include a certification of compliance stamped and signed by the PE which can be found on the
engineering website. General drainage report checklist is available on the engineering website. More
complete checklists are available upon request.
OR
Detention pond waived and a simple drainage narrative:
A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for
an exception to detention requirements listed below.
The drainage narrative must include at the minimum:
1. Description which exception is being applied for and include supporting documentation.
2. Where the water originates if it flows onto the property from an offsite source
3. Where it flows to as it leaves the property
4. The direction of flow across the property
5. If there have been previous drainage problems with the property
Exceptions.
1. No stormwater detention will be required for sites that meet any of the following conditions:
a. Use by right or accessory use in the A(agricultural)Zone District.
b. Zoning permits in the A (agricultural)Zone District.
c. A second dwelling permit in the A (agricultural)Zone District.
d. Towers including, but not limited to, cell, wind, and telecommunication towers.
e. Pipelines or transmission lines.
f. Gravel pits if the stormwater drains into the gravel pit.
g. Residential developments where all the following conditions exist:
1. Nine (9) lots or fewer.
2. The average lot size is equal to, or greater than, three (3) acres per lot.
3. Downstream roadway criteria are not exceeded.
4. The total post-development imperviousness for the rural residential development does not
exceed ten percent (10%), assuming that all internal roads and driveways are paved, or will
eventually be paved.
h. Development of sites where the change of use does not increase the imperviousness of the site.
i. Urbanizing areas where the total project stormwater runoff of less than, or equal to, 5 cubic feet
per second (cfs)for the 1-hour, 100-year, storm event.
j. Non-urbanizing areas where the total project stormwater runoff of less than, or equal to, 10 cfs for
the 1-hour, 100-year, storm event.
k. Parcels with total area less than, or equal to, a 1.0 gross acre.
I. Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal
Emergency Management Administration (FEMA) regulatory floodplain channel and the project.
m. A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a
onetime exception for a 1,000 sq ft building or equivalent imperviousness.
n. A parcel greater than 5 gross acres in size is allowed a onetime exception for a 2,000 sq ft
building or equivalent imperviousness.
o. Approved by a variance (DRAFT Weld County Code Section 23-12-150)
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more
urbanized area with state mandated, higher water quality requirements
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit
applications are accepted after the planning process is complete (map recorded). An Early Release
Request Form may be entertained only after the applicant and Planning Department have reviewed the
referral and surrounding property owner comments. The Early Release Request may or may not be
granted depending on referral comments and surrounding property owner concerns. Contact a
Engineering representative from the Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
Geologic hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this
location. Road maintenance including dust control, damage repair, specified haul routes and future
traffic triggers for improvements will be included. (Department of Public Works)
B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Planning-Engineering)
C. The applicant shall indicate how the site's truck traffic will safely navigate through the local
intersections at CR 66 and CR 43 and CR 66 and CR 45. (Planning-Engineering)
D. The map shall be amended to delineate the following:
1. Show and label the approved access(es), turning radii, and access permit number(s) on the map.

2. Show and label the approved tracking control on the map. (Planning-Engineering)
3. Show and label the accepted drainage features and drainage flow arrows on the map. Water
quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater

4. Show and label the entrance gate set back a minimum of 100ft from edge of shoulder. (Planning-

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction.

DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering)
2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Storage and Transload and Lay-Down
DATE: JULY 27, 2015
Environmental Health Services has reviewed this proposal for a site specific
development plan and special review permit for mineral resource development facilities,
oil and gas storage facilities with transloading, a lay-down yard and a less than 70 foot
in height communications tower in the a (agricultural) zone district (blue grama land
corporation, lucerne origination facility).
There will be up to eight employees located at the facility. The applicant provided
information indicating that provide water for drinking/sanitary purposes would be
provided by the North Weld County Water District. A well and water in the vicinity may
be utilized for non-potable uses. There are existing septic systems at the facility;
however, the applicant is proposing to abandon those and install a new septic system.
The facility will provide portable toilets during construction activities and for truck
drivers.
The applicant provided waste management information as part of the application. The
applicant indicated waste will be managed by Waste Management and Safety Data
Sheets will be available onsite for all chemicals managed.
The applicant also provided dust abatement information as part of the application. The
applicant indicated that main traffic areas will be paved, speeds onsite will be limited,
and water or chemical treatment will be utilized as needed. The applicant also indicated
in the application that topsoil that will be stripped during construction will be stockpiled
and seeded or covered to prevent blowing dust.
The applicant submitted correspondence with the Air Pollution Control Division,
Colorado Department of Public Health and Environment, indicating an Air Pollution
Emission Notice (APEN) would be filed.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
Prior to the issuance of the Certificate of Occupancy:
A. In the event the applicant intends to utilize the existing septic system for business
use, the septic system shall be reviewed by a Colorado registered professional
engineer. The review shall consist of observation of the system and a technical
review describing the system's ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed, the system shall be
brought into compliance with current regulations. Alternately, a new septic
system may be installed for business use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed of in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
Chapter 14, Article 1 of the Weld County Code.
4. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
5. Any contaminated soils on the facility shall be removed, treated or disposed of in
accordance with all applicable rules and regulations. All spills will be reported to
local, state and federal agencies in accordance with all state and federal
regulations.
6. Fugitive dust and fugitive particulate emissions should attempt to be confined on
the property. Uses on the property should comply with the Colorado Air Quality
Commission's air quality regulations.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. If employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld

County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to On-site Wastewater Treatment Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the public water supply.
10.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAPs) and volatile organic compounds (VOCs). All
chemicals must be stored securely, on an impervious surface, and in accordance
with manufacturer's recommendations.
11. A Spill Prevention, Control and Countermeasure Plan, prepared in accordance
with the applicable provisions of 40 CFR, Part 112, shall be available on site.
12.This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code.
13.Secondary containment shall be constructed around tanks to provide containment
for the largest single tank and sufficient freeboard to contain precipitation. A
synthetic or engineered liner shall be placed directly beneath each above-ground
tank. Secondary containment shall be sufficiently impervious to contain any spilled
or released material. Secondary containment devices shall be inspected at regular
intervals and maintained in good condition.
14.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

General
❑ Advisory. The subject property is located within the City of Greeley's Long Range
Expected Growth Area (LREGA). The LREGA is the range in which the community
anticipates development occurring within the coming 20+ years. Particular care in site
design is imperative to increase compatibility with the urbanizing nature of this area.
Please see the City-Recommended General Development Standards below for
suggestions.
E Advisory. This site is of particular importance due to its location along CR 66 and CR
45. These are identified as collector roadways in the City of Greeley's 2035
Transportation Master Plan. Due to these classifications, landscaping should be installed
along the frontages to enhance these major corridors across the community. See the City-
Recommended Landscaping Standards below for suggestions.
City-Recommended General Development Standards
E The standard setback for development of this nature in urban areas is 25 feet. All
buildings, parking lots, perpendicular drive aisles, and other structures should adopt a
setback of twenty-five feet from the future required right-of-way to avoid a non-
conforming situation in the future.
❑ To minimize airborne dust and the tracking of dirt, mud, and gravel onto public
thoroughfares, all drive aisles and parking spaces should be paved in asphalt or concrete.

E Outdoor storage should be completely screened from view of all adjacent roadways and
properties. This can be accomplished through the construction of a solid wall or fence or
the planting of landscaping of sufficient height and variety to provide year-round
screening.
❑ Fences or walls should include variation in appearance at least every 50 feet. This can be
achieved by constructing columns or offsetting the angle.
City-Recommended Landscaping Standards
❑ County Road 66 and County Road 45 are identified as collector roadways through the
community. Landscaping should be installed along these thoroughfares at the following
rates:
o Street trees—one shade tree every 35 feet or one shade tree every 25 feet
o Five medium shrubs (4-8 feet tall at maturity) per 100 linear feet
o Ten small shrubs (<4 feet tall at maturity) per 100 linear feet
❑ The proposed use should be buffered from adjacent uses of different intensities to the
south and west. A 15-foot wide landscaped buffer yard should be installed along the
southern and western property lines. This should include one shade tree, one ornamental
tree, and five small shrubs (<4 feet tall at maturity) for every 100 linear feet of frontage
along these property lines.

General Comments
❑ Advisory. The subject property is located within the City of Greeley Long Range
Expected Growth Area (LREGA). If in the future, water and sanitary sewer service are
requested to the property, then annexation into the City of Greeley will be required prior
to the City of Greeley providing utility service.
E Advisory. The City of Greeley and North Weld County Water District (NWCWD) have
adopted a Water Service Agreement for providing water in this area. Please note that the
City agrees with water service being provided to the property by NWCWD in accordance
with the executed Water Service Agreement; dated February 5th, 2013.
Traffic
E City of Greeley's 2035 Comprehensive Transportation Plan indicates that Weld County
Roads 45 and 66 will be 2 lane collector roadways requiring 80' total public right of way
(40' half right of way) each. Please ensure that the site map calls out the west half of the
right of way for Weld County Road 45 and the south half of the right of way for Weld
County Road 66. All proposed structures (buildings and paved areas) should be set back
a minimum of 25 feet from the future right of way lines.
