AND A TANKER WASHOUT FACILITY, OPERATING 24 HOURS A DAY, 7 DAYS A
WEEK, 365 DAYS PER YEAR WITH UNLIMITED TRUCK TRIPS TO THE FACILITY IN
THE A (AGRICULTURAL) ZONE DISTRICT - GRASSLAND WATER SOLUTIONS,
LLC
A public hearing was conducted on January 7, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
e I hereby certify that pursuant to a notice dated November 26, 2014, and duly published
December 1, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Grassland Water Solutions, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR14-0070, for Mineral Resource Development Facilities, Oil and Gas
Support Facility, including a Class II Oilfield Waste Disposal Facility — Saltwater Injection
Facility, a Water Recycling Facility, and a Tanker Washout Facility, operating 24 hours a day,
7 days a week, 365 days per year with unlimited truck trips to the facility in the A (Agricultural)
Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record.
e Kim Ogle, Department of Planning Services, presented a brief summary of the proposal,
and communicated that Planning Commission entered the favorable recommendation of the
application with a 9/0 vote, as recorded in their minutes. Mr. Ogle presented photos of the
property and verified for Commissioner Cozad that any seismic concerns would be directed to
the Colorado Oil and Gas Conservation Commission.
El Wayne Howard, Department of Public Works, provided a brief overview of the
transportation plans and requirements, with historic traffic averages in 2011-2012 to be between
20-26 vehicles ADT. The applicant has submitted a traffic narrative, received Access Permit
#AP14-00407, and is required to install tracking control. The haul routes will be addressed in a

new Improvements Agreement due to a new owner and increased traffic. The submitted
Drainage Narrative and Water Quality Feature design have been accepted, which will require a
Grading Permit if disturbing more than one acre.
F Heather Barbare, Department of Public Health and Environment, reviewed the water and
sewer provisions, and conditions of approval. Commissioner Conway clarified septic will
depend on needs. Commissioner Cozad verified a commercial well is required for drinking
purposes.
F Doug White, NGL Water Solutions, stated that because of the demand for increased
activity in the oil and gas industry, the applicant is responding with strategic placement of new
facilities. They believe this new facility will be a solution for clients in the north. It is a larger
facility with a saltwater disposal addition. Mr. White stated that they are investing 3.75 million
dollars in electricity upgrades in the Grover area, including a brand new substation adding 5
mega watts to the area which will be good for the community. The traffic impact of haul routes
is reduced because the traffic is spread out over the 24-hr period.
El Mr. White continued to share future development ideas regarding pipeline right-of-ways
which would reduce truck trips. The future goal is to pipe as much water as possible to reduce
costs, truck trips, and better care for the environment. The bigger off-load pad will be able to
handle eight trucks at a time and move trucks off road more quickly. NGL is spending the
money to process a lot of water more quickly and they have a future recycle plant in the
development plans.
F In response to Commissioner Cozad, Mr. Ogle provided the information regarding the
location of area residents and Mr. White clarified the relationship between Grassland Water
Solutions and NGL.
F No public testimony was offered concerning this matter.
la In response to Chair Kirkmeyer, Mr. White inquired concerning the requirement for a
commercial well as a Condition of Approval when there are only two employees on a shift at a
time. F Further discussion yielded the solution to remove #1.D as a Condition of Approval
and amend Development Standard #15 to correctly reflect stipulations on the number of
employees in regard to requirements for a commercial well. ID Mr. White requested to add
permanent concrete containments to house temporary frack tanks and chemical totes as the
business expands and contracts. This would be an 80 foot by 60 foot concrete addition facility.
F Mr. Ogle stated this would need to be added to the description. Mr. Yatabe further
commented that these additions were not noticed to the public. Commissioner Cozad stated that
it is covered by the description, Commissioner Freeman concurred. Ms. Barbare shared that the
Department of Environmental Health recognizes these concrete containments as a "best
management practice" and would suggest an additional Development Standard #5 requiring the
labeling of temporary frack tanks with the stipulation that they may only be on the premises for
six months. IN In response to Commissioner Cozad's suggestion to remove or relocate
Condition of Approval #11, Ms. Barbare communicated the necessity of keeping the language

as a Condition of Approval, the guidelines regarding washing vehicles and the Board and staff
agreed it would be better suited as Condition of Approval #1.B.
e In response to Chair Kirkmeyer, Mr. White indicated he and the applicant have reviewed,
and agree to abide by, the Conditions of Approval and Development Standards, as amended.
Fi Commissioner Cozad moved to approve the request of Grassland Water Solutions, LLC,
for a Site Specific Development Plan and Use by Special Review Permit, USR14-0070, for
Mineral Resource Development Facilities, Oil and Gas Support Facility, including a Class II
Oilfield Waste Disposal Facility — Saltwater Injection Facility, a Water Recycling Facility, and a
Tanker Washout Facility, operating 24 hours a day, 7 days a week, 365 days per year with
unlimited truck trips to the facility in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as amended. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:56 a.m.
This Certification was approved on the 12th day of January, 2015.
