Dear Connie:
The Department of Planning Services is in receipt ofyour letter dated May 1, 2004 requesting a temporary

variance of operational hours to accommodate a State Highway paving project (Colorado Department of
Transportation Project No. MICE 04-045). Aggregate Industries will furnish materials, new asphalt paving
and return transport rotomilled asphalt to the Riverview Resource facility. All activity is in conjunction with
the construction of Highway 34A and Highway 34D near the City of Evans, Weld County Colorado.
As stated in the above referenced letter, the hours of operation shall be between 8:00 P.M. and 6:00 A.M.
Sunday through Thursday, except for the week of May 16, 2004 when rotomilling activities are undertaken.
The Department of Public Works has no concerns with the project as long as the designated haul route
approved by the County is followed for all transport activities, both to and from the Riverview Resource
facility. The Departments of Planning Services and Public Works have no concerns with the proposed
variance of hours to complete this State transportation project. We thank you for your advance notification

Re: AmUSR-897 Riverview Resource Temporary Variance-Hours of Operation
Dear Kim:
This letter is provided to Weld County Planning Services as notice of a temporary variance from the
Riverview Resource permit limitation of daylight hours of operation in order to accommodate the terms
of Colorado Department of Transportation(CDOT)Project No. MTCE 04-045. Aggregate Industries-
WCR, Inc. (AI)has been awarded a contract with CDOT for furnishing materials and performing work
associated with construction on Highway 34A and Highway 34D near Evans, in Weld County(basically
from 17th Avenue and east). The asphalt plant at Riverview Resource has been designated as the material
supplier to this project and for receipt of asphalt millings from the project. In order to maintain the least
disruption to traffic flow,the State requires that the milling and paving activity be conducted at night,
generally between 8:00 p.m. and 6:00 a.m., Sunday through Thursday.
The enclosed Progress Schedule indicates May 16, 2004 as the commencement date and June 3, 2004 as
the completion date for Al's activity. AI would request that the end date be projected to June 10, 2004 to
accommodate possible weather and holiday delays. Rotomilling activity is expected to occur over the
first seven days of the project, which will require approximately 40 to 60 truck hauls per night of millings
from the project to Riverview Resource, where a loader will unload and stockpile the millings. Paving
activity is expected to occur throughout the remainder of the project. This will require operation of the
asphalt plant and approximately 40 to 60 truck hauls per night from Riverview Resource to the project.
