RE: FINDINGS AND RESOLUTION CONCERNING THE 3.2% BEER APPLICA-
TION OF ALVIN V. GARCIA, D/B/A GARCIA STORE.
The application of Alvin V. Garcia, d/b/a Garcia Store,
1415 North 25th Avenue, Greeley, Colorado, for a 3.2% beer ap-
plication, for consumption off the premises only, came on for
hearing on the 22nd day of August, 1979 at 2:00 o'clock p.m.,
and the Board of County Commissioners of Weld County, Colorado,
having heard the testimony and evidence adduced upon said hear-
ing, and having considered the testimony, evidence, petitions
and remonstrances filed with said Board, and having carefully
weighed the same, now makes the following findings:
1. The evidence discloses that the applicant has
sustained the burden of proof as to the reason-
able requirements of the neighborhood.
2. That no question was raised nor objection
offered as to the applicant concerning the
standing, character or motives of said
applicant.
3. The applicant has proven a prima facie case
as to the reasonable requirements of the
neighborhood.
RESOLUTION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has considered the application of Alvin V. Garcia, d/b/a
Garcia Store, 1415 North 25th Avenue, Greeley, Colorado, for a
County Retail License for the sale of fermented malt beverages,
containing not more than 3.2% of alcohol by weight, for con-
sumption off the premises only, and
WHEREAS, pursuant to Weld County Ordinance No. 6, Section
I.,A., applicant has paid the sum of $350.00 to the County of
Weld for a new license, and
WHEREAS, the applicant has paid to the County of Weld the
sum of $50.00, pursuant to Section 12-46-110, CRS 1973, as amended,
of which sum, $42.50 has been paid over to the State of Colorado,
Department of Revenue for credit to the Old Age Pension Fund, pur-
suant to the requirements of Section 12-46-110, CRS 1973, as amended,
and said applicant has produced a State Retail License for the sale
of 3.2% fermented malt beverages for consumption off the premises
only, outside the corporate limits of any town or city in the
County of Weld at the location described as follows:
1415 North 25th Avenue, Greeley, Colorado
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, having examined said appli-
cation and the other qualifications of the applicant, does hereby
grant License Number 79-22 to said applicant to sell 3.2% fermented
malt beverages for consumption off the premises only, at retail
at said location, and does hereby authorize and direct the issuance
of said license by the Chairman of the Board of County Commissioners
of Weld County, Colorado, attested to by the County Clerk and
Recorder of Weld County, Colorado, which license shall be in effect
from the 10th day of September, 1979 to the 9th day of September,
1980, providing that said place where the licensee is authorized
to sell the 3.2% fermented malt beverages for consumption off the
premises only, shall be conducted in strict conformity to all of
the laws of the State of Colorado and the rules and regulations
relating thereto, heretofore passed by the Board of County Commis-
sioners of Weld County, Colorado, and any violation thereof shall
be cause for revocation of the license.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
August, A.D., 1979.

The following business was transacted:
I hereby certify that pursuant to a notice dated July 16, 1979,
duly published July 19, 1979 and August 9, 1979 in the Platteville
Herald a public hearing was held on the request of Alvin Garcia
dba Garcia Store, for a retail 3.2% beverage license for consumption
off the premises only. Testimony was heard from the applicant,
Alvin Garcia and legal counsel, William Crosier. Two petitions in
support of this request, one from residents and one from store
customers, were presented to the Board. No one in opposition
to the license was present to testify. After discussion
Commissioner Roe made a motion to approve this request. Commissioner
Steinmark seconded the motion and it carried unanimously.

Juanita Garcia, (hereinafter Lessor) for $1.00 per year
and other valuable consideration hereby agrees to lease the
premises known as Garcia Store insofar as she has right, title,

This lease shall be automatically renewed for ten years under
