RE: RELEASE OF DEMAND NOTE FOR SUBDIVISION IMPROVEMENTS OF
COUNTRY CLUB ESTATES ISSUED BY ALLIED MUTUAL INSURANCE
COMPANY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Engineering Services has notified
the Board of County Commissioners of Weld County, Colorado, that
the subdivision improvements required by the Weld County Sub-
division Regulations of the developer of the subdivision known
as Country Club Estates , located in Part of Section 11, Town-
ship 5 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, has been performed, and
WHEREAS, the Department of Engineering Services has recom-
mended the release of the demand note issued by Allied Mutual
Insurance Company in the amount of Forty Three Thousand Dollars
($43, 000) securing performance by the developer of the required
subdivision improvements.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that it does hereby
direct the County Clerk and Recorder to release said demand
note issued by Allied Mutual Insurance Company, now being held
by the County, in the amount of $43 , 000 , to Country Club Estates ,
Box 537 , Greeley, Colorado 80631.
The above and foregoing Resolution was , on mction duly made
and seconded, adopted by the following vote on the 17th day of
July, A.D. , 1978.

On demand after date for value received, the undersigned promise to pay to the order of
the Board of County Commissioners, Weld County, Colorado, the sum of FORTY-THREE
THOUSAND and no/100 DOLLARS ($43, 000) with interest at ten percent (10%) per year from
date of demand until paid.
This note is given for the purpose of releasing immediately that certain Subdivision
Bond No. 400749, dated February 5, 1971, issued by Allied Mutual Insurance Company
to the Board of County Commissioners in the sum of Forty-three Thousand Dollars
($43, 000), and in lieuthereof this note shall secure the Board d County Commissioners,
Weld County, Colorado, against a contingent liability by reason of said Board of
Commissioners, Weld County, Colorado, having approved the platting of certain property
located in a general area known as Country Club Estates upon the condition precedent
to the approval of said plat requires that the said Country Club Acres, Inc. , Greeley,
Colorado construct streets, curb and gutter, jsevg, and water from a point beginning at
the intersection of U.S. Highway 34 south o , Ped Aver 'approximately 945 feet to and
including man hole number three and t ek eas `on 42nd Ave. approximately 450 feet to and
including man hole number eight as sh Wri f.iti the plans known as Country Ciub Estates,

_ It is also stipulated that should this note be collected by an attorney after maturity or in
case of default/(whether by suit or otherwise) ten percent (10%) additional on amount due
shall be allocyed;the holder as attorney fees.
If the improvemen,to as shown have not been constructed by the stated completion time,
the Board of County Commissioners, at its option, may re-negotiate the note amount to
refct change in construction cost and the amount of improvement construction completed.
