RE: APPROVAL OF RECORDED EXEMPTION NO. 372 - VERNON AND DOROTHY
STEWART.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 29th day of January, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 372, being the property of
Vernon and Dorothy Stewart, described as the Northeast Quarter
of Section 29, Township 8 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
The Northeast Quarter of Section 29, Township 8 North,
Range 65 West of the Sixth Principal Meridian, Weld
County, Colorado
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Vernon and Dorothy Stewart be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.

RE: Recorded Exemption #372
Dear Commissioners:
The attached application, plat and related items are in reference to
a request for a recorded exemption from Vernon and Dorothy Stewart.
The parcel of land is described as the NE* Section 29, T8N, R65W of
the 6th P. M. , Weld County, Colorado. This property is located four
miles east of Pierce. The property contains approximately 160. 5 acres
of Class I irrigated soils.
The request is to split the property into parcels of 3. 5 acres and
157 acres , more or less. There are three existing residences on Lot
A. The Stewarts live in one of the residences. The prospective pur-
chasers of the farm, The Church of Jesus Christ of Latter Day Saints,
own the farm across the road which presently has an existing set of
improvements. The purchaser ' s intent is to continue agricultural pro-
duction of the 157 acre parcel and thereby increase the efficiency of
their operation.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemption
procedure) , Section 3. 3 A of the Weld County Zoning Resolution
(intent clause of the Agricultural Zone District) , and the Weld
County Comprehensive Plan in that the uses will be compatible
with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land uses. There
will be no reduction in the amount of land currently being used
for agricultural production.

2. This request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
The Department of Planning Services Staff has concerns regarding the
recommendation for approval in that the recorded exemption provides
for all 3 existing residences (3. 5 acres) to be divided from the farm-
land (157 acres) . Approval of the exemption would allow potential for
another house to be built on the remaining 157 acres. The staff recom-
mends that the Board recognize that the future owner of the 157 acre
parcel appears to not require additional residential improvements be-
fore approving this request in its current form.

We are requesting a land split, for we have sold our
farm to the Corporation of the Presiding Bishop of the
Church of Jesus Christ of Latter Day Saints, subject
to the approval of this recorded exemption by the
Weld County Planning Commission and Weld County
Commissioners.
The purchasers now own the farm across the road,
which is the SW1 of Section 21 Township SN Range 65
West of the 6th P.M. and are desirous of additional
land to make their present operation more effecient.
We, on the other hand, are wishing to retain our
home and other improvements, and will continue living
at that location. According to the terms of our Sales
Contract, the purchasers will have the first right of
refusal on this recorded exemption at such time we
may wish to sell it; therefore, there is the
possibility of retaining this as one unit at a later
date.
We request that you give this exemption a positive
consideration, as we are semi-retired and we have
been renting our farm for the past seven (7) years
and therefore, are desiring less responsibilities.
