WHEREAS , pursuant to law, the Board of County Commissioners , Weld County, Colorado, is vested with the responsibility of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, Weld. County, Colorado, on the date of October 6th, 1976 , did execute a lease agreement with option to purchase between School District No. 6 , Weld County, Colorado, and the Board of County Commissioners , Weld County, Colorado, for the use and benefit of the Weld County Department of Human Resources on the following described premises : Lots 5 and 6 of Block 28 , City of Greeley, County of Weld, State of Colorado WHEREAS, it is the desire of the Board of County Commissioners to execute an addendum to said agreement, a copy of said addendum being attached hereto and made a part hereof by reference, all in accordance with the terms and conditions as contained therein; NOW, THEREFORE , BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said addendum of said lease agreement with the option to purchase, a copy of said addendum being attached hereto and made a part hereof by reference, be, and hereby is, approved, and the Board is hereby authorized to execute sa__d agreement. SIX, WELD COUNTY , COLORADO , LESSOR AND COUNTY OF WELD, STATE OF COLORADO , LESSEE THIS ADDENDUM, made and entered into this 6th day of October, 1976 , by and between School District No. Six, of the County of Weld and State of Colorado, referred to as Lessor, and the County of Weld, State of Colorado , referred to as Lessee, WITNESSETH : WHEREAS , heretofore. the parties have executed a Lease Agreement of even date, pertaining to premises described as follows : Lots 5 and 6 of Block 28 , City of Greeley, County of Weld , State of Colorado and the parties hereto desire to amend and supplement the terms and conditions of said Lease Agreement, with the intention that the stipulations herein contained will be considered as part of the original Agreement , and as if contained in the document above de- scribed . NOW THEREFORE, in consideration of the mutual promises and covenants of the parties , as are contained in said Lease Agreement and are contained herein, it is understood and agreed as follows : 1 . Section VIII of said Lease Agreement is hereby amended by adding the following statement thereto, to-wit : "Lessee shall not have the right to assign this Lease Agreement to any person , party, partnership , corperation , governmental unit , or legal entity , withcut first getting the written permission and consent of Lessor . " In all other respects , Section VIII is hereby ratified and confirmed. 2 . Section IX of said Lease Agreement , denominated "TERMINATION" , is hereby deleted , and in lieu thereof the following language is substituted , to-wit : "It is mutually agreed that this Lease Agree- ment may he terminated by Lessor upon thirty days written notice of its intention to do so , by reason / of Lessee ' s breach of any of the covenants containe in this Lease to be performed by Lessee , and failure to cure such breach within. the specified thirty day period. :I Lessee may terminate this Lease Agreement upon t", thirty days written notice to Lessor , on the condi- tion , and on the condition only , that Lessee fails to receive sufficient funds for and from the Head- Start Program sufficient to fund this Lease Agree- ment ; said funds are acknowledged by the parties , ' hereto to be an essential and vital ingredient off this Lease Agreement. Regardless of whether this Lease is terminated by Lessor by reason of non-cured breach thereof by Lessee , or by Lessee by reason of failure to receive said funds for and from the Head-Start Program, Lessor shall not be obligated to return to Lessee any rental payments received by Lessor from Lessee prior to such termination . " 3 . In all other respects the terms , conditions and stipula- tions contained in said Lease Agreement are hereby ratified and confirmed.
