AS PERSONAL REPRESENTATIVES OF THE ESTATE
OF ROBERT S . DAVIS , DECEASED and BOARD
OF COUNTY COMMISSIONERS, WELD COUNTY,
COLORADO DATED October 1 , 1975
IT IS AGREED by and between the undersigned parties
that the following indemnity clause is hereby added to and
made a part of the lease referred to above which covers lands
located in Township 5 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado
The Lessee agrees to indemnify and save harmless
the Lessor against and from any and all claims by or on behalf
of any person, firm or corporation arising from the conduct of
or management about the demised premises, or from any accident
in or on the demised premises , and will further indemnify and
save the Lessor harmless against and from any and all claims
arising from any breach or default on the part of the Lessee
in the performance of any covenant or agreement on the part of
the Lessee to be performed pursuant to the terms of this lease,
or arising from any negligent act or omission of the Lessee , or any
of its agents, contractors, servants, employees or licensees ,
and from and against all costs , counsel fees, expenses and
liabilities incurred in or about any such claim, action or pro-
ceeding brought thereon; and in case any action or proceeding
be brought against the Lessor by reason of any such claim.
Signed this 12th day of March, 1976 nunc pro tunc
as of October 1, 1975.
