WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 26th day of October, 1977, at the hour of 2 : 00 o' clock p.m. , in the Chambers of the Board of County Commissioners, for the purpose of hearing the appli- cation of Curtis Strong, P. O. E. 4 .1 . of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a special use permit by the Board of County Com- missioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for a gravel pit on the hereinabove described real estate , com- plies with all of the conditions as set out in Section 3 . 3 .E. 4 .1. of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of Curtis Strong, P. RESOLUTION September 6, 1977 The Colorado Geological Survey gravel resources map of the Gowanda quadrangle identifies the gravel deposit as an Fl floodplain deposit and as such it is classified as a resource conservation area. As stated above, extraction shall be encouraged in resource conservation areas. 2. All requirements of Section 6.1(3) of the Weld County Zoning Resolution have been fulfilled. 3. The Weld County Engineering Department has not identified any engineering problems with this proposal. 4. The Weld County Health Department has recommended approval of this application. 5. The Colorado Geological Survey has indicated they could not identify any serious problems with the plans for extraction and reclamation of the site. 6. The Soil Conservation Service has indicated they have no objections to the proposed use due to the need for gravel mining and due to the poor agricultural capability of the soils involved (Class VI) . Reclamation shall be in conformance with the permit issued by the Colorado Mined Land Reclamation Board. 2. All final slopes shall be graded to a minimum of 3 : 1. 3 . Whenever feasible, reclamation shall be done concurrently with mining operations. Reseeding shall be done as early as possible to assure good growth. �1 Curtis Strong EXTRACTION STANDARDS 1. Operation shall be in conformance with the permit issued by the Colorado Mined Land Reclamation Board. 2. Operation shall comply with all Weld County and State Health standards and regulations pertaining to air and water quality. 3 . Overburden removed and stockpiled prior to gravel extraction shall be utilized to fill in the pit area as extraction progresses . The pit area shall he filled to a level above the water table so that a standing body of water does not remain upon completion of the reclamation plan. Mr. Hiatt comments that he had site reviewed the area and found the operation to be very clean and reclamation looks satisfactory. Mr . Carlson asked whether it was dry or water pits . Mr . Davidson responded by saying that it was dry pits, but that there is subsurface water there that is not being used in the operation. The water is left to stand where the gravel is being extracted and the top soil is being broughtback and replaced. There will be no open pits when the operation is corlp] ete. Carlson, Mr. Leroy Sigwardt presented his reasons for opposing the operation being devaluation of the property and the surrounding area, fly and odor problem, and open pond with raw manure which would seep after a heavy rain or snow causing a health hazard and also cause damage to his property which had occurred previously. Mr. Sigwardt then distributed pictures to the Planning Commission which showed the result of run-off from the holding pond of irrigation water onto his land which is approximately six acres . Approximately five other persons also spoke in opposition of the hog operation request, most of whom were opposed to it because of the health hazard and fly and odor problem. The following letter is an attempt to explain the requirements of Weld County for a Special Use Permit application pertaining to the legal description and to explain the resolution of this matter between the County Attorney, Jasper Freese, and myself. An application for a Special Use Permit requires a certified boundary survey of the property for which application is made and a complete and accurate legal description of the property which must be acceptable to the County Attorney. It is not required that the application filed for a Special Use Permit include the entire property owned by the applicant if the use requested by the Special Use Permit does not cover the entire property. In other words, the application need only be made for the property for which the use is proposed. Mr. Jasper Freese, the surveyor who prepared the survey and legal description for the application in question, has indicated he will amend the legal description and survey which was submitted for this application so that the legal description for the Special Use Permit application will be within the area which was deeded to Mr. Strong when he obtained the property. Mr. Freese indicated the 46 "Elizabeth Pelegrin I Page 2 October 26, 1977 survey and legal description will be amended along the boundary lines of your adjacent property so that the legal description is on the inside (east and north) of the existing ditch and inside (north) of the existing fence line. By amending the survey and legal description to this extent , the arca for which the Special Use Permit application is made will no longer encroach upon the property which you own. This will not resolve any property line dispute between yourselves and Mr . Strong . Weld County has no interest or involvement in the dispute of the boundary lines between your property and Mr. Strong ' s property. It is interest of Weld County that the application made for the Special Use Permit contains an accurate legal description, the use requested by the Special Use Permit application falls within the surveyed area, and the survey and legal description submitted for the Special Use Permit application does not encroach upon adjacent property. Davidson of Sage Engineers, Inc. He has supplied us with additional information on the reclamation plan for the Curtis Strong gravel pit. After observing the mining operation in progress, we are satisfied that there is sufficient top soil available to cover the exposed slopes after the gravel is mined, and that indeed, the land actually will be returned to agricultural or pasture use. This would eliminate the need for breaking up the symmetry of the pit and the planting of trees as mentioned in item #5 of our original review. Street Greeley, CO 80631 Re: Curtis Strong Gravel Pit. Dear Ken: A review of the above mentioned request for "Special Use" has been made and we offer the following comments: r- 1 . The soils in the area to be mined are shallow, moderately permeable, medium textured soils found on river bottoms and terraces in floodplains. They are usually quite droughty because of the gravelly substratum. They have an Agricultural Land Use capability of V1 . 2. There are no major irrigation systems affected by the project. 3. Flooding hazards or flood plain deleneation is not a serious consideration for this type of activity. 4. Gravel mining is a recognized use in the agricultural zone. 5. We would like to see more detail in the reclamation plan including number and species of trees, some means of breaking up the symmetry of the remaining pit, the amount of topsoil to be returned to the slopes and the species of grasses to be planted. The Soil Conservation District recognizes the need for gravel mining and due to the poor agricultural capability would have no real objection to this use. Concerning item number 5 of your letter to the Weld County Planning Commission; 1. An adequate amount of topsoil will be replaced within the pit and on the slopes to make the pit formable land. 2. An adaptable species of forage crop will be planted. We are not tying ourselves down any tighter than this beoause we do not want to give you a lot of information pertaining to grasses, then descide we would prefer to plant alfalfa instead. Please do not interpret this to mean that we are attempting to be vague as to our future plans. 3. As far as the 3:1 side slopes that circumscribe the pit are concerned, we are under the impression that we are not tied to that slope so tightly that we could not change the slope later to a 5:1 or 10:1 if we so desire. This is to be farmable ground, so depending on the type of forage desoided uibn, the banks would want to conform to the use. Trees will only be planted if it is descided that the best use of the pit area would be for pasture. If trees are planted, they will be of an adaptable species fox tue area, and will be of a species that would provide the maximum amount of shade for live- stook. However, if at anytime in the future, the operation was expanded requiring the rezoning of additional land, we would certainly wish to have consideration given to the construction of accel and decel lanes on State Highway 66. We have no evidence of other gravel mining in the immediate area but well logs show at least 30 ft of gravel in section 21. Both the Strong mining plan and our logs indicate considerable overburden in the eastern portion of the tract. Apparently the gravel is more readily attainable on the 38 acres proposed for extraction in the western part of the tract. I find one discrepancy involved with the plan. On Sheet 2, the extraction standards call for a wet-pit operation. Sheet 3 shows a dry pit reclaimed with grass and trees. I am uncertain as to whether or not the stockpiled topsoil and overburden will be used to fill the wet pit to a level above the water table. This could substantially affect reclamation costs and even State permit consideration. I suggest that this procedure be clarified in the plan. I should note also that these plans were drawn up in August 1976. The State reclamation and mining permit statutes were extensively revised last year. The applicant should be aware of the new procedural changes. Other than the above problem, I see no serious problems involved with the plan. If I can be of further assistance, please contact me.
