GALE_' EY Attn: Diana Aungst — Planner Dear Diana — This letter is written in protest of the proposed Use by Special Review permit referenced above. My husband and I own the property directly to the north of the site and have been subjected to the eyesore of this property for the past several months. The property is not kept in any sense of organization and is not a pleasant site to see every time we walk out our door. I have reviewed the application filed by the property owner and wish to point out several inaccuracies: 1. The owner states that the employees will park their vehicles and will leave. She states that they will not stay at the property. This is not the case. There are currently four motor homes on the property and all four are occupied. The motor homes have been in the same locations for several months. There is electricity to the homes as lights can be seen at night. Since the homes have not moved, I am concerned whether the homes are hooked up to the property's well and septic systems. 2 . The owner states that there will be up to 20 semi trucks at the property at one time. There have been numerous occasions when more than that have been present. 3. The owner states that the tires will be traded in for new ones. This apparently does not happen very often as there is a large amount of used truck tires being stored to the East of the pole barn. 4. The owner addresses the new driveway access to the property that has been established on the East edge. She however neglected to address the fact that many of the trucks use an entrance on the far West edge of the property that is coming off of the oil company tank battery. I am wondering if this access has been approved or is being improperly used. When the trucks use this access in the evenings, the headlights shine directly into my home. 5. The owner addresses dust abatement; however, to date we have NEVER witnessed anyone taking care of the dust created by all of the activity. 6. I have not noticed any porta-potties on the property but those could be hidden in the mess of trucks and motor homes on the site. The presence of a porta-potty is not something that we would like to have next door to us. Those are often times filthy, smelly and generally disgusting. I certainly do not need the smell of a porta-potty drifting over my home. 7. The owner states that no vehicles will be washed on the property. However, on February 13th we witnessed what appeared to be the washing of a trailer taking place at the site. It was late in the evening and was dark but there was a large flood light shining on the trailer. There was a loud noise taking place such as a generator or a power washer. It was evident in the tight of the flood light that water was being sprayed on the trailer. There was an individual clearly walking on top of the trailer at the time. EXHIBIT " -Weil These are discrepancies that we have observed from her application. In addition to these, we have many concerns about this business operating next door to our home. -There are several vehicles parked on the property that have not moved in months. Some of these appear to be in a state of disrepair. - As a homeowner, I should not be subjected to the sound and smell of semi-trucks for hours on end. In the cold months, the engines on the trucks run for several hours at an idle. The diesel fumes often float over my property and the sound is ever present. I will never be able to open my windows on summer nights due to the activity next door. In addition to the noise of the trucks themselves, there is often the sound of pneumatic tools late in the evening/night. And the sound of a generator as referenced #6 above. -I feel that the safety and security of my family is being compromised by the additional traffic next door, not to mention the additional occupants that are living there. -The presence of this business next door and the unsightly way it is kept is going to have a negative effect on my property value and the value of surrounding property owners. I have nothing against someone trying to run a small business but do object to it being done in this way. The property is zoned agricultural and this business has NO ties to agriculture. The owner needs to locate a suitable location to run her business that is zoned appropriately and has little to no effect on the surrounding owners. As a property owner in Weld County, I have a right to have my rights protected by the county, including those in control of the approval of these types of applications. My rights and those of the other owners in the area should not be compromised to allow an individual to run a business such as this from her home. CCR-- Re A Perkins 21131 County Road 53, Kersey CO 80644 April 6, 2015 Weld County Planning Services 1555 N. 17th Avenue Greeley CO 80631 Atten: Diana Aungst daungst@weldgov.com Re: USR 15-0004- Teresa Schwartzkopf Good Morning: We would like to object to the approval of the USR 15-0004 application filed by Teresa Schwartzkopf to change from agricultural zoning to commercial use. As a landowner that is directly affected by this USR application, we feel that it is not compatible with our property or the surrounding properties for the subject property to be changed to accommodate 15- 20 trucks and trailers for commercial use. Mrs. Schwartzkopf violated her current zoning in the fall of 2014 when she allowed the trucks to begin to park and operate out of her property. The trucks that are currently being operated from the subject property are not one company but several. This can be derived from the fact that the trucks have various names and DOT numbers on them. It appears that Ms. Schwarzkopf has leased out her property to numerous truckers. On February 7, 2015 at 3:30 in the afternoon I observed 16 trucks, 18 trailers and three campers. The trucks had hoods up and tires were being changed. The trucks had various names and DOT numbers on them. Currently, there are at least 15 trucks and up to 20 trailers being operated from the property on a FULL TIME basis and there are 4 RV's that appear to be housing the drivers of these trucks. The 4th RV was just moved onto the property this past week and now has a picnic table and grill set up. These RV's were not on the property prior to the trucks being operated out of this facility. The doors are often open on the RV's and lights can be seen from these trailers during night time hours which leads us to believe there are people staying in them. The USR application is for 15 trucks on a PART- TIME basis. The USR application also does not address the storage or parking of recreational vehicles_ The trucks are being worked on 7 days a week and employees and truck traffic is also seven days per week. The trucks are not just having tires changed, but are being serviced out of the shop on the property. Ms. Schwartzkopf stated in her application that the tires were being taken to Fleet Pride in Greeley to be traded in. However, Fleet Pride does not take in tire carcasses. Therefore, it makes me EXHIBIT wonder if Ms. Schwartzkopf is fully aware as to what is taking place on her property with all these different operators. Our biggest concern is that the people that are leasing this property from Ms. Schwartzkopf have failed to follow Weld County's zoning laws up to date and therefore we feel that if the zoning is granted, there will be more issues in the future. This is not a case of Ms. Schwartzkopf running her own trucking business of a few trucks from her property. It has almost become a small truck stop. This type of business is not what we anticipated living in an agricultural community. We all like to be good neighbors and get along with everyone. However, most of us in this area bought our properties because it was agricultural zoned and we wanted to reside in an agricultural community. We feel that a change from agricultural to commercial use will de-value our property and our quality of life. I feel there are too many close neighbors to allow 15-20 trucks and/or trailers to be parked there constantly. In the past few months, more trailers keep accumulating along with campers and individuals staying in the campers. Her land is already to look like an RV Park/Truck Stop. I am concerned that our nice quite country living will not be the same as it has been for the past nine and �/2 years I have lived here. One reason I 'm concerned is because of her obvious disregard to the current zoning of her property; if the use change she is requesting is approved, I believe she (or all of the owner/operators she has renting out her property) will violate the boundaries associated with it as well. Bar-b-que grills have been being used around the shop, men constantly working 7 days a week on their trucks in and outside the shop, and people are continuously around the campers on the property and it appears that their personal vehicles are parked next to the campers overnight and throughout the weekends. This leads me to believe that they are using these campers as lodging. I feel that it has already gotten out of control and the permit hasn't even been approved yet. EXHIBIT If this permit does get approved, I feel privacy fencing needs to be built on the East, South, and North sides of her property to keep some kind of containment and eyesore under control. I chose to purchase land in the country for many reasons. If this is approved, it will permanently change the rural landscape that we have enjoyed for many years.
