The method of appraising agricultural land for ad valorem taxation purposes, based on its earning or productive capacity, involves an "agricultural landlord formula" which has been approved and accepted by the Property Tax Administrator, the State Board of Equalization, and the Statutory Advisory Committee to the Property Tax Administrator, county assessors, and members of the agricultural industry. Net income to the landlord is calculated by first determining a commodity price or grazing rental price averaged over the previous ten years multiplied by the appropriate yield based upon soil classification. Multiplying this gross income by the typical landlord ' s crop share results in the landlord ' s gross income. Typical landlord expenses, allowed on a statewide basis, are averaged over the preceding ten-year period and subtracted from the landlord ' s gross income to arrive at the landlord 's net income. This income is capitalized by the statutory capitalization rate of 13 percent to arrive at an indication of value. Typical Land Lord Expenses All expenses must be documented and calculated as ten -year averages using the ten calendar years prior to the June 30 appraisal date for a specified level of value. Not all expenses are allowable. The first condition : it must be a typical landlord expense; the second condition : it must be necessary to cultivate a crop; and the third condition : it must be within the following allowable expense categories. For Grazing Land Fence expense ( researched and provided by the Division of Property Taxation ( DPT) ) Water expense (researched and provided by DPT) Conclusion The subject property has been physically inspected July 22 , 2015 , pictures taken to verify that the property should have the agricultural designation . The land has been valued according to the consideration of the earning or productive capacity of the land and capitalized at the statutory rate of thirteen percent ( 13 % ) , Colorado Constitution, Article X, Section 3 ( 1 ) (a) , and 39 - 1 - 103 ( 5 ) (a) , CRS at a value of: 8. 37 acres, at $ 15. 17 per acre Total land value $ 127 . 00 2 Agricultural Structure Valuation Valuation of agricultural structures requires consideration of the three approaches to appraisal . The statue that controls the valuation of agricultural structures states, in part : Actual value determined — when ( 5 ) ( a ) All real and personal property shall be appraised and the actual value thereof for property tax purposes determined by the assessor of the county wherein such property is located . The actual value of such property, other than agricultural lands exclusive of building improvements thereon and other than residential real property and other than producing mines and other than lands or leaseholds producing oil or gas, shall be that value determined by appropriate consideration of the cost approach , the market approach , and the income approach to appraisal . The assessor shall consider and document all elements of such approaches that are applicable prior to a determination of actual value . 39- 1 - 103 , C . R . S . The Colorado Division of Taxation recommends use of the cost approach when determining values for agricultural structures as there is generally insufficient data for the application of the market or income approaches . Sales of agricultural parcels that include land in the transaction must not be used to abstract values associated with specific buildings since the abstracted values would be highly speculative . Market data for cattle sheds in Weld County is insufficient thus the market approach to value the owners cattle shed is not used . The income approach is also not used in this case as any income pertaining to the structure is attributed to the land as there is insufficient date for a reliable income approach to data . Thus, the cost approach is utilized in the structures value . Marshall & Swift Valuation Service is used to uniformly value agricultural structures in Weld County . Marshall & Swift is an authoritative source within the appraisal profession . There are eight houses currently for sale in and around our location. Each house is slightly larger than our house. Square footage range from 2080 to 4402 (40% to 196% more than ours) Some of the houses have basements Half of the houses contain 1 to 2 bedrooms more than ours Three houses contain 1 more Bathroom than ours Two contain a three car garage Cost per square foot range from$85 to $98 Our house is (1483 Sq. Ft) Placing a value of$124 per square foot on our house does not seem to be in line with the above. If anything our house is more in line with bottom dollar per square foot of$85. A good indicator of the true valve of property is reflexed in the current market. Houses currently for sale in and around our area range from $85 to $98 per square foot. A fair and honest Property Value is all we are asking for.
