HomeMy WebLinkAbout20253294 Hearing Certification Docket No. 2025-81 Board of County Commissioners Weld County, Colorado Change of Zone, COZ25-0009, from the A (Agricultural) Zone District to the E (Estate) Zone District— CR 25 Lot B West, LLC A public hearing was conducted on December 10, 2025, at 10:00 a.m., with the following present: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tern Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Diana Aungst Development Review Representative, Mike McRoberts The following business was transacted: I hereby certify that pursuant to a Notice dated October 15, 2025, and duly published October 17, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of CR 25 Lot B West, LLC, for Change of Zone, COZ25-0009, from the A (Agricultural) Zone District to the E (Estate) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal, and described the sign posting and location of the site. She shared 15 referrals were sent out, 10 agencies responded, and those with concerns have been addressed in the Conditions of Approval (COA). She explained the Change of Zone (COZ) is the second step in a non-urban scale Minor Subdivision of nine (9) residential lots and two (2) outlots, which was delayed due to the moratorium by North Weld County Water District (NWCWD). Ms. Aungst stated eight (8) surrounding property owners (SPOs) were noticed, and one SPO asked about rerouting the ditch. She explained the site is located within the Coordinated Planning Area (CPA) of the Towns of Windsor and Severance, both of which were sent a Notice of Inquiry (NOI), and each responded with no interest in annexation, although the Town of Severance did request screening from the surrounding residence. She explained the site is located within the three (3)-mile referral area of the City of Greeley and the Towns of Windsor and Severance, and no concerns were received back. She shared the site is off of County Road (CR) 25, and rezoning will not conflict cc . pi,(oE/MN/4A/Ka) 2025-3294 PL2983 01/21/26 Hearing Certification (COZ25-0009) — CR 25 Lot B West, LLC Page 2 with mineral extraction. She stated water is available from the North Weld County Water District, and septic systems are proposed for each lot. Ms. Aungst entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. Mike McRoberts, Department of Planning Services, Development Review, stated CR 25 is a local gravel road, with a minimum travel surface width of 26 feet. Aaron Everitt, represented the applicant, and in response to Chair Buck, indicated he had not had contact with any of the Commissioners regarding this case. He commended staff for their presentation. No public testimony was offered concerning this matter. The Board reviewed the Conditions of Approval but no changes or corrections were made. In response to Chair Buck, Mr. Everitt indicated he had reviewed, and agreed to abide by, the Conditions of Approval, as presented. Commissioner James moved to approve the request of CR 25 Lot B West, LLC, for Change of Zone, COZ25-0009, from the A (Agricultural) Zone District to the E (Estate) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Ross and it carried unanimously.
