WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 7th day of June, 1978 at the hour of 2: 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Panhandle Eastern Pipeline Company, P.O. C. RECOMMENDATION April 18, 1978 2. It is the opinion of the Planning Commission that this request is in compliance with the provisions of Section 3. 3. (E) (2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area, and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The Colorado Geological Survey has indicated that there appears to be no geologic reason why this request should not be approved. B. The Weld County Health Department has indicated they have no problems with this request providing the applicant complies with the stipulations as indicated in their letter dated March 29, 1978. C. The LaSalle Fire Protection District has indicated that they see no reasons why this request should not be granted. D. The Weld County Engineering Department has indicated that there are no engineering problems anticipated by this request E. The Town of Gilcrest Planning Commission has indicated that they have no problems with this request. The Planning Commission recommendation for approval is conditional upon the following: A. The attached Development Standards being approved for the Special Use Permit area. B. No building or electrical permits be issued on the Special Use Permit area until the Development Standards have been placed on the Special Use Permit plat and said plat has been recorded in the Weld County Clerk and Recorder's Office. I Panhandle Eastern Pipeline Company - SUP DEVELOPMENT STANDARDS 1. The permitted use on the hereon described parcel of land shall be for the installation and operation of natural gas liquid terminal and a gas compressor station. Major facilities shall be limited to those shown hereon. 2. The facility shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission , and sanitary disposal systems. The noise levels at the property lines shall not exceed 70 db(A) from 7 : 00 a.m. to 7 : 00 p.m. and 65 db(A) from 7 : 00 p .m. to 7 : 00 a.m. as stated in C.A.S . 1973 , 25-12-103 . 3. Upon termination of the operation of the compressor station, all facilities and structures shall be removed to 30" below grade. The site shall be reclaimed to a state compatible with the surrounding agricultural uses. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 5. All buildings shall be at least 50 feet or greater from the Special Use Permit boundary line. 6 . Three (3) parking spaces shall he provided for company vehicles. The automotive equipment parking area shall be 50 feet or greater from the Special Use Permit boundary line . 7. Leveling and filling shall be performed for proper grading and drainage on the Special Use Permit area. 8. All inside access roadways to facilities shall be graded and leveled. 9. No waste water or oil shall be disposed of on the Special Use Permit area. 10. The compressor station shall not he manned except for brief periods of daily preventive maintenance involving two men or less. The engine/compressor units may be in operation 24 hours per day and 365 days per year. 11. No living quarters will be located on the Special Use Permit area. 12. Safety and fire protection will be as prescribed by the LaSalle Fire Protection District and Industry Standards and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. , 1 Panhandle Eastern Pipeline Company DEVELOPMENT STANDARDS Page 2, 1978 April 18 , 1978 13. All construction, electrical work and fabrication will be clone in accordance with the Weld County Building Code. 14 . The appearance of the facility shall be •maintained in a neat and orderly condition through periodic painting and maintenance. 15. The Special Use Permit shall be limited to the plan sub- mitted and governed by the Development Standards stated above and applicable Weld County regulations. Any changes to the plans and/or Development Standards shall require approval of another Special Use Permit before such changes shall be allowed. a The Weld County Planning Commission held a scheduled meeting on April 18 , 1978, at 1 : 30 p.m. in the Weld County Centennial Center County Commissioners Hearing Room , 915 10th Street , Greeley, Colorado. The minutes of the April 4, 1978, meeting were unanimously approved. Amendments to the Weld County Supplementary Regulations concerning Geologic Hazards and Floodplains APPEARANCE : Dave Shelton , Colorado Geological Survey DISCUSSION : Mr. Shelton gave a very informative and well presented slide series showing what has occurred with regard to subsidence of coal and clay mines in Welch County and also in parts of Pennsylvania, Wyoming and Colorado. Ile also explained how this occurs and to what extent damage can be done. A map of Weld County showing sub- sidence areas was also presented at this time. Ken McWilliams then discussed with the Planning Commission the regulations that were adopted in 1976 and briefly went over the procedures which an applicant must take for any permits that they wish to take out if they are in a subsidence area. These regulations will not be effect- ive until the geologic hazard area map is adopted . Kay Norton +then read the proposed amendments into the record. Discussion followed regarding specific areas of Weld County that are potential subsidence area. Fred Anderson and George Barber DISCUSSION: This application was continued from the March 21, 1978, meeting of the Planning Commission pending further input from the applicant regarding theevaluation of existing wells on the property to indicate if the wells are adequate to serve the commercial uses proposed for the property and also evidence that the property is in compliance with County and State Health Regulations . Mr. Barber at this meeting stated that the Health Department has approved the sewage disposal system and a copy of the well permit has been submitted to the Planning Department as requested. There being no questions at this time . Chuck Cunliffe read the staff ' s recommendation for approval. Discussion followed regarding the comment from the State Engineer' s Office regarding the use of water for commercial purposes on the property . Mrs. White expressed concern regarding why Mr. Anderson does not wish to annex to Fort Lupton. No further questions or discussion. E , Section 24 , T10N, R62W LOCATION: 3 miles south and 2 miles west of Grover SUBJECT : Request to amend Development Standards #1 and #21 on SUP-303 : 76 : 8 Grover Uranium Solution Mining Plant APPEARANCE : Bob Pomeroy DISCUSSION : This application was continued from the April 4, 1978, Planning Commission meeting pending receipt of comments and recommendations from the Colorado Department of Health regarding the request . Mr. Pomeroy again gave some background information on the application and summarized the requests in general. He also indicated that they have received approval from the Colorado Department of Health since the last meeting. Bart Conroy then explained briefly the differences between the ISL-1 procedure of mining using ammonia bicarbonates and the ISL-2 method using calcium bicarbonate. Of the two methods, the ISL-2 method is much more economical and advantageous for all concerned. There being no questions at this time, Tom Honn read the staff ' s recommenation for approval . Discussion then followed regarding the ISL-2 process. APPLICANT : State Department of Highways CASE NUMBER: SUP-354 : 78 :6 LEGAL DESCRIPTION: Ptn .11qi and S , Section 16, T1N, R65W LOCATION: 2 miles southwest of Hudson and adjacent to I-76 (north side) SUBJECT : Open Cut Mining Permit - Borrow Site for Highway Construction APPEARANCE: Ken Woods DISCUSSION: Mr. Woods of the State Highway Department explained that the borrow site will be used for highway construction as a fill material for proposed highway projects between State Highway 7 and Hudson . There is a possibility of excavating 600, 000 cubic yards . The top soil will be stripped and stock piled. It will then be excavated and hauled to the adjacent right-of-ways . Excavation depth will be approximately 13 feet . Present use of the ground now is crop and range pasture. It will be c claimed to the same use. There being no questions at this time, Chuck Cunliffe read the staff ' s recommendation for approval of the request . Discussion followed regarding the slope of the cut which Mr. Wood indicated would he 15 to 1 . MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation . Motion by Jerry Kiefer, seconded by Bette Kountz. The wells are dropping off , so compression is now necessary . There being no questions at this time , Chuck Cunliffe read the staff ' s recommendation for approval and the Development Standards. Chairman Carlson questioned #10 of the Development Standards regarding personnel on the property. Gary Fortner stated that there will be no personnel on the property except for maintenance . Some discussion followed regarding where they are getting the gas . Box 758 Greeley, Colorado 80631 RE: Application for Special Use Certificate and P4nned Unit Development Certificate Gentlemen: Panhandle Eastern Pipe Line Company has had connected and is pre- sently connecting and delivering natural gas from the Hambert Field and due to the anticipated reduction of production pressures in this field located in Township 4 North, Range 65 and 66 West, and recently approved 160 Acre well spacing, it is necessary to install a natural gas compres- sor unit. This unit will compress the gas to current line pressure and allow the wells in this field to produce at a lower pressure. The location of the proposed booster station is shown on the at- tached Exhibit "Al" reproducible drawing. The planned facilities at the station will consist of liquid retention facilities, a 750 horsepower engine compressor unit enclosed within a specially insulated steel build- ing, a gas pulsation dampener, lube oil and ambitrol facilities and a fenced site all as shown on the attached Exhibit "Bl" drawing. Integral with each unit are gas coolers and scrubber and engine exhaust silencing equipment. A minimum of air pollution can be expected from the exhausts of these clean burning natural gas powered gas compressors. This design indicates that the property line noise level shall normally be 58 to 59 dbA with the proposed facilities installed and 64 to 65 dbA with the possible future facilities which may be installed as indicated on Exhibit "Bl". The plant will be adequately protected from fire hazards through installation of gas detection equipment which would automatically shut down the station. Thirty (30#) pounds ansul dry powder extinguishers will be located strategically throughout the facility. In addition auto- matic emergency shut down systems for high and low temperatures and high and low pressures will be provided on each compressor unit. This station is designed for complete unattended operation; however, one or two personnel will be present for brief periods during the day to perform necessary preventative maintenance. No sanitary or any type of water facilities are planned for this booster station. Commissioner Carlson seconded the motion and it carried unanimously. All five commissioners were present for the hearing. We feel that from the standpoint of te LaSalle Fire Protection District there is no reason why the special use per-lit should not be granted. We would ask the Panhandle Eastern Pipeline Company to supply the LaSalle Fire Department with a list of at least four (4) names and telephone numbers of responsible persons to be con- tacted in case of an emergency at this location. We would also ask that, upon completion of this facility, a representitive of Panhandle Eastern Pipeline Company contact the LaSalle Fire Department so they may tour the site of the booster station. This would allow the fire department to familiarize themselves with the facility and also view the placement of the 30 pound fire extinguishers which will be placed at the site. The Petitioner seeks to obtain a perpetual right-of-way easement for the purpose of an access road across the subject property to and from the facilities of Petitioner, which are a natural gas gathering and transmission system, authorized by the Federal Power Commission . 5. Petitioner has been unable by means of good faith negotiations , to acquire by contract or to agree with the owners ' of the subject property upon the compensation to be paid for the right-of-way easement herein sought. 6. It is necessary that Petitioner be permitted to enter immediately upon the subject land, to use and enjoy the same dur- ing the pendency, and until the final conclusion of these proceedii,gs . 7. The location of the easement as shown on Exhibit A is not unreasonable or arbitrary. 8. Competent evidence shows that the proper compensation to be paid for the possession of the subject right-of-way easement , pending final determination of actual value is $ /.6(7, 0O and said amount should be deposited by Petitioner with the Clerk of this Court for the use of the Respondents, three-fourths of which may be withdrawn by said Respondents. It formed in eolian deposits. Included in this unit are some soils with lime above 40 inches. Also included in mapping were some soils with sandstone between 40 and 60 inches Typically the surface layer is brown sand about 6 inches thick. The underlying material, to a depth of 60 inches is brown sand. Permeability is rapid. Available water capacity is moderate. Effect- ive rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. The potential vegetation on this soil is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grama, needle and thread, little bluestem and blue grama. Potential production ranges from 2500 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, switchgrass, sand reed- grass, sideoats grama and little bluestem decrease and production drops. Sand sage increases, undesirable weeds and annual plants invade and "blow- out" conditions can occur as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass, Indian— grass, switchgrass, sideoats grama, little bluestem and blue grama are f suitable for seeding. Due to the wind erosion susceptibility of this soil seeding should be done with an interseeder or in a firm, clean f r •, sorghum stubble-prepared the growing season prior to seeding with a grass drill. Early spring seeding has proven most successful. Brush management can also help improve deteriorated range. Windbreak and environmental plantings are generally not suited to this soil. On-site investigation is needed to determine if plantings are feasible. Wildlife is an important secondary use for this soil. Rangeland wild- life, exemplified by the pronghorn antelope, can be assisted and en- couraged by development of livestock watering facilities, proper live- stock grazing management and range reseeding where needed. This Valent soil has a fair potential for urban development. The primary limiting soil features are the rapid permeability and susceptibility to wind erosion. Septic tank absorption fields will function properly, however, the proper filtering effect may not be achieved by the sandy substratum. Sewage lagoons would require sealing. It formed on eolian deposits. Included in this unit are some soils with lime above 40 inches. Typically the surface layer is brown sand about 8 inches thick. The underlying material, to a depth of 60 inches is brown sand. Permeability is rapid. Available water capacity is moderate. Effect- ive rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. This soil is suited to limited cropping; intensive cropping is hazardous because of erosion. The cropping system should be limited to close grown crops such as alfalfa, wheat and barley. The soils also are adopted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by corn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grown crops may be irrigated from closely spaced contour ditches or sprinklers. Contour furrows or sprinklers should be used for new crops. Applications of barnyard and commercial fertilizer will help maintain good production. The potential vegetation on this soil is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grama, needle and thread, little bluestem and blue grama. Potential production ranges from 2500 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, switchgrass, sand reed- grass, sideoats grama and little bluestem decrease and production drops. rs Sand sage increases, undesirable weeds and annual plants invade and "blowout" conditions can occur as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reed- grass, Indiangrass, switchgrass, sideoats grama, little bluestem and blue grama are suitable for seeding. Due to the wind erosion suscepti- bility of this soil seeding should be done with an interseeder or in a firm, clean sorghum stubble-prepared the growing season prior to seeding- with a grass drill. Early spring seeding has proven most successful. Brush management can also help improve deteriorated range. Windbreaks and environmental plantings are fairly well suited to this soil. Blowing sand and available water capacity are the principle hazards to establishing trees and shrubs. The soil is so loose that trees need to be planted in shallow furrows and maintain vegetation cover between the rows. Supplemental irrigation will be needed to insure survival. Trees that are best suited and have good survival are Rocky Mtn. juniper, eastern redcedar, ponderosa pine and Siberian elm. Shrubs best suited are skunkbush sumac, lilac and Siberian pea shrub. Wildlife is an important secondary use, with these soils best suited for openland and rangeland wildlife. In cropland areas, habitat favorable for ring-necked pheasants, mourning doves, and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development; this is especially true in areas of intensive agriculture. Rangeland wildlife, exemplified c by the pronghorn antelope, can be assisted and encouraged by develop- ment of livestock watering facilities, proper livestock grazing manage- ment, and range reseeding where needed. This Valent soil has a fair potential for urban development. The primary limiting soil features are the rapid permeability and suscep- tibility to wind erosion. Septic tank absorption fields will function properly, however the proper filtering effect may not be achieved by the sandy substratum. Sewage lagoons would require sealing. Lawns, shrubs and trees, for beautification, when once established will do well. Also included are some soils with loamy substratums and some soils that are noncalcareous to depths of 60 inches. Typically the surface layer is a grayish brown loamy sand about 6 inches thick. The subsoil is a brown to light yellowish brown fine sandy loam about 22 inches thick. The substratum, to a depth of 60 inches, is a sandy loam or loamy sand. Permeability is moderately rapid. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops in the area. However, perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows, contour furrows and cross slope furrows will work on row crops. Sprin- kler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important. Crops grown on these soils respond { to fertilizer applications of phosphorus and nitrogen. � f � y In nonirrigated areas this soil is suited to winter wheat, barley and sorghum. Most of the area is devoted to winter wheat which is alter- nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terr- acing may also be needed to control water erosion. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch- grass, sideoats grama and western wheatgrass are also prominent. Po- tential production ranges from 2200 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years.
