Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description This project is north of and adjacent to CR36 and is east of CR13. Parcel number 120906000030. Access is from CR36. Roads: CR36 is a local gravel road maintained by Weld County. Traffic: Traffic counts adjacent to the site were 46 in September of 2012. The traffic information provided with the submittal states that there are typically 8 daily round trips per day. Access: An access permit has been approved for the access to the site (AP14-00480). The addition of a second dwelling will not create a need for tracing control. General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes) Geological hazard Area: This site IS NOT in a Geologic Hazard Area. Floodplain: The project site IS NOT within a known floodplain. Drainage Study: The drainage narrative indicates there will be no additional imperviousness. The second dwelling does not warrant any stormwater treatment facilities. Grading Permit The project will not require grading as the second dwelling is within an existing structure. CONDITIONS OF APPROVAL: The map shall be amended to delineate the following: A. County Road 36 is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full build out. The applicant shall verify and delineate on the map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. B. Show the approved access(es) on the plat and label with the approved access permit number (AP14-00480). DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. Department of Public Health and Environment CASE NO.: USR14-0075 NAME: Nelson Environmental Health Services has reviewed this request for a Site Specific Development Plan and Use By Special Review Permit for one (1) single-family dwelling unit per lot other than those permitted under Section 23-3-20.A. (second single-family dwelling unit) in the A (Agricultural) Zone District. The existing 3 bedroom home is served by a septic system (SP-9900532). The applicant is proposing to utilize the existing septic system for the proposed second dwelling. A letter dated August 27, 2014 was received from CES Consultants, LLC which indicates the existing septic system is adequately sized for the second residence. A minor repair permit is required to connect the second residence to the existing septic system. Water is provided by Little Thompson Water District, which will also provide service to the second dwelling. We have no objections to the proposal; however, we do recommend that the following requirement be met prior to issuance of a certificate of occupancy for the proposed residence: 1. A minor repair permit is required to connect into the existing On-site Wastewater Treatment System (OWTS) and shall be installed according to the Weld County On-site Wastewater Treatment System Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 2. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 3. This facility shall adhere to the maximum permissible noise levels allowed in the Non- Specified Zone District, as delineated in Section 14-9-30 of the Weld County Code. 4. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing public water supply. (Little Thompson Water District) 5. Sewage disposal shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code pertaining to Individual Sewage Disposal Systems. 6. The facility shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. �� _ MEMORANDUM saril rl yy T To: Tiffane Johnson, Planner November 24, 2014 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR14-0075 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV14-00142)was noted. This violation was initiated due to the construction of a second home without first obtaining the required Land use permits required for a Second Dwelling unit. This case has not been presented to the Weld County Court Magistrate through the Violation process. Since this application was submitted prior to an actual court date being scheduled, no investigation fee is required. This application if approved by staff, will correct the violation. If this application is denied the second home shall be removed; otherwise, the violation case will proceed accordingly. A building permit application must be completed and submitted. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Residential Building Code; 2012 International Energy Code; 2006 International 2011 National Electrical Code; and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction.
