BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
JULY 8, 2015
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, July 8, 2015, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Barbara Kirkmeyer, Chair
Commissioner Mike Freeman, Pro-Tern
Commissioner Sean P. Conway
Commissioner Julie A. Cozad
Commissioner Steve Moreno
Also present:

• MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of July 6, 2015, as printed. Commissioner Conway seconded the motion, and
it carried unanimously.
• READ ORDINANCE BY AUDIO: Commissioner Conway moved to read Emergency Ordinance
#250-A by audio. Commissioner Freeman seconded the motion, which carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Cozad moved to approve the Certification of
Hearings conducted on July 6, 2015, as follows: 1) Hearing Concerning Proposed Designation of the
Site Selection and Construction of Those Major Facilities of a Public Utility Consisting of Pipelines and
Storage Areas of Utilities Providing Water as a Matter of State Interest Pursuant to §24-65.1-401,
C.R.S., and Weld County Code §21-1-210(B). Commissioner Moreno seconded the motion, which
carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as
printed. Commissioner Cozad seconded the motion, and it carried unanimously.
• PUBLIC INPUT: No public input was given.

COMMISSIONER COORDINATOR REPORTS: Commissioner Freeman attended the Northern
Integrated Supply Project (NISP) Support Rally which was well attended and they will have additional
meetings in Fort Collins on July 22nd and at the Weld County Administration Building on July 23rd in
Greeley. He stated the Greeley Parade was a fun time by all and was a good turnout. Commissioner
Conway echoed his support of the (NISP) Rally and encouraged people to go to the meetings to voice
their opinions. He went to the 1-25 Collation meeting and appreciates Congressman Ken Buck attending
and continuing the work toward a solution. Commissioner Cozad was invited by Judge Hartman to a
Truancy Meeting. She said Weld County has the highest number of kids held in detention for an
average of 37 days. She noted the Brighter Futures Program works with kids who are truant. She also
attended several events at the Stampede and at the City of Greeley Council Meeting discussed the
economic impact of the Stampede, not only in Greeley, but also Weld County. Lastly, she was in
attendance at the Johnstown Town meeting; they presented the audit report which demonstrated they
are in a good financial situation. Commissioner Moreno attended the PERC meeting in Denver; the pilot
program continues to move forward with new equipment that will be used for six (6) counties. He went
to the Fair Board meeting and the Fair will start July 29, and end August 2, 2015. He went to the Redi-
Services safety meeting in Platteville; it was a great opportunity to meet with employees and the CEO.
Chair Kirkmeyer expressed that the Commissioners attended the service for Clair Orr, a former County
Commissioner.
NEW BUSINESS:
• 1) CONSIDER HAZARD MITIGATION GRANT CONTRACT FOR STREAM GAUGE PROJECT
AND AUTHORIZE CHAIR TO SIGN: Chair Kirkmeyer reminded the Commissioners that this had
already been discussed in a work session. Commissioner Conway moved to approve said grant
contract and authorize the Chair to sign. Commissioner Cozad seconded the motion, and it carried
unanimously.
EI 2) CONSIDER RENEWAL APPLICATION FOR RETAIL LIQUOR STORE LICENSE AND
AUTHORIZE CHAIR TO SIGN - RLF, INC., DBA CJ'S LIQUORS: Bob Choate, Assistant County
Attorney, stated there are no significant concerns. No public testimony was offered concerning this
matter. Commissioner Freeman moved to approve said renewal application and authorize the Chair to
sign. The motion was seconded by Commissioner Conway, and it carried unanimously.
e 3) CONSIDER ENTRY UPON VARIOUS LANDS BY WELD COUNTY VEGETATION
MANAGEMENT SPECIALIST: Tina Booton, Department of Public Works, requested approval for the
right of entry onto private lands that require weed control. In response to Commissioner Conway, Ms.
Booton replied that multiple attempts have been made to work with the land owners, and most of these
were initiated by complaints from neighbors. She responded to Commissioner Cozad that all noxious
weeds are treated on the property and she explained the billing process. The motion, which was made
by Commissioner Moreno, and seconded by Commissioner Freeman, carried unanimously.
• 4) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
—AZTEC EXPLORATION, LLC: Esther Gesick, Clerk to the Board, requested that this be referred back
to staff as further research is needed. Commissioner Conway moved to refer the matter back to staff.
Commissioner Cozad seconded the motion, and it carried unanimously.
e 5) CONSIDER EMERGENCY ORDINANCE #250-A, IN THE MATTER OF A SUPPLEMENTAL
APPROPRIATION FOR THE YEAR 2015: Don Warden, Director of Finance and Administration,

explained this ordinance and it involves moving budgeted amount from various funds to support other
projects in the County. No public testimony was offered concerning this matter. Commissioner Moreno
moved to approve Emergency Ordinance #250-A Seconded by Commissioner Conway, the motion
carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Ordinance #250-A was approved on Emergency basis.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:32 a.m.
