Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Site intends to inject domestic waste water This project is west of and adjacent to CR 19 and is south of CR 124. Parcel number 020133400003. Access is from CR 124. Roads: County Road 124 is a gravel road and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. This road is maintained by Weld County. The County Road 19 Section Line is estimated to have 60 feet of unmaintained County line right-of-way. The applicant shall delineate the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way. The County Road 122 Section Line is estimated to have 60 feet of unmaintained County line right-of-way. All setbacks shall be measured from the edge of right-of-way. Traffic: No traffic counts are available in the area. The traffic information submitted with the application materials indicated the site would have possibly 1-2 trucks/day. Access: An access permit has been approved for the access to the site (AP15-00340). Tracking Control: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Minimum requirement for all projects include 50ft of road base or recycled asphalt. The site map indicates the tracking control to be located onto CR 19 from the tank location which is incorrect. The tracking control should begin at CR 124 and then down CR 19 at least 50'. Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device "" Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite tracking and upgrading and/or maintaining onsite tracking control. Drainage Requirements: Stormwater impacts to this site are insignificant and staff has indicated that the site meets revised drainage code Exception H. Development of sites where the change in use does not increase the imperviousness of the site, therefore no detention is required. CONDITIONS OF APPROVAL: A. The applicant shall complete a Non-Exclusive License Agreement for the upgrade and maintenance of Weld County Right-of-Way. (Department of Public Works) B. The map shall be amended to delineate the following: 1. County Road 19 is unmaintained section line right-of-way. Show and label 50ft of road base or recycled asphalt from CR 124 on the map. (Planning- Engineering) DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP) 1. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering) 2. The Non-Exclusive section line right-of-way for CR 19 shall be graded and drained to provide an all- weather access. (Planning-Engineering) 3. The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Planning and Engineering) 4. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 5. Department of Public Health and Environment CASE NO.: USR15-0035 NAME: Sullivan Environmental Health Services has reviewed this Site Specific Development Plan and Use by Special Review Permit for a Use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (transportation and storage of domestic septage associated with a commercial business), provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. The applicant has a current septic cleaner license with Weld County, License No. CL- 0700018. The application indicates there will be 1 to 2 employees. A portable toilet will be supplied, which is acceptable. According to the application, septage is brought onto the property to off-load into three 20,000 gallon tanks and the septage will be applied to the applicant's farm field when appropriate. The tanks have been certified by an engineer to store septage and are partially buried. As the tanks do not meet the definition of a vault a building permit will be required for an underground storage tank. "Vault means a watertight, covered receptacle, which is designed to receive and store excreta or wastes either from a building sewer or from a privy and is accessible for the periodic removal of its contents. If the vault is intended to serve a structure or structures that are projected to generate a domestic wastewater flow of two thousand (2,000) gallons per day or more at full occupancy, the vault is a domestic wastewater treatment works. Vaults are OWTS." In accordance with Chapter 14, Article VI (Domestic Septage) of the Weld County Code a domestic septage permit shall be required for the application of domestic septage in the unincorporated areas of the County. The proposed application rate of the domestic septage has to be conducted at the agronomic rate of the proposed crops. The determination of the agronomic rate shall consider historic crop yields at the proposed site and reasonable, realistic crop yield goals. In no case shall the application rate exceed twenty-five thousand (25,000) gallons per acre per year. The facility shall be operated so that off site odors do not exceed the seven-to-one dilution threshold level as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. We recommend that the following requirement be met prior to operation: 1. In accordance with Chapter 14, Article VI (Domestic Septage) of the Weld County Code a domestic septage permit shall be obtained for the application of domestic septage. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of seven-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of seven-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 8. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 9. The facility shall be operated in accordance with Chapter 14, Article VI (Domestic Septage) of the Weld County Code. 10.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code.
