OF NEW JERSEY, INC.
WHEREAS, the County Engineer has recommended the
release of a $20, 522 . 50 Demand Note now being held by
Weld County, Colorado, for the completion of certain
road requirements within said Westridge Subdivision
Fourth Filing (SEo, NEo and SWa, Section 16 , Township 5
North, Range 66 West of the 6th P.M. , Weld County,
Colorado) said Demand Note more particularly described
as follows :
Dated March 1, 1972; made payable to Board of
County Commissioners , Weld County, Colorado;
in the amount of $20,522 . 50 ; signed by William
S. Bunte, President, and Robert H. Folk,
Secretary, Rocky Mountain Enterprises of
New Jersey, Inc.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners , Weld County, Colorado, that they
do hereby direct the County Clerk to release said
Deamnd Note, now being held by the County, in the
amount of $20. 522 . 50 to the Rocky Mountain Enterprises
of New Jersey, Inc.
The above and foregoing resolution, was on motion
duly made and seconded, adopted by the following vote
this llthday of August, 1975.

Greeley, Colorado February 28 , 19 72 .
On demand after d<te for value received, the undersigned promises to pay to the
order of the Board of County Commissioners, .Weld County, Colorado, the sum of
TWENTY THOUSAND FIVE HUNDRED TWENTY-TWO AND 50/100 'Dollars
( $20.522.50 . ) with interest at ten percent (10%) per year from date of
demand until paid.

This note is given for the purpose of securing the Board of County Commissioners,
Weld County, Colorado, against a contingent liability by reason of said Board of
Commissioners, Weld County, Colorado, granting subdivision rights to one or more
of the undersigned within the County of Weld, Colorado, as outlined in Subdivision
Agreement dated February 28 , 1972, and guaranteeing installation
of certain improvements in said subdivision by February 28 1974

Amount of note shall be conditioned by damages which the Board of County Commis
sioners shall suffer by failure of undersigned to perform under said agreement.
Upon final acceptance of said improvements by the Board of County Commissioners,
Weld County, Colorado, this obligation shall be void; otherwise to remain in full
force and effect.

The makers, endorsers, sureties��gu r r and assignors of this note severally
waive demand, presentment foa,l)ayim5 protest and notice of protest and of non-
payment, and agree and co Kt ii• xtehsions of time of payment, without
notice by the holder o ` n �qu t fl y of them.
It is also stipulated t ' r�"�'shoulld this note be collected by an attorney after
maturity or in case of fault (whether by suit or otherwise) , ten percent (10%)
additional on amount ue shall be allowed the holder as attorney fees.
If the improvements as shown have not been constructed by the stated completion '
time, the Board of County Commissioners will re-negotiate the note amount to
reflect change in construction cost and the amount of improvement construction
completed, and, will extend this note for a two year period.
