Dear Ms. Aungst:
We have reviewed the above referenced proposal for a site-specific development plan and use
by special review for a mineral resource development on approximately 92 acres. The submitted
material does not appear to qualify as a "subdivision" as defined in C.R.S. S 30-28-101(10)(a).
Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors,
this office will only perform a cursory review of the referral information and provide comments. The
comments will not address the adequacy of the water supply plan for this property or the ability of the
water supply plan to satisfy any County regulations or requirements.
The proposal is for a gravel mining operation, known as the Van Cleave Pit, which will be
operated under Colorado Division of Reclamation Mining and Safety (DRMS) permit no. M-2014-064. The
primary commodities to be mined at the site are sand and gravel for road base/construction materials.
The site is proposed to be reclaimed to its current use of rangeland upon completion of the mining
operation. Comments regarding the reclamation permit were provided to the DRMS in a memo dated
December 2, 2014.
No groundwater is anticipated to be encountered at the Van Cleave site; therefore exposure of
ground water must not occur during or after mining operations. The site is anticipated to have six to
eight employees on site, with additional visits by material haul truck drivers. Bottled drinking water
will be provided for employees and visitors, and portable toilets will be located on site. Water for dust
control and crushing operations will be trucked to the site from elsewhere. The applicant will need to
document that the water was obtained from a legal source, or the water was diverted in priority under
a water right decreed for such industrial use.
During mining, storm water runoff will generally be contained within the mine pit. Any storm
water runoff intercepted by this operation that is not diverted or captured in priority must infiltrate
into the ground or be released to the stream system within 72 hours; otherwise a substitute water
supply plan or augmentation plan approved by water court must be obtained.
