O co WHEREAS, the Board of County Commissioners of Weld County, cc Colorado, pursuant to Colorado statute and the Weld County Home t--t Rule Charter, is vested with the authority of administering the e affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, O Colorado, has reviewed the request of James Sargent for an exemp- i tion of land to be transfered by him to Monfort of Colorado, Inc. , from the definition of "subdivision" and "subdivided land" in Sec- tion 30-28-101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations , and WHEREAS, the Board finds that the contemplated transfer does not conflict with the intent of the Weld County Comprehensive Plan and will not have an adverse impact on the existing use of the land, and WHEREAS, the Board has considered the recommendation of the Department of Planning Services on this matter and has reviewed information submitted by the applicant. The property is subject to a contract for sale to Monfort Feed Lots , Inc. , a Colorado corporation. However, Monfort Feed Lots , Inc. has agreed to allow the Sargents to purchase the 2 .054-acre plot described on the Exhibit hereto attached known as Lot A. The transaction would be handled by having the Estate retain Lot A and then convey it to the heirs of James Sargent, with Monfort purchasing the remaining 79.311 acres. Monfort Feed Lots, Inc, has agreed to allow the Estate to retain Lot A with the agreement that there be an Option Agreement allowing Monfort Feed Lots , Inc. , its successors or assigns, at the end of a ten-year period, and within six months thereafter, to purchase said Tract A at the agreed upon appraisal price plus fair market value of any improvements approved by Monfort Feed Lots, Inc. , its successors or assigns, and made thereon during the ten-year period. Monfort has asked for this Option in order that if in the future Lot A might conflict with the planning of the area, Lot A could be repurchased in order that whatever development occurs might be uniform. Sargent, personal representative of the estate of James Sargent, on February 28 , 1977 . Subsequently, the parties agreed that, if the Board of County Commissioners approved a subdivision exemption, the estate could retain a small lot within the described parcel con- sisting of 2 . 054 acres which comprises the Sargent "homestead" , subject to an option to purchase executed by the estate in favor of Monfort of Colorado, Inc. , its successors or assigns . Under the terms of said option agreement, Monfort of Colorado, Inc. , its successors or assigns shall have the option to purchase said homestead parcel at the end of a ten year period, said option to be exercized within six months there- after, the option price to be the agreed appraisal price plus the fair market value of any approved improvements made thereon during the ten year term.
