Re-subdivision questionnaire
1. Elmer Lundvall wishes for the existing 10.45 acre parcel to be divided into two 5.2 acre lots.
The proposed lots would be used for (2) single family residence lots. Each lot would have access
on existing streets within Arrowhead Subdivision. The west lot would access Kiowa Drive and the
east lot would access Pawnee Drive.
2. A preliminary site plan has been prepared to show that pad sites on the lots are big enough
for a home and leach field without being in the flood plain.
3. There are two 5.2 acre lots proposed.
4. There lots would access existing paved roads within Arrowhead subdivision.
5. On street parking may be permitted in overflow situations only and not on a regular basis.
6. The lots have water taps purchased for them from the City of Evans
7. The lots will have private septic systems
8. A letter requesting a waiver of the Geologic Survey is included .
9. No covenants or restrictions will be imposed on the lots.
10. No erosion control for the subdivision construction will be required.
11. No new roads will be required for the subdivision .
12. There are no irrigation ditches to be modified .

Dear Ms. Petrik:
The proposed change of zone and proposed splitting of the 10 acre lot into two 5 acre
parcels will probably have insignificant effects on surrounding properties in Arrowhead
subdivision. Both of the proposed lots will drain mainly north and directly to a 100-year flood
way. The amount of increased runoff should me minimal considering residential zoning on a 5
acre lot. Future grading should be reviewed to verify grading does not negatively impact
surrounding residential property.

STEWART TITLE GUARANTY COMPANY, a Texas Corporation ("Company"), for a valuable consideration, commits to issue
its policy or policies of title insurance, as identified in Schedule A, in favor of the Proposed Insured named in Schedule A, as
owner or mortgagee of the estate or interest in the land described or referred to in Schedule A, upon payment of the premiums
and charges and compliance with the Requirements; all subject to the provisions of Schedules A and B and to the Conditions

This Commitment shall be effective only when the identity of the Proposed Insured and the amount of the policy or policies
committed for have been inserted in Schedule A by the Company.
All liability and obligation under this Commitment shall cease and terminate six months after the Effective Date or when the

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust,trust deed, or other security instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved
from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if
the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other
matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall
not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b)to eliminate exceptions
shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this
Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies
committed for and such liability is subject to the insuring provisions and Conditions and the Exclusions from Coverage
of the form of policy or policies committed for in favor of the proposed Insured which are hereby incorporated by
reference and are made a part of this Commitment except as expressly modified herein.
4. This Commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a report of
the condition of title. Any action or actions or rights of action that the proposed Insured may have or may bring against
the Company arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered
by this Commitment must be based on and are subject to the provisions of this Commitment.
5. The policy to be issued contains an arbitration clause. All arbitrable matters when the Amount of Insurance is
$2,000,000 or less shall be arbitrated at the option of either the Company or the Insured as the exclusive remedy of the

B. No labor or materials have been furnished by mechanics or materialmen for purposes of construction on the land

C. The Company must receive an appropriate affidavit indemnifying the Company against unfiled Mechanic's and
Materialmen's Liens.
D. The Company must receive payment of the appropriate premium.
E. If there has been construction, improvements or major repairs undertaken on the property to be purchased, within

SCOPE
This report presents the results of a preliminary geotechnical exploration for the proposed
subdivision of Tract A,Arrowhead 4th Filing,Weld County,Colorado. The buildings are anticipated
to be of typical wood frame construction. Full basement and/or crawlspace construction is
anticipated for these structures.
This exploration was conducted to provide preliminary recommendations pertaining to the
type and depth of foundation system,soil bearing pressures,groundwater conditions,and to identify
any complications that may be encountered during or after construction due to subsurface conditions.
SITE INVESTIGATION
The field investigation performed on March 19, 2014, consisted of drilling, logging, and
sampling two(2)test borings across the 10-acre site. The borings ranged in depth from thirteen(13)
to sixteen (16) feet. The location of the Test Holes is shown on Drawing No. 1.
Boring locations were established by a representative of CDS Engineering Corporation based
on a site plan provided by Wernsman Engineering. Distances from the referenced features were
made by pacing and angles were estimated. Graphical logs of the borings are shown on Figure No.
2. The descriptions of the soils and/or bedrock strata are based, primarily, on visual and tactual
methods which are subject to interpretation.
The test borings were advanced using a truck mounted,four-inch(4")diameter,continuous
flight auger drill rig. Laboratory samples were obtained by driving a two and one-half inch(2%2")
diameter California Barrel Sampler twelve(12) inches(or as shown)into undisturbed soils with a
140-pound hammer falling thirty(30) inches. Bag samples of auger cuttings may have also been
collected.
Laboratory tests performed were - Swell-Consolidation, Natural Moisture, Natural Dry
Densities, and Unconfined Compressive Strengths. All tests were conducted in accordance with
ASTM standards. A Summary of the Swell-Consolidation Test Results is shown on Figure No.3. A
Summary of Test Results is shown on Table No. 1.

SITE LOCATION AND DESCRIPTION
The site is located southwest of Greeley,west of 47th Avenue on the south side of 37`h Street,
Weld County,Colorado. The site is generally in a plains region,and vegetation consists primarily of
grasses,trees,and shrubs.The site has slopes in varying directions. No rock outcrops were observed
at this site. An apparent wetlands area runs through the north side of the property.
SUBSURFACE CONDITIONS
Refer to the Log of Borings, Figure No. 2. The subsurface conditions appear uniform
throughout the proposed building site. General descriptions of the soils and/or rock encountered are
as follows:
TOPSOIL—A thin layer of topsoil,approximately six(6)inches,overlies the site. The topsoil
should not be used as foundation bearing material,structural fill,or backfill. It is suggested that
the topsoil be stripped, stockpiled and used for landscaped areas.
CLAY — Clays with slight to moderate amounts of silt, and slight amounts of sand were
encountered in the upper two and one-half(2'/2)to three(3)feet of Test Hole Nos. 1 and 2. The
clays appear to be moist, firm to stiff, and brown. The clays exhibit low swell potential.
SILTSTONE — Siltstone bedrock strata with slight to high amounts of clay and sand were
encountered from beneath the upper soils to the depths explored in Test Hole Nos. 1 and 2. The
competent siltstone exhibits high bearing capacities with low swell potentials detected in our
tests.
Groundwater levels were recorded as the borings were advanced, after completion of the
drilling operations,and twenty-four(24)hours after drilling operations were complete. During our
field exploration groundwater was encountered in each test hole at a depth of ten (10) feet. The
water levels listed above are the stabilized levels of the free groundwater surface at the time of this
exploration and may not properly define yearly groundwater levels.

SITE DEVELOPMENT
The preliminary geotechnical concerns which may influence development of this site are the
shallow depth of bedrock. These issues can be mitigated with proper planning,engineering,design
and construction. Other geotechnical issues for the site include site grading, utility construction,
pavement subgrades, and construction of permanent slopes for long term stability and protection
against erosion. These concerns are discussed in the flowing sections.
Due to the preliminary nature of this project,site organization or grading plans have not been
prepared,and therefore are not available for review in conjunction with this subsurface exploration
program. Therefore, recommendations provided here are general and for planning purposes only.
Overlot Grading
Although evidence of fills or underground facilities such as silage pits, septic tanks,
cesspools, basements and utilities were not observed during the field exploration and testing
program,such features could be encountered during construction. If unexpected fill or underground
facilities are encountered, such features should be removed and the excavation thoroughly cleaned
prior to backfill placement and/or construction.
In areas to be filled,the ground surface should be stripped of vegetation,scarified,moisture-
conditioned and compacted to at least 95 percent of the standard Proctor maximum dry density
(ASTM D-698). We anticipate stripping will require minimal cuts of six(6)to twelve(12)inches
for the majority of the site.
The on-site soils can be used as site grading fill provided it is free of vegetation and other
organic materials, trash, rubbish and construction debris. Fill should not contain rocks or lumps
greater than six (6) inches in diameter. Highly plastic and swelling clays and claystone bedrock
strata should not be used or mixed with other soils for fill in areas with structures. Clay fill,if used,
should be placed at a high moisture content to reduce swell potential. The placement and
compaction of site grading fill should be observed and tested by a qualified Soils Engineer.
Basement Construction
Groundwater was encountered in the test holes at a depth of approximately ten (10) feet
below existing ground surface and may rise with long term development and subsequent landscape

irrigation. Generally,full basement level construction would be considered feasible at this site. The
relatively shallow groundwater level in these areas may limit foundation depths and the variety of
structure styles which could be offered.
PRELIMINARY FOUNDATION RECOMMENDATIONS
The type of foundation system applicable to each specific building location will depend on
the swell potentials of the upper soils and bedrock strata,the location and type of bedrock strata,the
type and depths of construction, and other factors that may come up at the time of construction.
Drilled pier foundations would be suited where moderately to highly expansive soils and/or bedrock
are encountered within the influence zones of the foundation. The drilled pier foundations could
range in depth from twenty (20)to thirty(30) feet. Spread footings may be an option where some
type of ground modification is utilized. The spread footing foundations may have maximum
allowable bearing pressures ranging from 1500 to 2500 pounds per square foot(dead load plus live
load)and a minimum bearing pressures ranging from 0 to 750 pounds per square foot.Individual,
site specific investigations are recommended to develop criteria for designing the foundations
and floor systems. Based on the information gathered in our limited subsurface exploration and
laboratory testing,it appears that the lots in the planned subdivision will require drilled straight shaft
pier foundations.
SLAB CONSTRUCTION
The type of floor system will depend on the swell potential of the soils,the type of usage and
the owner's tolerance to slab movement. At this site,slabs placed a minimum of three(3)feet above
the bedrock,in our opinion,could be constructed on grade. Slabs placed within three(3)feet of the
bedrock may require alternate methods such as soil replacement or structural floors.

FOUNDATION DRAIN SYSTEM
A perimeter drain system shall be installed where below grade floors are constructed. The
type of drain,interior,exterior or both should be determined by a more specific site exploration and
at the time of the excavation observation.
CONCLUSIONS
The data presented in this report were collected to help determine the feasibility of this
project. Recommendations provided are for planning purposes subject to change based on future
testing for site development.
The findings and recommendations of this report have been obtained in accordance with
accepted professional engineering practices in the field of Geotechnical Engineering. However,
standard Geotechnical Engineering practices and related government regulations are subject to
change. The recommendations provided in this report are only valid as of the date of this report. If
the construction is at a later date,we would be glad to review the information presented in this report
with regard to updated governmental requirements or industry standards. There is no other warranty,
either expressed or implied. We do not guarantee the performance of the project in any respect,but
only that our engineering work and judgments rendered meet the standard of care of our profession.
This report applies only to the type of construction anticipated in the area tested. The current
technology is not at a stage where a guarantee of"absolutely no damage"can be assured by design
and construction practices.

for the proposed subdivision of Tract A,Arrowhead 4th Filing, Weld County, Colorado.
SITE INVESTIGATION

depths of thirteen(13)to sixteen(16)feet and two(2)percolation holes to an average depth of thirty
(30)inches,at each site. Percolation tests were performed on March 20,2014. The Location of the
Test Holes is shown on Drawing No. 1. A Log of Borings is shown on Figure No. 2.

Topsoil-A thin layer of topsoil,approximately six(6)inches,overlies the site. The topsoil should
be stockpiled and used as backfill over the absorption field.
CLAY —Clays with slight to moderate amounts of silt,and slight amounts of sand were encountered
in the upper two and one-half(2%)to three(3)feet of Test Hole Nos. 1 and 2. The clays appear to
be moist,firm to stiff, and brown. The clays exhibit low swell potential.

encountered from beneath the upper soils to the depths explored in Test Hole Nos. 1 and 2. The
competent siltstone exhibits high bearing capacities with low swell potentials detected in our tests.
Groundwater levels were recorded as the borings were advanced, after completion of the
drilling operations, and twenty-four (24) hours after the drilling operations. During our field
explorations groundwater was encountered in the profile holes at a depth of ten (10) feet. The
groundwater table could be expected to fluctuate throughout the year depending on seasonal moisture
variations.
PERCOLATION TEST RESULTS
A total of two (2) percolation tests were conducted at each site, using the Standard Test
Method,as described by the Weld County Health Department. Percolation test holes were presoaked
on March 19, 2014,and the test was performed on March 20, 2014.
The percolation exploration indicates average percolation rates of 100 minutes per inch at site
1; and 132 minutes per inch at Site 2. Due to the slow percolation rates, and shallow bedrock,we
anticipate that engineered septic systems will be required for these conditions. Based on these
conditions,Evapotranspiration absorption or low pressure drip systems would be applicable at these
sites.
SEPTIC SYSTEM RECOMMENDATIONS
The beds should be constructed by a licensed septic system installer,in accordance with the
I.S.D.S.R.for Weld County. An effluent filter could be installed in or after the septic tank and may
provide a longer life for the system. The beds should lie a minimum of ten(10)feet from property
lines, twenty (20) feet from the proposed structure, and one-hundred (100) feet from most water
features,such as ditches and wells. The contractor and/or owner must carefully plan the elevations
of the structures if gravity flow of the wastewater to the septic system is desired. We recommend

that the top of the bed or trench be a minimum of one foot below any floor level with gravity sewer
otherwise a pump system may be required.
CONCLUSIONS
These tests are only preliminary for the area tested. The findings and recommendations of
this report have been obtained in accordance with accepted engineering practices in the field of
Geotechnical Engineering. The county health department has final acceptance over these test results
and referenced system. All construction shall be in compliance with the septic system permit.

HI Chris, since it was done as a tract in a later filing, I am not sure it was ever really
part of the surrounding subdivision. I am not sure about that though. It will be more
similar to the existing lots surrounding it, after the re-subdivision is done. The
surrounding lots are 2 acres plus or minus. After the re-subdivision is done, the lots
will be 5 acres instead of the one 10 acre lot. I am a little unsure about how to
address this. Please let me know if this is adequate or I need to provide a letter with
further information.

recommendation for the Lundvall case and I have realized that our resubdivision
application is a bit confusing. The application form and questionnaire does not
include a specific question/submittal that is outlined in our County Code to be
submitted with the resubdivision application:

the proposed resubdivision complies with the approved final plat. The letter
shall also explain how the resubdivision complies with the adopted rules,
regulations and ordinances currently in force and affecting the subdivision."
Could you please provide a response to this question. (In regards to the
subdivision rules and regulations question — Chapter 24 is the chapter to look at).
I am going to revise or have somebody revise this application so that it is a bit
clearer.
I will get back to you on NCTC — our staff meeting has been pushed back to this
afternoon.
