The proposal has been reviewed by Development Review on behalf of the Weld County Department of
Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the
application process may not be all-inclusive, as other issues may arise during the remaining application
process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Change of Zone from the A (Agricultural) Zone District to the E (Estate) Zone District.
This project is north of Highway 392 and is east of and adjacent to County Road 25.
Parcel number: 080518300015.
Access will be from County Road 25.
ACCESS
Neither the Change of Zone (COZ) application nor the Change of Zone draft plat identifies where the
proposed access (subdivision intersection)will be located on County Road 25. Per Weld County Code, the
intersection shall be located to meet the minimum access and intersection spacing criteria prescribed for a
local road in Table 1 of Section 8-14-30.
Per Section 8-14-30, an Access Permit is required for access to Weld County maintained roadways. More
information regarding access can be found in Chapter 8 of the Weld County Code.
ROAD AND RIGHT-OF-WAY
County Road 25 is a gravel road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of
setback in the Weld County Code, Section 23-1-90, the required setback is measured from the future right-
of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is
maintained by Weld County.
Per Chapter 8, Article 13, Section 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any
project that will be occupying, constructing, or excavating facilities within, and or encroaching upon, any
County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at:
https://www.weld.gov/Government/Departments/Public-Works/Permits/Right-of-Way-Permits.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
CONDITIONS OF APPROVAL
A. Per Section 23-2-40.B.4., the applicant shall demonstrate that County Road 25 has a minimum 26-foot-
wide travel surface with a minimum 4-inch depth of aggregate surface course (gravel) and a minimum
right-of-way width of sixty (60) feet. Otherwise, the rezoning shall only be approved on the condition
that the applicant shall enter into an Improvements Agreement prior to recording the Change of Zone
plat. Such agreement shall be in conformance with Appendix 8-N, Transportation Plan, and Section 2-
3-30, Collateral for improvements, both of this Code. The Improvements Agreement shall provide for
the road to be improved to a minimum of 26-foot-wide travel surface with a minimum 4-inch depth of
aggregate surface course (gravel) and a minimum right-of-way width of sixty (60) feet prior to the
recording of any land use permit map or issuance of any building permit, access permit, or grading
permit, whichever comes first, and shall be re-evaluated for compliance with any additional
improvements upon submittal of an application for a land use permit, building permit, access permit, or
grading permit. Additional improvements, if necessary, may require an amended or new Improvements
Agreement documenting additional requirements. No land use permit, building permit, access permit,
or grading permit shall be issued without review of the Improvements Agreement. (Development

B. The plat shall be amended to delineate the following:
1. County Road 25 is a gravel road and is designated on the Weld County Functional Classification
Map as an local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate and label the existing right-of-way (along with its creating documents) and the physical
location of the road. All setbacks shall be measured from the edge of the right-of-way. This road
is maintained by Weld County. (Development Review)
2. Delineate and label any existing County Road 25 access serving the subject parcel and label it with
all applicable access types (i.e., AGRICULTURAL, RESIDENTIAL AND/OR OIL & GAS).

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
A. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
B. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Development Review)
C. There shall be no parking or staging of vehicles on public roads or within public rights-of-way. On-site
parking shall be utilized. (Development Review)
D. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned
ponding of stormwater runoff. (Development Review)

Dear Diana:
At your request(July 29,2025),the Colorado Geological Survey has reviewed the COZ25-0009 referral. I
understand the applicant proposes a change of zone from A(Agricultural)to E(Estate)to accommodate a planned
nine-lot residential subdivision on approximately 36.1 acres platted as Portion of Vacated Lot B,Recorded
Exemption No. 0805-18-03 RECX16-0016.
The site does not contain steep slopes, is not undermined, is outside of mapped 100-year flood hazard zones,and
no geologic conditions are known or suspected to be present that would preclude the proposed residential use and
density.
Mineral resource potential.According to the Atlas of Sand, Gravel, and Quarry Aggregate Resources, Colorado
Front Range Counties(Schwochow et al, Colorado Geological Survey Special Publications 5-A,Plate 1, and
5-B, Severance Quadrangle, 1974),the subject property is mapped as not containing an aggregate resource.
Soil and bedrock engineering properties.EEC's Preliminary Geotechnical Engineering Report, Subdivision at
CR 25 and CR 68,Weld County, Colorado(EEC Project No. 1212029,April 28,2021)contains a valid
characterization of overall subsurface conditions and makes appropriate preliminary recommendations
regarding site development.
Provided EEC's recommendations are adhered to(specifically including additional,building-specific
investigation, analysis and design), CGS has no objection to approval.

Dear Ms. Aungst,
This referral for case no. COZ25-0009 does not appear to qualify as a "subdivision" as defined in
section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and
March 11, 2011 memorandums to county planning directors, this office only performed a cursory
review of the referral information. Upon review, it appears that the proposed water supply source
for the property is service provided by the North Weld County Water District, subject to various
terms and conditions of NWCWD as outlined in their letter dated May 21, 2025. There are no
permitted wells on the subject property. Our office has no comments on this referral.
