DISTRICTS (40X80 SQUARE-FOOT SHOP AND PARKING FOR ABOUT 20 SEMI
TRUCKS), PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR
RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO
ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE
A (AGRICULTURAL) ZONE DISTRICT -TERI SCHWARTZKOPF
A public hearing was conducted on July 29, 2015, at 10:00 a.m., with the following present:

Commissioner Mike Freeman, Pro-Tem
Commissioner Sean P. Conway - EXCUSED
Commissioner Julie A. Cozad
Commissioner Steve Moreno
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 20, 2015, and duly published
March 25, 2015, in the Greeley Tribune, a public hearing was conducted April 29, 2015, to
consider the request of Teri Schwartzkopf, for a Site Specific Development Plan and Use by
Special Review Permit, USR15 0004, for any Use permitted as a Use by Right, Accessory Use,
or Use by Special Review in the Commercial or Industrial Zone Districts (40x80 square-foot
shop and parking for about 20 semi trucks), provided that the property is not a lot in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District, at which time the Board
deemed it advisable to continue the matter to July 8, 2015, to allow the applicant, Teri
Schwartzkopf, adequate time to meet with surrounding property owners, have a hearing before
the Planning Commission which had been continued to May 5, 2015, and present to a full
quorum of the Board. A public hearing was conducted July 8, 2015, at which time the Board
deemed it advisable to continue the matter to July 29, 2015, due to a scheduling conflict. On
July 29, 2015, Brad Yatabe, Assistant County Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, entered the request of the applicant to
continue the matter to August 5, 2015, to present to a full quorum of the Board.
Tami Long, resident to the south, expressed her displeasure regarding the many
continuances of this case and disclosed her efforts to speak to Teri Schwartzkopf in objection to
the number of semi trucks and truck traffic. She stated this has been going on since last

November and as far as the she is concerned, it would be best to get it resolved as soon as
possible.
Chair Kirkmeyer expressed her appreciation for Ms. Long being present and willing to
share her frustration. However, she clarified that because of due process, it is up to the
applicant to decide if they want to present to a full board and since that is the preference of the
applicant, it will be contiued to August 5, 2015. Chair Kirkmeyer asked Ms. Long if she will be
able to attend, she answered yes.
Commissioner Moreno moved to continue the request of Teri Schwartzkopf, for a Site
Specific Development Plan and Use by Special Review Permit, USR15-0004, for any Use
permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or
Industrial Zone Districts (40x80 square-foot shop and parking for about 20 semi trucks),
provided that the property is not a lot in an approved or recorded subdivision plat or part of a
map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District, to August 5, 2015. The motion was seconded by Commissioner
Cozad. Commissioner Moreno expressed his appreciation for the neighbors being present and
apologized for the many continuances. Commissioner Cozad agreed. The motion carried
unanimously. Chair Kirkmeyer concurred and apologized for the many continuances. There
being no further discussion, the hearing was completed at 10:10 a.m.
This Certification was approved on the 3rd day of August, 2015.
