MAYES, FROM THE DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" . WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has reviewed the request of John M. Mayes and Joyce K. Mayes for an exemption of land to be transferred to them by Weld County Farm, Inc. , d/b/a Northern Colorado Sod Company, from the definition of "subdivision" and "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations, and WHEREAS, the Board finds that the contemplated transfer does not conflict with the intent of the Weld County Comprehen- sive Plan and will not have an adverse impact on the existing use of the land, and WHEREAS , the Board has considered the recommendation of the Department of Planning Services on this matter and has reviewed information submitted by the applicant. Mayes and Joyce K. Mayes which conveyed to them a tract of land approximately 39 acres in the Northwest Quarter of Section 5, Township 3 North, Range 68 West, Weld County, Colorado. The legal description found in the enclosed deed together with the legal description found in the quit claim deed to the Mayes previously sent to you incorporates the entire tract that is to be owned by Mr. and Mrs. Mayes . As I ex- plained to you in our telephone conversation, the property described in the enclosed deed did not include the portion described in the quit claim deed as there was a dispute as to the location of the boundary line with Mrs. Phyllis Schell. Now that the Weld County Farm, Inc. and Mrs. Schell have resolved their dispute as to the location of the boundary line, the purpose of the quit claim deed to Mr. and Mrs . Mayes sent to you on March 18 , 1977, is to merely con- vey the additional property to Mr. and Mrs . Mayes for which they had originally contracted to receive. Clearly, from the standpoint of Weld County Farm, Inc. the intent of the second conveyance of 2. 703 acres to the Mayes is not to create a separate parcel for later conveyance by the Mayes , but merely to add to the 39. 997 acres previously conveyed to them to make a total tract of 42. 7 acres. SUMP March 18 , 1977 r Mr. Tom Hahn m 7^ c/o Department of Planning County of Weld 915 10th Street Greeley, Colorado 80631 Re: Quit Claim Deed exchange to adjust disputed boundary lines in Northwest Quarter of Section 5, Township 6, North, Range 68 West of the 6th P.M. , Weld, County, Colorado Dear Mr. Hahn: This letter will follow up my telephone conversation with you of March 16, 1977 , in which we discussed the procedure which might be used to exchange two quit claim deeds between the Weld County Farm, Inc. , and Phyllis J. Schell that will adjust and make final the boundary lines that exist between the two property owners. The reason for exchanging quit claim deeds and adjusting the boundary stems from a dispute over the size of the reservoir site that is contained in the above referenced quarter section. The problem has developed over whether the reservoir site pre- sently owned by Mrs. Schell contained approximately 7 acres or approximately 15 acres. The legal description that describes the reservoir site is one that does not close on its four boundary lines. This law firm has spent a great deal of time and effort in reviewing this boundary problem and has concluded after reviewing the abstract of both properties , reviewing aerial photography of the area, consulting with the Weld County Assessor, that the reservoir site should be approximately 7 acres. It was the intent of our client to quiet the title in a judicial decree to determine these boundaries . In order to avoid litigation, the parties have agreed upon a compromise boundary to be established between themselves . The result of the compromise boundary will yield a reservoir site of about 9 acres, the remaining property to be retained by the Weld County Farm, Inc. and John and Joyce Mayes who recently pur- chased 39 acres in the southwest corner of the above referenced quarter section from Weld County Farm, Inc. Mr. Tom Hahn -2- March 18 , 1977 The intent of the quit claim exchange is not to create any additional parcels of land but merely to define the boundaries of the existing parcels so that the continuing controversy over their location can be resolved finally. This matter has been reviewed by Mr. Denver Wiggins of Security Abstract Com- pany / Stewart Title Company who has concurred with the quit claim deed exchange. Recognizing the various zoning requirements within Weld County and the dictates of Senate Bill 35, I would request your assist- ance from a procedural standpoint of obtaining approval from the Weld County Department of Planning and the Weld County Commissioners to this exchange of deeds to resolve the boundary dispute. For your review, I am enclosing the proposed deeds and a copy of the survey which shows the location of the existing boun- daries, boundary lines that would be created by existing fence lines and proposed boundary lines.
