RE: RECORDED EXEMPTION NO. 276 - MELVIN REICHERT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 12th day of September, 1977, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Melvin Reichert, located
in part of the SWa of Section 31, Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado, more particularly
described on Exhibit "A" , a copy of which is attached hereto
and incorporated herein by this reference, does not come within
the purview of the definition of the terms, "subdivision"
and "subdivided land" , pursuant to its authority under Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Melvin Reichert, be exempt from
the definition of the terms, "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973.
BE IT FURTHER RESOLVED, by the Board of County Commis-
sioners that the approval of this Recorded Exemtion is subject to
the condition that the Plat be corrected to reflect the ease-
ment as requested by the Town of LaSalle.

Dear Commissioners :
The attached application, plat, and related items are in reference
to a request by Melvin Reichert for a Recorded Exemption. The parcel
of land in question is Pt. of the SW# of Section 31, T5N, R65W of the
6th p.m. , Weld County, Colorado. The property is located immediately
northwest of LaSalle. The parcels contains 10. 84 acres of Class VII
soils. The desire is to divide the property into parcels of 2 acres
and 8. 84 acres. The 2 acre parcel contains improvements commonly
known as Valley Packing. The balance contains no improvements.
Based upon the information submitted and the adopted policies in the
county, the staff recommends that the request be approved for the
following reasons :
1. The proposed split conforms with the intent clause of the Recorded
Exemption procedure (Section 9-2) of the Weld County Subdivision
Regulations and the Weld County Comprehensive Plan. The property
contains Class VII capability soils and lies within the compre-
hensive plan area of LaSalle;
2. The Town of LaSalle recommended approval of the request ; and
3. The proposal is in conformance with the intent clause of the
Agriculture District as it provides for orderly expansion of urban
growth in conformance with the Weld County Comprehensive Plan.

RE: APPLICATION FOR RECORDED EXEMPTION OF MELVIN REICHERT
Gentlemen:
On Monday, August 15 , 1977 , I filed with the County' s planning
office an application for a recorded exemption concerning cer-
tain property owned by Mr. Reichert in the southwest o of Sec-
tion 31 , Township 5 North, Range 65 , West of the 6th P.M. in
Weld County, Colorado immediately to the northeast of the town
of LaSalle. The application was , of course, submitted with the
required plat, legal description and title record documents but,
in that the form of application contains only minimal information
required by the county, it was felt some additional information
might be useful to you.
The present 10. 84 acre tract is the cite of a meat packing facil-
ity commonly known as Valley Packing which has previously been
operated by the owner of the land, Mr. Melvin Reichert, and by
his lessees as recently as mid-September, 1976 . When the last
lease on the plant terminated, Mr. Reichert ' s other business
interests made it impractical for him to resume operation of
the plant personally and he began looking for a purchaser for
the property.
The property itself was originally subject to four separate legal
descriptions of rather unusual shape and size as reflected by the
title documents and the plant situate on the property lies on two
of the four previously platted pieces of land and is immediately
on the line of a third.
In representing the prospective purchasers of the property, Mr .
and Mrs . Darrell Leggett , I recommended that the property be re-
surveyed and a two acre tract , including the plant , excised as
part of the purchase. By effecting the resurvey and designation
of tracts A and B, my clients will be able to purchase a relatively
uniform parcel of land (tract B) and Mr. Reichert will retain a
more clearly defined parcel (tract A) capable of development for
other purposes.

My client ' s intention in seeking to purchase two acres from the
original tract is to initially provide sufficient space for
competent operation of the meat packing facility and perhaps ,
if permission is granted by the County pursuant to a subsequent
application , to establish a residence on the premises .
My client , Darrell Leggett, has been in the meat packing business
in the metropolitan Denver area for a period of 18 years and has
been actively seeking to purchase his own meat packing operation
for approximately the last three years . His immediately planning
contemplates operation of the plant as a "custom kill" packing
facility rather than a Federally inspected plant. As such, Mr.
Leggett plans to render services in behalf of people in and about
the community of LaSalle by slaughtering and dressing beef, lamb
and pork and providing service for dressing of game animals dur-
ing hunting season.
Mr. and Mrs . Leggett have met, at length, with the planning com-
mission of the town of LaSalle and have indicated their willing-
ness to work with the planning commission and town board in op-
erating the plant , if the recorded exemption is granted. The
basic understandings reached between the town of LaSalle and
Mr. and Mrs . Leggett are outlined in my letter of July 26 , 1977 ,
addressed to Ms. Lisa Warnecke , Town Administrator, a copy of
which has been furnished to the County Planning Department . Mr.
and Mrs. Leggett seek a continuing, mutually beneficial relation-
ship with the county and the town of LaSalle and believe they can
offer a valuable service to the community by operation of the
packing plant. Mr. Reichert , Mr. $ Mrs . Leggett also believe that
granting of the record exemption would considerably simplify the
chain of title to the tract involved and maximize the usability
of the land in terms of future planning by both the county and
the town of LaSalle.

posed transaction, we would be happy to provide same upon request.

To whom it may concern:
At their meeting of August 23 , 1977 , the La Salle Town Board decided
to recommend approval of the requested Exemption to divide Mr. Melvin
Reichert ' s property into the two duly described tracts . As requested,
the Board also agreed to proyide sewer service for proposed Tract "A"
when and if the need arises .
At present one of the Town' s main sewer lines runs through proposed
Tract "A" . The Board requests the plat recognizes easement for the
length of this line with a minimum width of ten feet.
The Board wishes to favorably recognize the July 21 , 1977 , meeting
and agreements made between Darrell and Glenda Leggett , their attorney
John W. Lichty and the La Salle Planning Commission. It is the Board' s
wish to include with their approval of the Exemption a copy of Mr .
Lichty' s letter of July 26 , 1977 , which describes the agreements made
at said meeting.
Both the La Salle Town Board and Planning Commission look forward to
working with Darrell and Glenda Leggett for their and the town' s
benefit . We hope the above recommendation , easement request , and list
of agreements provide a solid basis for a good relationship between
Mr. and Mrs . Leggett and the Town of La Salle.

RE: DARRELL and GLENDA LEGGETT, VALLEY PACKING COMPANY
Dear Ms. Warnecke:
This will confirm the basic understandings reached during
our meeting with the town Planning Commission on Thursday
evening, July 21, 1977. During the meeting, the commission
inquired of Mr. Leggett regarding several concerns it had
with respect to proposed reopening and operation of the
plant by Mr. Leggett.
The areas of concern were:
1. Whether it would be possible to install a de-
vise capable of trapping most of the blood drained
from animals during slaughter to keep it out of the
city' s sewer system.
2 . Whether Mr. Leggett would be willing to have the
property annexed to the city at such future time as
the city may move for annexation.
3. Whether, if the county' s regulations with respect
to mobile homes are modified and Mr. Leggett is granted
permission to live on the premises in a mobile home, he
intends that that mobile home become a permanent struc-
ture.
Following extended discussion, my client agreed to install an
appropriate blood tank within 18 months of opening the plant.
Said 18 month period to include any period during which the prop-
erty is leased by Mr. Leggett from its present owner prior to
conclusion of the actual sale. Additionally, it was agreed that
in the event Mr. Leggett is granted permission to move a mobile
home onto the property, that mobile home will not become a perm-

anent fixture and will be removed, at the latest, five years
from the date it is moved onto the property. In the event
Mr. Leggett sells the property or defaults under the terms of
the obligations with respect to its purchase, thereby suffer-
ing foreclosure, the mobile home will not be conveyed with the
property and will be removed by Mr. and Mrs. Leggett upon the
happening of either of these events .
Finally, Mr. Leggett agreed to execute a letter, upon his pur-
chase of the property, agreeing to concur in annexation of the
tract which he has purchased in the event the town annexes the
land now- adjacent to the existing northeast town limit. Mr.
Leggett ' s only concern with respect to annexation was the cual-
ity of water presently available from the city, in that the
boiler and pressure washing devices in the plant require softened
water for proper operation. We understand that one of the town ' s
major goals is improvement of the quality of water service and
that it is contemplated that, by the time annexation is commenced ,
water quality would be sufficient for the plant' s operation .
The Commission indicated, at the close of the meeting, that it
could take no formal action at this point to approve or disapprove
operation of the plant. The Commission did indicate that it had
no objection to reopening of the plant but reserved the right to
further review this matter at a later date when certain documen-
tation required by the county is submitted to the city for comment.
Subsequent to our meeting, I again spoke with Mr. Tom Honn of the
Weld County Planning Office, advised him of the discussions held
with the town and determined that the matters remaining for action
are the application for exemption from the county' s subdivision
regulations, the adoption by the county of a modified mobile home
ordinance and Mr. Leggett' s, application for a use permit under
that new ordinance. Mr. Honn is sending the necessary application
with respect to the subdivision regulations which we will file
with the county immediately upon receipt. We understand that the
county will transmit copies of the application and certain other
documents to the town for comment prior to taking action on the
application itself.
Mr. Leggett has asked me to express his appreciation for your
courtesy and interest in this matter. We sincerely hope that the
transaction for purchase of the plant by Mr. Leggett can be suc-
cessfully concluded and that he will soon be able to offer his
