Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: This project will be used for storage and staging for oil and gas roustabout. This project is north of and adjacent to CR22 and is west of CR31. Parcel number 130909000014. Access is from CR22. Roads CR22 is a paved County maintained arterial roadway, which will require 140ft of future right of way at full build out. Traffic counts on CR22 just west of the site were 2874 in October 2013. Traffic The traffic information provided with the submittal states that there will be 9 employees using the site. 5 pickups, 4 trailers, 1 semi truck and 7 dump trucks. Employees arrive to the site about 8am and pick up the commercial vehicles the return to the site between 5 and 6pm and take their personal vehicles home. Access: A gate must be set back a minimum of 75 feet from future right-of-way to allow a truck or RV and trailer to pull completely off of the roadway and open the gate after the future road widening. An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division. Tracking control is required to prevent tracking from the site onto the County Roadway. Tracking Control Device plus 300ft of recycled Asphalt/road base is required for sites with between 4 and 10 truck round trip per day. General Site Plan Requirements i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes) Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: A drainage narrative was submitted with water quality feature design and was found acceptable by Weld County. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-3575. CONDITIONS OF APPROVAL: The map shall be amended to delineate the following: A. County Road 22 is a Paved road and is designated on the Weld County Road Classification Plan as a Arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall verify and delineate on the plat the future and existing right-of-way and the documents creating the existing right-of-way. If the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. B. Show the approved access(es) on the plat and label with the approved access permit number(will be provided). C. Show and label standard tracking control onto publically maintained roadways on the map. D. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA. E. Show and label the drainage flow arrows, turning radii (60ft), and parking and circulation on the map. F. Show any proposed gate back a minimum of 75ft from the right of way. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. DEVELOPMENT STANDARDS(NOTES ON THE PLAT) I. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. 'oats $186" � MEMORANDUM �.;�— a rI�� �� TO: CHRIS GATHMAN, PLANNING SERVICES i�J N Tr FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH aO-1jT SUBJECT: USR15-0003 DATE: FEBRUARY 11, 2015 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (storage and staging of trucks and equipment for a roustabout and excavating business along with minor vehicle maintenance), provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. There will be up to 9 employees accessing the site. The application states there will be no full time employees. The existing residence will be used for storage however the application also states that security personnel may live there which would require the well to be repermitted to commercial. The application indicates bottled water and the existing septic system will be provided for employees. The property is currently served by a shared domestic well that may require repermitting to commercial and the existing septic system will have to be reviewed by an engineer to determine if it is adequately sized for the business. The waste handling plan indicates a portable restroom will be provided for drivers, which is acceptable. A dust abatement plan was not submitted. An abatement plan is required for onsite dust which includes drives and parking areas. Also include how dust will be controlled on the stored dirt pile. The waste handling plan indicates that employee waste will be collected by Best Cleaner Disposal. There is minor maintenance of vehicles that will occur on site, however the waste handling plan states no fluids will be generated and major maintenance will occur at 15724 CR 18, which is not permitted for vehicle maintenance. The waste handling plan will need to be revised to include disposal of all items related to maintenance including; fluids, tires, batteries and other scrap parts generated from vehicle maintenance that cannot be disposed of in a dumpster. According to the application, there will be no washing of vehicles. If there will be floor drains in the maintenance shop the drains must discharge to a watertight vault, and contents removed for proper off-site disposal. If there will be fuel storage onsite that shall be indicated in the waste handling plan and secondary containment is required. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include disposal/recycling of tires, batteries and other scrap parts generated from vehicle maintenance and disposal/recycling of all waste fluids such as oil and antifreeze. Include the names, telephone numbers and addresses of the waste handlers and disposal/recycling facilities. 2. In the event the applicant intends to utilize the existing septic system at the home, for business use, the septic system shall be reviewed by a Colorado registered professional engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. Alternately, a new septic system may be installed for business use. 3. The applicant shall submit a Dust Abatement Plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. 4. In the event the applicant intends to utilize the existing domestic well at the home, for business use, the applicant shall submit written evidence of a commercial well to the Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Sewage disposal shall be by septic system when the number of full time on site employees exceeds 2. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when the number of full time on site employees exceeds 2. 9. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 3 11. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 12. Water Division 1, Water District 2 Dear Mr. Gathman, The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any City regulations or requirements. The applicant is requesting a Site Specific Development Plan and Use by Special Review Permit to allow storage and staging of trucks and equipment for a roustabout and excavating business, along with minor vehicle maintenance, to take place on their property. The property is 3.2 acres and is described as Lot A of RE-1155. The property has an existing residence and water well, operating under well permit no. 177217. Application materials indicate that approximately 9 employees will be on-site to pick up vehicles daily and conduct occasional vehicle maintenance; there will be no permanent on-site employees. The proposed water supply for the business is bottled water and a portable toilet. Permit no. 177217 was issued pursuant to C.R.S. 37-92-602(3)(b)(I) on April 13, 1994 to use an existing well completed in to the Laramie-Fox Hills aquifer. The use of groundwater from the well is limited to ordinary household purposes inside one single family dwelling, the watering of domestic animals, and the irrigation of not more than 10,000 square feet of home gardens and lawns. Permit no. 177217 does not support the use of water for a commercial business. It appears that the applicant has obtained an alternate water supply for the proposed commercial purposes and will use the well for residential uses only.
