RE: AUTHORIZATION FOR CHAIRMAN OF THE BOARD TO SIGN ANNEXATION
PETITION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the City of Fort Lupton is in the process of
annexing the South one-half of Ninth Street to the City of Fort
Lupton to fulfill part of the agreement between the City of Fort
Lupton and Weld County, Colorado, and
WHEREAS, the City of Fort Lupton has requested that the
Chairman of the Board sign a Petition for Annexation, and
WHEREAS, the Board of County Commissioners deems it advisable
to authorize the Chairman of the Board to sign said Petition.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Chairman of the
Board be, and hereby is, authorized to sign the Petition for
Annexation.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
December, A.D. , 1979.

PETITION FOR ANNEXATION
TO THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO:
We, the undersigned, being the record owners of the real
property of the territory hereinafter proposed to be annexed to
the City of Fort Lupton, Colorado, a municipal Corporation,
located in the County of Weld and State of Colorado, do hereby
respectfully petition that the. following territory be annexed
to and become a part of the City of Fort Lupton, to-wit:
LEGAL DESCRIPTION ATTACHED AS SCHEDULE "A" .
In support of said petition, your petitioners allege that:
1. It is desirable and necessary that the above described
territory be annexed .to the City of Fort Lupton;
2. Not less than one-sixth of the perimeter of the area
proposed to be annexed is contiguous with the City of Fort Lupton;
3. A community of interest exists between the territory .
proposed to be annexed and the City of Fort Lupton;
4. The territory proposed to be annexed is urban or will
be urbanized in the near future;
5. The territory proposed to be annexed is integrated or
is capable of being intergrated with the City of Fort Lupton;
6. No land within the boundary of the territory to be ,
annexed held in identical ownership, whether consisting of one
tract or parcel of real estate or two or more contiguous tracts
or parcels of real estate;
(a) is divided into separate parts or parcels without the
written consent of the landowner or landowners thereof,
unless such tracts or parcels are separated by a dedicated
street, road or other public way;
(b) comprising twenty acres or more and which, together
with the buildings and improvements situated thereon has
an assessed value in excess of two hundred thousand dollars
for ad valorem tax purposes for the year next preceding the
annexation is included within the territory proposed to be
annexed without the written consent of the landowner or
landowners.
7. The signers of this petition comprise 100% of the land
owners of the territory included in the area proposed to be annex-
ed, exclusive of streets and alleys;
B. The mailing address of each signer, the legal description
of the land owned by each signer, and the date of signing of each
signature are all shown on this petition;
9. As a part of this petition is the affidavit of the cir-
culator or circulators of this petition stating that each signature
hereon is the signature of the person whose name it purports to be;
10. Accompanying this petition are five prints of an annexa-
tion map containing the information following:
(a) A written legal description of the boundaries of the
area proposed to be annexed;
(b) a map showing the boundary of the area proposed to be
annexed, said map prepared and containing the seal of a
registered engineer;
(c) within the annexation boundary map there is shown the

location of each ownership tract in unplatted land, and
the boundaries of the platted land and the plat number of
plots or of lots and blocks are shown;
(d) next to the boundary of the area proposed to be annexed
is drawn the contiguous boundary of the City of Fort Lupton,
there being no other municipality abutting the area proposed
to be annexed;
(e) The dimension of the contiguous boundaries are shown
on the map. •
11. That the above described territory is not presently a
part of any incorporated city, city and county, or town.

Township 1 North, Range 66 West of the Sixth Principal Meridian ,
Weld County, Colorado, and being more particularly described as
follows:
Commencing at the Northwest Corner of said Section 5; thence South
890 58' 00" East along the North line of said Section 5 a distance
of 1, 321. 80 feet to the Point of Beginning;
Thence South 89° 58' 00" East along the North line of said Section 5,
a distance of 1, 947. 10 feet to the North Quarter (Na) Corner of said
Section 5;

of said Section 4 and considering the East line of the Northwest

with all other bearings contained herein relative thereto;

Dear Mr. Carlson:
We are in the process of annexing the South one-half of 9th St. to
the City of Fort Lupton to fulfill part of our agreement with you in the
improvement of this street. The enclosed Petition for Annexation
requires your signature and we are requesting that you sign and return
this document at your earliest convenience.
For clarification, we are also annexing along with the south one-half
of 9th street, the site where our water storage tank is located. The
legal description includes both areas as we want to accompolish annexing
both parcels of land with the same ordinance.
