RE: DESIGNATION OF THE SITE SELECTION AND CONSTRUCTION OF THOSE MAJOR
FACILITIES OF A PUBLIC UTILITY CONSISTING OF PIPELINES AND STORAGE
AREAS OF UTILITIES PROVIDING WATER AND NATURAL GAS OR OTHER
PETROLEUM DERIVATIVES AS A MATTER OF STATE INTEREST PURSUANT TO
§24-65.1-401, C.R.S., AND WELD COUNTY CODE §21-1-210(B)
A public hearing was conducted on May 27, 2015, at 10:00 a.m., with the following present:

Commissioner Julie A. Cozad
Commissioner Steve Moreno - EXCUSED

The following business was transacted:
I hereby certify that pursuant to a notice dated December 9, 2014, and duly published
December 12, 2014, in the Greeley Tribune, a public hearing was conducted January 19, 2015,
concerning the Proposed Designation of the Site Selection and Construction of those Major
Facilities of a Public Utility Consisting of Pipelines and Storage Areas of Utilities Providing
Water and Natural Gas or Other Petroleum Derivatives as a Matter of State Interest pursuant to
§24-65.1-401, C.R.S., and Weld County Code §21-1-210(B), at which time they deemed it
advisable to continue the matter to March 23, 2015, and then again to May 27, 2015. On
May 27, 2015, Robert Frick, County Attorney, made this a matter of record.
No public testimony was offered concerning this matter. Mr. Parko stated for future
notification purposes, the description of this item will need to be modified to remove "and
Natural Gas or Other Petroleum Derivatives" because those have been removed from the 1041
process and are no longer applicable to this hearing.
Commissioner Conway moved to continue the Proposed Designation of the Site Selection
and Construction of those Major Facilities of a Public Utility Consisting of Pipelines and Storage
Areas of Utilities Providing Water as a Matter of State Interest pursuant to §24-65.1-401, C.R.S.,
and Weld County Code §21-1-210(B). The motion was seconded by Commissioner Cozad.
Mr. Yatabe provided a brief explanation of the formal process for consideration of this matter
and stated on July 6th, this hearing should be considered prior to consideration of the Code
revision under Ordinance #2015-1. Mr. Parko reiterated that future listings should also remove
the reference to "and Natural Gas or Other Petroleum Derivatives". In response to
Commissioner Cozad, Mr. Yatabe stated this matter will need to be renoticed due to the
description change and several continuances. Based on the previous discussion,

Commissioner Cozad restated the motion for a continuance, specifically to July 6, 2015,
at 9:00 a.m., preceding consideration of Code Ordinance #2015-1. The motion was seconded
by Commissioner Conway. There being no further discussion, the motion carried unanimously
and the hearing was completed at 10:13 a.m.
This Certification was approved on the 1st day of June, 2015.
