Dear Weld County Attorney and County Commissioners:
This letter serves as notice of a claim against Weld County for negligent design,
construction and/or maintenance of a portion of Weld County Road 42 that directly
resulted in substantial injuries to Weld County resident Lesley Schoonmaker on or
about October 18, 2014, as documented in the attached Traffic Report.
Weld County has failed to comply with C.R.S § 24-10-109(3)(b) by not listing its agent in
the inventory of local government entities pursuant to C.R.S. § 24-32-116, and has
therefore waived its rights to notice under the Colorado Government Immunity Act.
Nevertheless, this notice is being served on the Weld County Attorney pursuant to
C.R.S § 24-10-109(3)(a) and to each of the five Weld County Commissioners.

(b) Concise statement of the factual basis of the claim, including the date, time,
place and circumstances of the act, omission or event complained of (pursuant to
C.R.S.§ 24-10-109 (2)(b)) :
On or about October 18, 2014, at 11:44 p.m. (as noted in the attached Traffic Accident
Report completed by the Weld County Sheriffs Office) Ms. Schoonmaker was a
passenger in a vehicle traveling eastbound on Weld County Road 42 in unincorporated
Weld County when the vehicle left the road, struck the shoulder and rolled before
coming to a resting place. The precise latitude and longitude of the accident are
referenced on the attached traffic report.
Weld County is liable for negligently designing, constructing and/or maintaining a
dangerous road with a history of motor vehicle accidents at substantially the same spot
where Ms. Schoonmaker's accident took place. The known dangerous conditions
include, but are not limited to; a posted speed limit too fast for conditions, no lighting
whatsoever and a sharp turn in the road that is not adequately marked with warning
signs or other devices.

(d) A concise statement of the nature and extent of the injury claimed to have
been suffered pursuant to C.R.S. § 24-10-109 (2)(d)):
Ms. Schoonmaker was taken from the scene of the accident to a hospital by ambulance.
She suffered substantial physical injuries, including broken bones, lacerations, internal
injuries, and head trauma. She has not yet completely recovered from the injuries and
likely faces permanent damage.
(e) A statement of the amount of monetary damages that is being requested
pursuant to C.R.S.§ 24-10-109 (2)(e)):
Ms. Schoonmaker is seeking monetary damages in excess of the statutory limit of
$350,000.00, as outlined in C.R.S. § 24-10-114 (1)(a).
