HomeMy WebLinkAbout20150051.tiff RESOLUTION RE: ACCEPT REQUEST OF KAY COLLINS AND RYAN GALLATIN TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0043, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (LANDSCAPE TURF INSTALLATION, TRUCKING AND TRUCK REPAIR SHOP, ALONG WITH OUTSIDE EQUIPMENTNEHICLE STORAGE AND STAGING) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on January 7, 2015, the Board was presented with a letter, dated January 5, 2015, from Kay Collins and Ryan Gallatin, 13900 CR 76, Eaton, CO 80615, requesting the withdrawal of the above described application proposed on the following real estate, to-wit: Lots A and B of Recorded Exemption, RE-2366; being part of the NW1/4 of Section 32, Township 7 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, deemed it advisable to continue the matter to January 28, 2015, to allow the applicant more time to work with staff concerning an alternate location, and WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of January, 2015, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing the request of Kay Collins and Ryan Gallatin to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR14-0043, for any Use permitted as a Use By Right, Accessory Use, or Use By Special Review, in the Commercial or Industrial Zone Districts (landscape turf installation, trucking and truck repair shop, along with outside equipment/vehicle storage and staging) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, on the real estate described above. The Board heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, deemed it advisable to accept the request to withdraw said application. 2015-0051 cC. ILL/K 0Qtt 2//O PL2301 ACCEPT WITHDRAW REQUEST - KAY COLLINS AND RYAN GALLATIN (USR14-0043) PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Kay Collins and Ryan Gallatin to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR14-0043, on the parcel of land described above be, and hereby is, accepted. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of January, A.D., 2015.
