RESOLUTION WHEREAS, it has been determined by the Board of County Com- missioners, Weld County, Colorado, that a certain tract of land, being the property of Jack Jewett and Glenda Jewett, husband and wife, Eaton, Colorado, and more particularly described as follows, to-wit: A tract of land located in the Southeast Quarter (SEf) of Section 1, Township 6 North, Range 65 West of the Sixth Principal Meridian, Weld County, Colorado, being more particularly described as follows: Beginning at the South Quarter Corner (S-', Cor) of said Section 1 and considering the West line of the Southeast Quarter (SEa) of said Section 1, to bear North 00°01 '02" West, with all bearing contained herein being relative thereto; Thence North 00°01 '02" West, along the West Line of the Southeast Quarter (SE ) of said Section 1, a distance of 2669. 49 feet to the Center of said Section 1; Thence South 88°10'24" East, along the North Line of the Southeast Quarter (SE+++) of said Section 1, a distance of 398. 95 feet; Thence South 37°12'25" East, 859. 73 feet; Thence South 02°10'53" West, 1132. 58 feet; Thence along the East Bank of No. 2 Canal by the following two (2) bearings and distances: South 17°02'16" East, 445. 13 feet; South 30°19'54" East, 509. 92 feet to a point on the South Line of said Section 1; Thence North 88°50'46" West, 1262. 91 feet to the Point of Beginning. Said tract of land contains 53. 982 acres, more or less, does not come within the purview of the definition of the terms "subdivision" and "subdivided lands" as set forth in CRS 30-28-101 - (10) (a) and (b) 1973, as amended, and WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, desires to exempt this particular division of land upon the recommendation of the Weld County Zoning Administrator for the reasons as stated and pursuant to its authority under CRS 30-28-101 - (10) (d), 1973, as amended. NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de- scribed tract of land owned by Jack Jewett and Glenda Jewett, Eaton, Colorado, be exempt from the definition of the terms "subdivision" and "subdivided lands" as provided for in the new Weld County Subdivision Regulations at Section 2-1A. , (3), adopted August 30, 1972, as amended. Said parcel is located 12 miles west and 1 mile south of Galeton on the north side of County Road 72. The subject parcel contains 53.982 acres, the majority of which is pasture land. The request is to split the property into parcels of 49.475 acres and 4.507 acres. Each resulting parcel would contain one set of improvements. Based upon the information submitted, the Planning Commission staff recommends approval for the following reasons: 1 . The proposed split conforms with the intent clause (Section 9-2 of the Weld County Subdivision Regulations), the intent clause for the Agricultural District (Sec- tion 3.3(A) of the Weld County Zoning Resolution), and the Weld County Comprehensive Plan in that each resulting parcel would have a existing set of improvements. Pau Director Environmental Health Services by MEMORANDUM To: Board of County Commissioners From: Weld County Planning Staff Date: September 11 , 1974 Subject: Recorded Exemption 0803-1-4-RE138 (Jewett, Jack) This application was subscribed to on January 28, 1974. A minimum lot size was not a requirement of Recorded Exemption procedures until April 17, 1974. Therefore, it is not necessary that this parcel (53.982 acres) meet minimum size requirements in order to apply for a recorded exemption. The proposed lots are not part of a recorded exemption or of a subdi- vision approved within less than five (5) years previous. The lots resulting from the proposed land division are accessible from an existing public road (County Road 72) with a minimum frontage in conformance with the Weld County Zoning Resolution (minimum 180 feet). The application indicates a water source from existing wells. The Weld County Health Department, in a letter dated July 10, 1974, indicates the water is bacteriologically safe. The application indicates that sewage disposal is to be provided through septic tanks. The Weld County Health Department, in a letter dated May 29, 1974, has stated the soil test for this recorded exemption has been approved. Both lots are over one acre in size. Lot A is 4.507 acres, and Lot B is 49.475 acres. The Weld County Assessors' Office has the parcel in question containing roughly 10 acres of irrigated land and 40 acres of pasture land (see sketch following next paragraph. The portion of land directly South of Greeley #2 Ditch in Lot B lies below the ditch level and appears to have a high water table. 2. The pasture land lying above Greeley #2 Ditch appears to be subject to possible flooding from a 100-year storm from the natural drainage channel which bisects Lot B. 3. The irrigated portion of Lot B appears to be the high ground. 4. There are no commercial sand and gravel deposits indicated in this area according to information made available by the Colorado Geological Survey. 5. This is not a "critical " wildlife area according to available information from local game and fish personnel . 6. The Soil Association for this area is #172, Renohill - Shingle. The Renohill component poses moderate shrink-swell limitations for buildings; the shingle component poses low shrink-swell limitations for building structures. 7. The only existing water source noted is located on Lot A. Actions 1 . The only major objection to this recorded exemption is the observation concerning possible flood hazards. Therefore, Glenda Jewett was contacted on September 11 , 1974 and informed that a favorable recommendation from the Weld County Planning staff would be subject to a favorable reply from a qualified engineer indicating one of the following conditions exist. (1 ) Lot B contains not less than forty-thousand (40,000) square feet of land which is at an elevation above the one hundred (100) year recurrence interval flood, or; (2) Lot B contains not less than forty-thousand (40,000) square feet of land which is at an elevation five (5) feet above the elevation of the maximum flood of record. This action is in compliance with Section 8-11-D(5) of the Weld County Subdivision Regulations concerning floodlands, and Section 9-4-A(9) concerning staff review procedures for recorded exemptions. 2. Mrs. Jewett was also informed (11 September 1974) that a copy of a well permit for Lot B, approved by the State Engineer, should be made available to this office. This action is in compliance with Section 9-4-A(4) of the Weld County Sub- division Regulations concerning staff review procedures for recorded exemptions. I have reviewed the subject recorded exemption with regard to possible flood hazards. Using the equations developed by Jerrard F. McCain and Robert D. Jarrett of the U.S. Geological Survey and the USGS Quadrangle maps of the area, I obtained a Q100 of 7400 cfs and a Dl00 = 9.4 feet. (A copy of the calculations is enclosed) While the values do appear excessive in light of other regional data the 9.4 foot depth would permit Lot B of the recorded exemption to contain 40,000 square feet above the one hundred (100) year reocurrance interval .
