This proposed use, especially due to its outside storage component will have a negative impact on the valuation of all surrounding property owners. There is likely no affordable means that would allow this developer to provide for enough screening to make that kind of "eye sore" go away and mitigate this inappropriate use at this location. This site sits low compared to the road ways and many other properties. I had a conversation with officials of the City of Evans, and those 1 spoke with are not in support of this type of use. Unfortunately for them, and other property owners within this neighborhood who own adjacent properties that do come under the City of Evans' planning provisions, the City of Evans has no control over this property and the decision for what EXHIBIT happens on this land rests solely with your department. I hope that your decision takes into account the lasting effect allowing this use will have on all of those others who own property within sight of this out-of-place use. Those impacts will also affect future tax revenues generated from all other surrounding properties including property taxes and sales taxes as well as the timing of when the County and City of Evans starts to receive its shares of revenues from those higher and better uses. Given the current economic conditions in Northern Colorado this intersection is finally coming of age after many years of stagnation. This type of proposed use could have a lasting effect on the timing of other higher and better use developments at this intersection. I have also heard there will be a section for RV storage and an RV dump station on the property adjacent to the lake. It is hard to imagine turning such a prime location into a facility that belongs in an industrial park. With the growth of Greeley and Evans it would seem a more appropriate use for this vacant land would be for apartments/townhomes, professional offices, subdivided single home acreage lots, even retail would not be such a blow to the property values in the neighborhoods. Since all four corners of the intersection of 47th Avenue and 37th Street are vacant lots or farm land, allowing this eye sore to build will bring more industrial development in a nice residential neighborhood . Everywhere in close proximity are nice upper middle class homes. We now have a beautiful new school up the road again surrounded by beautiful residential subdivision. Our children would fish at the lake and we would let them walk down to the lake by themselves. With the idea of a commercial storage facility at the lake this risks the safety of the children. I am not against self storage units as I am a partner in one going up in Loveland . We are getting approval through the City of Loveland so I am very much aware of what all the project entails. I am opposed to this project for several reasons listed below: 1. Why doesn't the Engelman's look into a Industrial site not residential . This is not a good fit for this Subdivision . It is on lake front property. The elevation doesn't make sense either, he will need to bring in a lot of dirt to raise this up and what an eye sore from 37th St. 2. We just recently had a school open up just west of the subdivision . The traffic in the morning and afternoon is horrible due to the school . Now we are expected to be happy about additional traffic. Has this been looked into? He says he will access through 37th and then Arrowhead Dr. There are 160 houses here with the school traffic and business traffic how long will it take us to leave this subdivision . 3. Has he looked into what will happen to the wildlife in the cattail area just west of this project? Has the Army Core of Engineers been contacted and the necessary forms submitted for this problem ? 4. Has the Weld Co. roads been contacted to see what impact this road traffic will have on Arrowhead Dr. This two lane is hard enough to navigate during peak hours and now he wants to add additional wear and tear on this road . Please have all these questions check out before you give approval. Thank you for your time. Judith Sahrle EXHIBIT October 2, 2015 Weld County Department of Planning Services and Weld County Commissioners Ladies and Gentlemen: As a Homeowner in the Lake Arrowhead subdivision, we have major concerns regarding the Arrowhead Storage, Planning Number USR15-0039. How dare they consider themselves Arrowhead Storage. We do not want them; they will not grace our area with its presence. Not only will our property values decrease, but our peaceful enjoyment will be disrupted. This project will bring an unattractive appearance to our subdivision . The Planning Department and the Commissioners need to view this area now to see for themselves how unsightly this project is before making a decision. If the Planning Department and/or Commissioners amend the current zoning, only one person will benefit or improve its position . As new development has continued to grow, especially 37th Street, the need for a traffic light was needed. Now there is a school which is directly west of the subdivision. This has created more traffic, speeding, and it is becoming harder and harder to use other exists within the subdivision. There have been several accidents at the light on 47th Avenue and 37th Street. We believe the accidents will increase due to the higher volume of traffic When we first considered building is this area it was peaceful , quiet, no lights; and not uncommon to see deer in the area . This would be the perfect place to build our new home. All of this has disappeared to the constant growth in the area. The wildlife has virtually disappeared due to the increase of population in the area . We now hear the traffic on 37th Street and the Bypass. The last two years there has been a golden eagle who would sit in the tree (in the very area of the proposed storage area) near the lake looking for any injured goose which would be on the lake. Several times during the winter months, the bald eagle would feed on the geese which were on the ice. Is this to be an encroachment by man so the bald eagle will not visit? What happened to the disturbance of an endangered species? There are also two swans which have lived several years on the lake, and come back every year. This year two more swans appeared on the lake, but have now disappeared. Are our yearly swans also going to disappear? Geese land on the lake, will this disappear? There is a tremendous amount of disruption to the wildlife. No wonder people are having trouble with bears and other animals in their yards due to man's encroachment upon the animals' environment. Growth and bringing more commercialism to the area is not the answer. We have had several blackouts in the last four to five years than ever before. The County and the Cities cannot fill its obligation to the people to supply enough energy to those who have lived here several years. Tremendous flooding, guess why? Continued growth has taken away the soil and trees and replaced it with pavement and asphalt. Where is the water to go? The water cannot be absorbed into the land. Too hot? Same issue, no EXHIBIT 3 2 vegetation and no trees. When is Weld County going to learn, especially Greeley and surrounding areas, we are a bedroom community! Please drive to work to other towns, and also shop other places. If the storage area is approved, there can only be trouble for the owner and the homeowners. The storage area would need to be fully fenced, but what will keep people from climbing the fence to get to the lake. Lake Arrowhead is a private lake. No outsiders are allowed on the lake. Only water users within the subdivision have access. What about trash blowing into the lake? Since living in Arrowhead for more than 20 years, we have seen an increase of trash throughout the subdivision. These are people who have no respect the area, and it will only get worse if the storage is approved. What about the storage facility's snow removal? Will it be pushed into the lake? Will it be pushed on the roadway? What about the traffic entering and exiting the storage area, since more and more people are traveling 37th Street? Are we going to have trouble entering from either direction to enter the subdivision? Are we going to have more people encroaching upon our properties? Who and how often will the area be patrolled? We have people who ride horses, ride bikes, and walk their animals throughout the subdivision. What safety standards are in place to prevent renters of the storage area from entering the subdivision? What about the lights which will be in place for the storage area? If we lived across the lake, this would be a disruption to our peaceful enjoyment. This rezoning would cause a major disruption to the Lake Arrowhead subdivision, and the rezoning should be considered a mute request by the storage owner. Zoning this property as commercial, will be SPOT-ZONING and we are against it. r Currently, there are 3 RV storage areas and in Greeley, one of them less than Y2 mile on 47th Ave. There are also over 19 self storage companies in Greeley and Evans. There is no need to start an RV storage and self storage units in one of the nicest neighborhoods in Greeley. We oppose that. P The traffic on 37th St has already increased with the new Prairie Heights middle school . With an RV storage facility and self storage units, the traffic will not only increase even more, but also, slow moving vehicles/motor homes, will create chaos around the area. We are against that. r There will be vehicles /RV's parked in the area near the lake, that will be leaking fluids, creating an environmental problem on our beautiful lake. We oppose to that. r This is a very pleasant, beautiful neighborhood, with an impressive entrance with a beautiful view of the lake. There are not many lakes in the area, and to clutter the view with multiple commercial buildings and RV's all over, would be a shame. An RV storage and self storage units, will ruin the entrance of our neighborhood. With all the walls, storage units and RV's, there will be 10 acres of nothing but noise, pollution and cheap construction. We oppose that. Thank you . Good afternoon . Our home at 5020 Pawnee Dr has been in our family since 1998 . When George Sory purchased this land he wanted to buy a property that could be enjoyed by him, his grandchildren , and any future great grandchildren to come. It is a lovely area. We see bunnies, foxes, pheasants, turkeys, hawks, Bald Eagles, Golden Eagles deer, coyotes, snakes, squirrels, and all types of song birds. Going outside means hearing and seeing this wildlife and being able to enjoy it just as George had expected . We have concerns with the proposed Arrowhead Storage facility. This project is far more suited to an industrial area, where noises of the vehicles, the opening and closing of gates, the lights shining in the night, the loud roar of delivery vehicles, and the general disturbance noises a storage facility brings will not disrupt residential neighbors, wild life, and also retail/office type businesses that may be built on the adjacent corners. We know that something will eventually be developed there. The problem with the Arrowhead Storage proposal is that it is not a good fit for the neighborhood . Good neighborhoods are filled with good neighbors. Years ago, when we were restaurant owners, we strived to be a positive aspect to our neighbors and the city. We allowed access when the shop next door requested it. We helped fence and block the alley when the city asked us to. When 8th Ave was being re paved , we agreed to increase our lawn in front to add some landscaping to a rather barren area. We partnered with community organizations such as the Weld County Library system , the Weld 4-H , the Greeley Swim Club, many District 6 schools, and others to give support for their programs. All of this is part of being good neighbors. From the outset,Arrowhead is not a good neighbor. The very density of the project is distressing . The possibility of "dirty" water making it to the lake is worrisome. The noise will effectively scare aware the wild life while disrupting their habitat. A project that is so large leaves little room for anything but the owners want--a money making set of buildings, without concern for what it will do to all those (human and other) in the surrounding neighborhoods. If the developers gave any thought regarding what this project will do to residential property values as well as the values of the adjacent commercially zoned properties, they would understand that a storage facility is not the best use with the best comparability for this land . Please, before any decisions are made, come out, see the area . Come in the early morning , or the evening to hear the peaceful hum of a rural neighborhood . But also EXH1B1T come at 8 am and 4pm, when the work commuters and school buses are backed up at the light. Imagine what this will be like with moving vans, delivery trucks and many more regular passenger vehicles are added to the mix. We can envision something being built on the property that would be a win for everyone. An office building with lovely landscaping (think of the National Chiropractors building at 10th St and 59th Ave); a business that not only can be a good neighbor to us, but that we can be good neighbors back by supporting the business and keeping an eye on the property during off hours. Putting something like this on the property will set a precedent for the further development that is sure to come on the other corners. We are counting on the County and Planners to be our guardians to secure "good neighbors" for this property. We asking that you do not approve this proposal , and do encourage the owners to put something that will be a compatible and pretty addition to the area . It always has been a pastoral place for families, horses and other pets in a semi-rural environment. It is a spacious neighborhood where people care for each other and keep a protective eye out for each other's welfare. You can count on a friendly wave from neighbors out for a walk with their dogs or horseback ride. The primary entrance to this long-time neighborhood features a scenic drive past Lake Arrowhead where ducks and geese congregate and an occasional fish jumps. While the lake is an important source of water to keep the lawns and gardens green and lush , the lake is also an amenity to the neighborhood and the county. A proposed RV storage facility located at the entrance to this bucolic neighborhood is not only inappropriate and incongruent with the feel and character, but would significantly devalue the property values of Lake Arrowhead . We are adamantly opposed to such a proposed use and urge you to deny Application USR 15-0039, a for an RV and self-storage facility. Our family home is not only an important financial asset, but is a historic piece of a neighborhood with unique character that attracts families who value scenery, space and country living . I am opposed to USR 15-0039. The property under review is a uniquely bound lakefront property surrounded on the north and east by the City of Evans, Weld county and residential agriculture on the south and west. The Weld County comprehensive plan determines land use in Chapter 22 of the county code. Section 22- 1 - 120 states in part A: Private property rights are not unlimited rights but, rather, rights balanced with the responsibility of protecting community health, safety and welfare. This USR does not reflect any of these guidelines, in fact contradicts them. The USR notes section 22-2-20 G. A. Goal 7 : County land use regulations should protect the individual property owner' s right to request a land use change. However, the entire content of goal 7 is not included in the USR and states 1 . A. Policy 7. 1 . County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. This is not related to agriculture by any stretch of the imagination and the impact to surrounding will be negative as this is an industrial project and eyesore visually The USR includes A.Policy 7.2. Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such EXHIBIT 11-{ development, and should attempt to be compatible with the region. There is no evidence to support this goal, the site is situated at a busy intersection potentially inviting safety hazards and the risk for environmental catastrophe is tenfold as the location is on a lakefront and near protected wetlands. The USR continues noting Sec. 22-2-90. Commercial development, however, no supportive information is included therein. The Weld code states A. The purpose of commercial development Goals is to characterize, by intensity, those areas throughout the County for retail, offices, services and other similar uses. Commercial uses are primarily located along major roadways, at major intersections and in commercial parks designed to accommodate these uses. When of an appropriate scale that accounts for pedestrians and public space, limited commercial activity is also appropriate within neighborhoods. This project does not reflect any goals of the commercial development policy. This industrial project should be located within an industrial park as is required in surrounding cities. The surrounding properties are ag residential and vacant land that is not zoned for industrial use. Section 23 -2-260 series of statements in the USR are inconsistent with the comprehensive plan and do not meet goals as expressed in Chapter 22 of the County code. The property is bound on the north by the Evans city limits and Weld County ;, consists of AG residential on the south, and such a close proximity should reflect some commonality in development. This USR makes no effort to promote Weld County' s guiding principles. There is also no mention of environmental impact that is sure to surface. Everything from light pollution, water pollution, noise pollution, traffic pollution and building pollution due to almost 3 acres of metal buildings and the remaining six to seven acres of property to be paved with asphalt, not to mention "stabilizing" the lakefront. These issues have not been addressed by this USR. Other non- addressed items include flood plain requirements, lake frontage, Army Corps of Engineers permit, waterfowl and wildlife migratiin, current traffic study, as a new school recently opened adding numerous vehicles, unaccounted in this USR traffic narrative. As this is an industrial related project, as defined in Evans city code and the boundaries are across the street from this property, the probability of other compatible use is highly unlikely. Future development will likely be residential and light commercial , Tuscany I, II, and III are plotted and this USR project will have significant negative impact on future development of these properties. There is no provision to address the health, welfare and safety of the surrounding neighborhood. The erection of walls, security lighting and security gates only leads one to believe this facility will attract criminal activity and behavior. These issues do not exist in Arrowhead sub- division at this time. We have an extremely low crime rate. Storage of questionable items, vehicle and customer access 24/7, inconsistent supervision by personnel (6 out of 24 hours) and increased traffic can only bring trouble. There now exists within 500 yards, 3 RV storage facilities located in unincorporated Weld County existing many years before annexation another similar business is unnecessary. Saturation of this type of enterprise in an area zoned as it is seems to be needless. Colorado law provides that the mineral owner has the right of reasonable access to and use of the surface estate to extract minerals and that the mineral estate owner and the surface estate owner are to give due regard to the rights of the other and reasonably accommodate each other's rights. The mineral interests of the Anadarko entities have significant value and consequently they are concerned that the approval by the County of a final application for development and the subsequent build-out of the Property will impair the ability of the Anadarko entities to develop their mineral and oil and gas interests. 4. The Anadarko Entities Have No Agreements with the Applicant that would Protect their Valuable Assets and provide for the Joint Use of the Property for Potentially Conflicting Surface Uses. Although the current Colorado Oil and Gas Conservation Commission rules and regulations provide for the location of wells in a quarter section where the Property is located- generally in the center of each quarter quarter section, or one oil and gas operations area within each forty acres — the Anadarko entities and surface owners/developers/applicants typically try and negotiate locations that may be outside these established drilling windows. This is done to provide for the best use of the surface by the Applicant as well as allow for proper development of the minerals and oil and gas. However, at this time, no agreement concerning alternative locations has been finalized. The Anadarko entities or their lessees have rights to drill wells and locate associated drilling and production equipment on the Property and to conduct future operations on the Property that could include, drilling, re-drilling, deepening, recompleting, fracturing and re- fracturing wells and the maintenance and servicing of wells and equipment. Drilling and subsequent well operations could take place on a continuous basis over several days with the use of heavy equipment that may require the coordination of the use of portions of the Property at given times. Any future surface development plans approved by the County should provide protection for future wells, pipelines, gathering lines and related oil and gas facilities and equipment. Approval of any surface development plan that forecloses the rights of the owners of the mineral estate may be a compensable taking. 5. The Anadarko Entities Object to the Application in the Absence of Agreements. The Anadarko entities and their affiliated company, Kerr-McGee Oil & Gas Onshore LP, have extensive mineral and oil and gas interests throughout the State of Colorado and have successfully worked with many parties who wish to develop the surface estate in order to assure the compatible development of the surface estate and the oil and gas estate and that provides for the disposition of the hard rock minerals owned by Anadarko Land. The practice of the Anadarko entities is to meet with surface owners to reach mutually acceptable agreements. In this case, representatives for the Anadarko entities have not initiated discussions with the Applicant. Because no final agreements have been reached, and in order to protect their mineral interests and private property rights, the Anadarko entities object to the approval of a final application for development for the Property and request that the County make any approval of the applications conditioned upon agreements with the Anadarko entities. If this is an appropriate use , why is such a permit needed? This is an appropriate use for an industrial park, which this is not. 1.We are concerned with possible water pollution and runoff of chemicals and RV waste. It is not possible to constantly monitor what people are dumping and spilling. Will the detention ponds adequately deal with this?The lake water is utilized for irrigation by residents and feeds several small tributaries on its way to the Platte. It also supports the various wildlife that live in the area. Sadly the property has already been cleared, destroying wildlife habitat. Was there a study done by the appropriate environmental impact authorities? 2.There has been an incredible increase in traffic at the 47th Ave and 37th St intersection and there are no turn arrows.Adding RVs and people with trucks and trailers coming and going will only serve to cause more traffic issues. In the summer the weekends would be a nightmare! (The traffic narrative used information gathered in 2014. There has been an increase since then, due to Prairie Heights school being opened. ) Then there is the increase of traffic in the neighborhood.This is a rural oriented, quiet, peaceful, safe area . People live out here to get away from noise and traffic and enjoy the safety of the neighborhood. Residents enjoy walking, riding bikes and/or fishing from the lake.Increased traffic brings increased crime and trash. People who have to rent a place to store their things won't have an interest in the integrity of our neighborhood! 3.Then we have the aesthetic issue. Looking North from the neighborhood on the lake the view will be metal buildings and RVs. No amount of fencing or landscaping will hide this. It will be an eyesore. Have you ever driven by open RV storage that was pleasing to the eye? What a disservice to residents to mar a key perk of living here. The surrounding land is being used for Ag , is awaiting development or is conservation protected. This project will negatively affect the future of the properties that will be developed. Which in turn could hinder future revenue for the county and cities involved. There are already at least 2 large RV storage facilities about .5 miles away and numerous storage facilities within 1 or 2 miles. 4. It seems feasible that with 24 hour , 7 day a week accessibility this facility could easily be used for undetected criminal activity. This usage does not fit in with the surrounding properties ,will negatively affect property values and the quality of life here in Arrowhead. Many of the people out here who oppose this project feel as though the commissioners will always vote in favor of big business and residents voices will not matter. In regards to safety. (Biggest on my list with two young kids) A. What type of security systems will be in place? Many self storage units are equipt with very high tech camera and sensor systems but for the RV and Boat storage there are not many options (from what I can gather.) Will this bring more crime to our relatively "low lying" and quite subdivision? -with possible increased interest from criminals interesting in "borrowing" boats and RVs, this will inevitably increase all residents in venerability to our boats/RVs/residences to be "cased" by curious criminals. Essentially putting our property that's not under lock and key an easy target and on their radar. B. With an increase in drug activity, storage lockers are a hot commodity. Our remote location seems to be a prime location for this type of activity to take place. -we are far from a police station -low patrolling -not many cross streets and low traffic during the day and night, with exceptions during morning commute and evening commute *specific concern- meth labs just down the road (less than a mile) from our homes and more importantly the new middle school. *could those chemicals be dumped into our lake water that we water our grass that feeds our animals? -I imagine this kind of activity will eventually increase homeowners premiums for homeowners insurance as well as other things. C. Stolen goods are often stored in store facilities. -will this increase our crime rating in the city of Greeley leading to decreased property values? 2. Vandalism A. Tagging being a popular gang trend on large buildings on busy streets. -decreasing the value of our homes -eye sore for entire community -increased criminal activity in a relatively low criminally active area. 3. Traffic A. Access to facility off of 37th Ave. will cause traffic jams due to it only being a two lane road. Congestion during the high traffic times could cause numerous accidents. B. Access to facilities from Arrowhead drive seems unreasonable since the residents of arrowhead have to maintain that road and turning radius for LARGE RVs or boats will exceed turning radius needed. -what will the storage faculty do to resolve this situation? C. Increased traffic on lake and bridge. -who will be paying to maintain this growing increase -more traffic means that homeowners will be less safe when walking down to the PRIVATE lake to fish (my son's favorite reason for living here) D. Delinquent tenants or people who leave their belongings. -sales open to the public that will bring even more traffic to the quiet neighborhood. 4. Property de-valuation (One of my big concerns) A. How will this effect our home values? - our lake sets this subdivision apart from everyone else. Open land should be valued and not filled in. - no one wants to live across from a storage unit. I would imagine this could greatly affect those who live directly on the lake. Even if it were to be a high end facility. Views are views and a parking lot isn't exactly a great view. (Even when you go to Disney World, those are the cheap rooms) Those are the questions I can come up with on the top of my head. The sight itself is rather low and I would be concerned about water damage to those units. If seepage occurred, who would be responsible for the damages? Hopefully not the LAHA.
