1. There are some right of ways and set back issues needs to be look at.
2. Proper fencing and screening for the propose operation .

4. The size of the operation for the future use.
5. Proper distance from neighbors house.
6 Type of equipment and grinders.
7. Condition of the Bridge on C Street for load safety.
8. The impact of the traffic with a heavy equipment on C street dirt road and dust.
9. Fire Hazard and safety concern .
10. The location of the operation in 53 Acres parcel .
11. Wood waste need to be store removed.
12. The impact of the operation most not hurt the value of the surrounding lands and neighbors.
13. Fugitive dust and noise from the operation needs to be discussed.

GENERALDURARLE POWER OF ATTORNEY
I, Windon H. Davis, of 2730 Buena Vista Drive, Greeley, Colorado, do hereby execute
this General Durable Power of Attorney with the intention that my agent hereinafter named
shall be able to act in my place in all matters.
1. SECTION - DESIGNATION OF ATTORNEY
a. I constitute and appoint Stephanie Louise Odell of General Delivery, Kremmling
Colorado, to be my attorney-in-fact or agent ("agent"), to act for me, in my name and in my
place. If my agent, Stephanie Louise Odell, shall cease to act due to death, incapacity or
resignation, then I appoint Megan Elizabeth Holdren of Eaton, Colorado to be my attorney-
in-fact or agent ("agent"), to act for me, in my name and in my place.
2. SECTION - EFFECTIVE DATE AND GENERAL PROVISIONS
a. This General Durable Power of Attorney shall be effective as of the date of
execution by me.
b. This General Durable Power of Attorney shall not be affected by my incapacity or
disability, it being my specific intention that my agent shall continue to act as such even
though I may not be competent to ratify the actions of my agent.
c. Third parties may rely upon the representations of my agent as to all matters
relating to any power granted to my agent, and no person who may act in reliance upon the
representations of my agent shall incur any liability to me or my estate as a result of
permitting my agent to exercise any power.
d. This power is revocable, provided that insofar as any governmental agency, bank,
trust company, insurance company, other corporation, or other person is concerned, who
shall rely upon this power, this power may be revoked only by a notice in writing executed
by me delivered to such person or institution.
e. This power of attorney shall not be revoked or otherwise become ineffective in any
way by the mere passage of time, but rather, shall remain in full force and effect until
revoked by me in writing, as provided in Section 2.4 hereof.
3. SECTION - POWERS
a. General Grant of Power: I give to my agent full power to do everything necessary
in my name or for my benefit which I could do if I were personally present and able. It is
my intention that my agent may perform any act and exercise any power, duty, right, or

obligation that I could perform or exercise. Such authority is intended to relate to any
person, transaction, or interest concerning real and personal property, including intangible
property interests, in which I now have an interest, and property in which my interest is
subsequently acquired. I empower my agent to delegate authority to others. In addition
thereto, and not in limitation thereof, my agent shall also have the powers set forth below.
b. My agent may collect and receive, with or without the institution of suit or other
legal process, all debts, monies, gifts, objects, interest, dividends, annuities, and demands
that now are due, or may hereafter become due, owing or otherwise payable or belonging
to me. My agent may use and take all lawful actions in my name or otherwise to recover
the same and to compromise the same.
c. My agent may sell, purchase, convey, lease, exchange, mortgage, pledge, release,
transfer, acquire or otherwise deal with, dispose of, or encumber any of my property, either
real or personal. This shall include the power to borrow money or otherwise obtain credit
upon such terms, conditions, and covenants as my agent considers to be appropriate.
d. My agent may appear on my behalf in any litigation in which I am, or may become,
a party during the duration of this General Durable Power of Attorney.
e. My agent may give discharges, releases, consents, and receipts on my behalf.
f. My agent shall have the power to deposit funds in my name in any banking or
savings institution, or in any "money market" account, whether or not insured.
g. My agent shall have the power to pay any and all bills, accounts, claims, and
demands now due by me or becoming due by me subsequent to the execution of this
General Durable Power of Attorney. In connection therewith, my agent may withdraw
funds from and draw and sign checks in my name upon any bank or trust company, savings
institution, or money market fund in which I may have any funds on deposit.
h. My agent may endorse all checks drawn to my order for deposit in any account in
which I have funds on deposit or in any new account opened in my name.
i. My agent shall have the power to hold, invest, reinvest, and otherwise deal with
and manage all property in which I have any interest.
j. My agent shall have the power to sell, convey, transfer or surrender any securities
which I may own, or to purchase different securities. In connection therewith, my agent
may execute in my name or on my behalf any stock power or other instrument in order to
effect any such sale, conveyance, transfer, surrender or purchase.
k. My agent shall have the power to enter into or renew any agency or custodian
agreement with any bank or trust company at my expense for the investment or
safekeeping of any property. This shall include the power to revoke any agency or
custodian agreement, whether the agreement is entered into by me, by my agent, or by any
other person.
1. My agent shall have unrestricted access to, and the right to, enter into any safe
deposit box, vault, storage warehouse, or other depository which I may own that may be
registered in my name or in which any property may be held for me, including the
authority to drill the safety deposit box if the keys have been misplaced.
m. My agent shall have the power to prepare, make, execute, and file any and all
federal, state, local, or other tax returns, claims for refunds, or declarations of estimated
tax, requests for extensions of time, petitions regarding tax matters, and any other tax-
related documents, including offers, waivers, consents, agreements and any power of
attorney required by any taxing authority. This power shall include the power to represent
me (directly or through attorneys, accountants, or other agents) in any matter before the
Internal Revenue Service, or any other federal, state, or local agency, and to execute federal
tax form 2848 or any other power of attorney required by the Internal Revenue Service. In
connection with such representation, my agent may execute consents extending the
statutory period for the assessment or collection of taxes, may pay all taxes and interest
thereon which I may properly owe or which may be assessed against me, may contest the
validity of any proposed assessment, exercise any election available to me under federal,
state or local tax law, and may receive any tax refunds to which I am entitled, and act for
me in all tax matters for all tax periods and years before the Internal Revenue Service and
any other taxing authority.
n. My agent shall have the power to execute, seal, acknowledge, and deliver any
instruments, documents, or papers deemed necessary or advisable with respect to any of
my property.
o. My agent shall have the power to apply for a Certificate of Title upon, and endorse
and transfer title thereto, for any automobile, truck, pickup, van, motorcycle, or other
motor vehicle in which I have any interest
p. My agent shall have the power with respect to insurance and annuity transactions
to procure, continue, modify, change, convert, sell, encumber, take a loan against, withdraw
cash value, assign or terminate any contract of insurance or annuity which insures me or
provides an annuity to me or another person. My agent shall not have the power to change
beneficiary designations on a life insurance policy insuring my life or on an annuity naming
a beneficiary after my death, unless the change of beneficiary designation is necessary to
qualify me or my spouse for Medicaid.
q. My agent shall have the power with respect to estate, trust or other beneficiary
transactions to act for me in all such matters to accept, reject, disclaim, receive, assign or
exchange any share or interest I may claim or be entitled to as a beneficiary.
r. My agent shall have the power with respect to benefits from social security,
medicare, medicaid or any other governmental program, or civil or military service
pension, to act for me to file and prosecute a claim for me to any benefits under such
programs, and to accept, settle or compromise any claims for me with respect to any
benefits.
s. My agent shall have the power to transfer all or any part of property owned by me
or in which I have an interest, to the trustee of any revocable trust created by me during my
lifetime, such that the same is held and becomes a part of the corpus of that trust to be dealt
with in accordance with the terms of such trust. My agent shall also have the power to
demand and receive, just as I could, any income or principal held in trust of which I am a
beneficiary. And my agent shall have the power to revoke any trust created by me.
t. My agent shall have the power to grant, bargain, sell, convey and lease for oil, gas
and mineral purposes any and all real estate which I may own or in which I may possess
any interest, wherever situate, for such price and on such terms which my agent deems
best, and to make, execute, acknowledge and deliver good and sufficient documents of
conveyance for the same, with or without covenants of warranty; to sell, assign, transfer
and convey any and all oil and gas leases and royalty and mineral interests which I may
own or in which I may possess any interest, wherever situate, for such consideration and
on such terms as my agent deems best, and to execute good and sufficient assignments and
conveyances for the same; to execute any and all necessary division orders, transfer orders
and similar instruments; to release and surrender any and all non-producing oil and gas
leases in which I may own an interest.
u. My agent shall have the power to demand and receive any and all information,
statements, data, account balances, and any and all other records regarding any and all
financial affairs of mine, including such records from any banks, financial institutions,
financial planners, securities brokerages, or any other entities that have any and all
financial information of mine. It is my intent by this power to allow for my agent to be able
to obtain all financial information in order to handle all of my financial affairs.
v. Notwithstanding any other provisions in this Power of Attorney, my agent
shall not have the power or authority to agree on my behalf to binding arbitration, or to
sign any agreements requiring binding arbitration regarding any possible claims I may
have against anyone for negligence or malfeasance.
w. In addition to all of the powers conferred herein, and not in lieu thereof, I grant to
my agent all of the powers conferred or provided by the Colorado Fiduciaries' Powers Act,
as it may hereafter from time to time be amended.
4. SECTION - MISCELLANEOUS PROVISIONS
a. I hereby ratify and hold valid all acts taken by my agent pursuant to this power.
b. I hereby authorize the use of a photocopy of this General Durable Power of
Attorney, in lieu of the original copy executed by me, for the purpose of effectuating the
terms and provisions hereof.
c. I hereby revoke all General and Limited Powers of Attorney previously executed by
me, if any, and the same shall be of no further force or effect.
d. This General Durable Power of Attorney is executed and delivered in the State of
Colorado, and the laws of the State of Colorado shall govern all questions as to the validity
of this power and as to the construction of its provisions.
e. This instrument is to be construed and interpreted as a general durable power of
attorney. The enumeration of specific powers herein is not intended to, nor does it, limit or
restrict the general powers herein granted to my agent,
f. My agent shall have the obligation to keep a full and accurate record of all
transactions handled on my behalf by use of this power of attorney, and to account to me,
any successor agent named herein, or any person designated by me upon my or their
demand.
g. In the event it becomes necessary to appoint a conservator for me, I nominate my
agent, or the successor agent named herein if my agent is unable to serve, as my
conservator to serve without bond.
h. The determination of "incapacity" as used in this document shall be made either by
a Court determination, or by a notarized statement from the regular physician of the
patient that due to illness, age, or other cause, the person is not able to manage property or
financial affairs effectively.

The Department of Planning Services received a verbal request from the applicant requesting a
continuance of this case, USR14-0046 for The Estate of Windon H. Davis in care of Ric Davis, applicant,
for a Site Specific Development Plan and Special Review Permit for an Agricultural Service Establishment
primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or
contract basis, including uses similar to the uses listed in Section 23-3-40 as Uses by Special Review as
long as the use (Grinding and Storage of wood chips and logs for livestock bedding) complies with the
general intent of the A (Agricultural) Zone District.
The applicant is making this request such that adequate Mineral Notification can be provided to the
Mineral Interest Owners and Lessees as required by Colorado Revised Statue.
Therefore, the applicant is requesting this case be continued until Tuesday September 15, 2015. On
