With that in mind, if there is any confusion relating to the properties being addressed, please contact me or Chad Dilka with King Surveyors. Proposed Lot 5 of the resubdivision appears to be a portion of a lot adjacent ("Adjacent Lot") to the current Lot 1 of the Union Colony Resubdivision RS-1023. The Adjacent Lot is owned by the City of Greeley and is located almost entirely within its municipal boundaries. The Weld County GIS map indicates that the Adjacent Lot is part of parcel number 080331400004. The GIS map shows that parcel 080331400004 also includes Clayton Park which is separated from the Adjacent Lot by the river. However, based upon the deed for the Adjacent Lot (see attached Greeley from Monfort Deed), it appears that the Adjacent Lot is a separate lot from the property comprising Clayton Park, As a result, it is not clear what parcel number pertains to the Adjacent Lot. To clear up any remaining question as to ownership of the proposed Lot 5, Weld County intends to quitclaim any interest it may have in such lot to Greeley once the resubdivision is completed. ADDITIONAL NOTE REGARDING GREELEY SADDLE CLUB SUBDIVISION: The Adjacent Lot to the properties affected by this Geisert Pit resubdivision and within City of Greeley municipal limits is currently undergoing a City of Greeley subdivision process. The name of the proposed subdivision is the Greeley Saddle Club. Both this Geisert Pit resubdivision and the Greeley Saddle Club subdivision are the result of a collaboration between Weld County and the City of Greeley to clarify unclear property boundaries that exist in the subject area. The land comprising proposed Lot 5 of this Geisert Pit resubdivision has been determined to be owned by the City of Greeley and is currently a part of the property addressed by the Greeley Saddle Club subdivision being processed by the City of Greeley (see Greeley from Monfort Deed submitted with this application). However, because the property comprising Lot 5 is located within unincorporated Weld County, it is being addressed through the Weld County resubdivision process. LEGAL DESCRIPTION: Union Colony Resubdivision Lot 1, RS-1023; and a portion of the Union Colony Subdivision, 52 S31 T6N R65W of the 6th PM; and a portion of the parcel described in the Greeley from Monfort Deed submitted with this application. FEE OWNERS OF THE PROPERTIES: 1. Weld County, Colorado (owner of all property except for area comprising proposed Lot 5 of this proposed resubdivision) 2. City of Greeley, Colorado APPLICATION REQUIREMENTS DEEDS AND PLAT MAPS: Deeds for the properties owned by Weld County and the City of Greeley are being submitted as a computer file on CD along with this application. Likewise,the proposed plat map for the Geisert Pit Resubdivision is being submitted as a computer file on CD. The Greeley Saddle Club subdivision plat map is also being submitted on CD in order to give a more complete overview of how property is being subdivided in the area. ACCESS PERMIT APPLICATION FORM NOT SUBMITTED: The Weld County Road Access Permit Application Form was not submitted to Weld County Public Works because access to the proposed resubdivision is from H Street which is under City of Greeley jurisdiction. Access to proposed Lots 2 and 3 will be via the H Street access leading to an access easement across the Weld County property north of and adjacent to proposed Lots 2 and 3 where the existing road runs. A proposed plat of the access easement is being submitted as a computer file on CD. Weld County's intention is to sell Lots 2 and 3 to the Central Colorado Water Conservancy District for use as water storage. At this time,the access easement has not been granted because the sale is still pending. STATEMENT OF WELD COUNTY TREASURER NOT SUBMITTED: All properties that are the subject of this application are government owned and exempt from taxation. TITLE COMMITMENTS: A copy of the title commitments for the property owned by Weld County and the City of Greeley are being submitted as a computer file on CD. AFFIDAVIT AND CERTIFIED LIST OF SURROUNDING PROPERTY OWNERS: A copy of buffer reports generated for the Weld County owned parcels is being submitted with this application. Because the Applicant believes that the City of Greeley parcel is separate from Clayton Park based upon the deed of transfer,the surrounding property owner information was calculated by hand using the Weld County website property portal. Some duplication of properties exists among the lists due to the close proximity of the properties at issue. MINERAL OWNERS AND LESSEES: It is the Applicant's understanding after researching both the Weld County Assessor's Office and Weld County Clerk to the Board's records that the mineral interests for the Weld County properties at issue are not severed and none of the mineral interests are currently being leased. With regards to the City of Greeley property, Mineral Resources, Inc. has a lease. However, it is not completely clear from the lease whether the proposed Lot 5 is subject to the lease. Out of an abundance of caution, notice will be sent out to Mineral Resources. Once the hearing is scheduled,the Applicant will send notice pursuant to Section 24-65.5-102, et seq., C.R.S. and submit a certification once that is completed. SUPPLEMENTAL REQUIREMENTS: DESCRIPTION OF THE TYPE OF USES PROPOSED FOR THE RESUBDIVISION The properties owned by Weld County and that are the subject of this application are principally former mining properties with cells which have been lined by slurry walls for water storage. Weld County plans on selling Lots 2 and 3 to the Central Colorado Water Conservancy District for use as water storage and augmentation beneficial to agricultural activities within Weld County. Lot 4 is to be established to preserve the existing use of the land for the Poudre River Trail. Lot 1 is to be retained by Weld County for the continuing use by the Weld County Public Works Department and serves as a point of access to the resubdivision parcels from H Street in the City of Greeley. Lot 5 is being created to clean up what has to this point been an unclear property boundary due in part to the shifting of the river. As a result of the survey created for this proposed resubdivision, along with the survey for the adjacent Greeley Saddle Club Subdivision which is undergoing City of Greeley review and discussion with the City of Greeley, it appears that the land comprising Lot 5 is owned by the City of Greeley but is situated within unincorporated Weld County. Weld County intends to quitclaim any interest it may have in Lot 5 to the City of Greeley once the resubdivision process is completed.
