Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Saddle Butte Rockies Midstream proposes to construct approximately 17.3 miles of 10 inch crude oil pipeline from a point located in Section 30, T6N, R64W south to a point located in Section 24, T3N, R65W adjacent to the existing White Cliffs (Rose Rock) Oil Polishing Terminal. The pipeline is designed to transport oil gathered from existing oil development in the immediate area through gathering lines constructed perpendicular to the main trunk pipeline and from truck offload lanes at the 2 terminals. There will be a 4 or 6 inch gathering line running east/west south of Kersey on CR 38. A communication tower will be on site but at this time the applicants do not know the height of the tower. Staff noted that a co-locate study within 10 miles of the site will be required if the tower is above 70 feet in height. Once the site is completed and operational, the number of people using the entire site will be approximately 10 people per week within the hours of operation of 24/7. A total of 10 vehicles (light weight trucks) per week will access the site as well as approximately 25 truck loads per day delivering and offloading oil to the terminals. The applicants indicated that they are proposing a 6 or 8 inch pipeline from the White Cliffs (Rose Rock) Terminal to the Suncor site near Ft. Lupton. This project is just east of CR 47 and north of CR 30. Access is from CR 30 using non-maintained CR 47 ROW. Roads: County Road 47 is unmaintained section line right of way. The applicant shall verify and delineate on the map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of right-of-way. This road is not maintained by Weld County. Latest ADT on CR 30 was taken on 3/6/13 which counted 1118 vpd with 68%trucks. Traffic: A traffic narrative was submitted with the application materials and indicated that there will be approximately 15 truck daily roundtrips. The expected traffic routes are CR 30 to CR 49 then north or south. The site will have 3-5 employees working on a 24/365 basis. Construction traffic could generate access issue including road damages and should be included in the IRMA. Access: An access permit has been approved for the access to the site (AP15-00106). Entrance gates (if applicable) must be set back a minimum of 75 feet from edge of existing right of way (future right of way if classification is other than local) to allow a truck and trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped for gate be allowed to create a safety issue for roadway users. Tracking Control: Tracking control is required to prevent tracking from the site onto the County Roadway. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. O More than 10 round large truck trips or more than 50 round passenger vehicles trips: • Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft of asphalt. *Recycled concrete is not allowed in County ROW "Tracking control devices can be double cattle guards or other specialized device "** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. Other PW Permits: A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld County Public Works at 970-304-6496 ext. 3764. General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes) -Improvements Agreement: Improvements/Road Maintenance Agreement: An example agreement is available at: http://www.co.weld.co.us/Departments/Pla n n i ngZon i nq/LandUseAppl icationsAssista nce/ApplicationAssist ance.htm l o An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. o Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: construction traffic issues, dust control, specified haul routes, damage repairs, and future improvement triggers. A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite tracking and upgrading and/or maintaining onsite tracking control. Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: A drainage letter was submitted with the application. The drainage letter certified the project stormwater impacts were minimal and a water quality feature with no stormwater detention was appropriate for the project. The drainage letter and water quality calculations are accepted by Engineering. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. An Improvements Agreement and Road Maintenance Agreement is required for offsite improvements at this site. Road maintenance including dust control, damage repair, specified haul routes and future triggers for improvements will be included. B. The applicant shall complete a Nonexclusive License Agreement for the upgrade and maintenance of Weld County Right-of-Way. The map shall be amended to delineate the following: A. County Road 47 is unmaintained section line right of way. The applicant shall verify and delineate on the map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of right-of-way. This road is not maintained by Weld County. B. Show the approved non-exclusive license agreement on the Plat and label it with the recorded reception number and date. C. Show the approved access(es) on the plat and label with the approved access permit number (AP15-00106). D. Show and label standard tracking control onto publically maintained roadways on the map. E. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA. F. Show and label the accepted drainage features, drainage flow arrows, turning radii, and parking and circulation on the map. G. Show any proposed gate back a minimum of 75ft from the right of way. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. B. If more than 1 acre is to be disturbed for construction of non pipeline items such as structures, parking lots, laydown yards etc..., a Weld County grading permit will be required prior to the start of construction. Prior to Operation: A. Construction of the approved access and/or tracking control improvements is required prior to operation. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. 5. The right-of-way or easement shall be graded and drained to provide an all-weather access. 6. There shall be no tracking of dirt or debris from the site onto publically maintained roads. The applicant is responsible for mitigation of any offsite tracking and maintaining onsite tracking control devices. MEMORANDUM TO: Kim Ogle, Planning Services \ FROM: Heather Barbare, Environmental Health U� foY N T T — � SUBJECT: USR15-0012 Saddle Butte Milton Crude Oil Terminal DATE: 5/12/2015 Environmental Health Services has reviewed this proposal for a site specific development plan and a special review permit for a mineral resource development facilities including oil and gas storage and support and service facilities, including crude oil in the A (Agricultural) Zone District. There will be three to five full time employees located at the facility. The applicant is proposing to provide water for drinking/sanitary purposes to the facility by commercial well (conversion of domestic well #203955 to commercial). The applicant is proposing to use the existing septic system at the facility (SP-0400192) following establishment of the commercial well. During construction activities the applicant is proposing to provide bottled water and portable toilets. The waste handling plan stipulates that all waste generated onsite will be removed offsite to Waste Management. Wastes from tanks bottoms will be removed via vacume truck and disposed of at CSI. The applicant provided an approved dust abatement plan as part of the application. On unpaved roads, water trucks will be utilized to keep dust down. Vehicle speeds will also be limited to reduce dust. Main access drives will be constructed with road base. Re- vegetation of disturbed areas will be conducted following construction. The applicant provided a Noise Abatement Plan indicating that several noise mitigation measures will be employed to reduce noise from the site. This includes locating noise- generating equipment towards the center of the facility, enclosing pumps and motors in a building, and lowering the speed of vehicles. The applicant submitted evidence of an Air Pollution Emission Notice (APEN) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to allowing the plat to be recorded: A. The applicant shall submit written evidence of a commercial well to Weld County Department of Public Health and Environment. Prior to the issuance of the Certificate of Occupancy: A. In the event the applicant intends to utilize the existing septic system, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. Alternately, a new septic system may be installed. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved waste handling plan, at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan, at all times. 5. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 2 6. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the private water supply. 8. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 9. A current professional engineer signed Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 10.The operation shall comply with all applicable State noise statutes and/or regulations. 11.Secondary containment shall be constructed around tanks to provide containment for the largest single tank and sufficient freeboard to contain precipitation. A synthetic or engineered liner shall be placed directly beneath each above-ground tank. Secondary containment shall be sufficiently impervious to contain any spilled or released material. A search of the Colorado Cultural Resource Inventory database indicated that no cultural resource inventories have taken place in the vicinity of the proposed project area and no historic properties have been recorded within the subject property. However, our files contain incomplete information for this area, as most of Colorado has not been inventoried for cultural resources. As a result, there is the possibility that as yet unidentified cultural resources exist within the proposed permit area. As you may be aware, under State and Federal laws, our office, the State I listoric Preservation Office, takes on a consulting role on projects that have the potential to affect historic properties (such as buildings and archaeological sites). Please note if this project includes Federal involvement(Federal permitting, Federal funds or Federal lands), Section 106 of the National Historic Preservation Act (16 U.S.C. 470) requires the federal agency to meet the requirements of as set forth in 36 CFR 800 ("Protection of Historic Properties") and the lead federal agency remains legally responsible for all required findings and determinations of National Register of Historic Places (NRHP) eligibility and project effects (36 CFR 800.2(a)(3)). Water Division 1, Water District 2 Dear Ms. Ogle, The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any county regulations or requirements. The applicant is constructing 50.8 miles of oil gathering pipeline that will be connected to a crude oil polishing terminal (Milton Terminal). The property is 32 acres and is described as Lot A of RE-2045; application materials indicate that the Milton Facility will occupy 18 of the 32 acres. The property has an existing residence and water well, operating under well permit no. 203955. The development will include the demolition of the existing house and the construction of the polishing terminal and an office building/warehouse. Approximately 3-5 office employees, plus individual truck owners, will be on-site at any time; the operation will run 24 hours per day, 7 days per week. The applicant is anticipating they will require 0.3-0.5 acre-feet of water per year for on-site commercial purposes. The proposed water supply is the existing well, to be operated under a new commercial well permit. During construction, the applicant will bring in bottled water and portable toilets. The well was completed into the Laramie-Fox Hills aquifer October 19, 1998. The use of groundwater from the well is limited to ordinary household purposes inside three single family dwellings, the watering of domestic animals, and the irrigation of not more than 1 acre of home gardens and lawns. Permit no. 203955 does not support the use of water for a commercial business. The applicant is proposing to re-permit the well for commercial purposes. If the applicant were to apply for an exempt commercial well permit, the uses of the well would be limited to drinking and sanitary purposes inside a commercial business, not to exceed 0.33 acre-feet of withdrawals per year at a rate of 15 gpm. If the applicant desires uses beyond those available with an exempt commercial well, they may apply for a non-exempt well permit instead. Since the existing well is in the nontributary Laramie-Fox Hills aquifer, a non- exempt well would not require a plan for augmentation. The uses of a non-exempt well will vary based on the applicant's needs and the quantity of water available underlying the property in the Laramie-Fox Hills aquifer. Please note, this office cannot guarantee the approval of any well permit application. This office has no objection to this application so long as the applicant obtains a commercial well permit for the existing well prior to use of the well for any commercial purposes and the applicant obtains dust suppression water from a legally available source.
