RE: APPROVAL TO CLOSE WINDSOR AND FORT LUPTON SANITARY LANDFILL
SITES.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 24th day of October, 1979
at the hour of 2 :00 o 'clock p.m. for the purpose of considering
the closure of the Windsor and Fort Lupton Sanitary Landfill
sites, more particularly described as follows :
1. The site known generally as the Windsor
Sanitary Landfill which is located on
Southeast Quarter Northeast Quarter of
Section 32, Township 6 North, Range 67
West of the 6th P.M. , Weld County,
Colorado.
2. The site known generally as the Fort
Lupton Sanitary Landfill which is located
on a portion of the North Half of the
Southeast Quarter of Section 19, Township
1 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, and all of the exhibits and evidence presented in this
matter and having been fully informed, finds that the closures
of the aforementioned sanitary landfill sites would be in the
best interests of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the closures of the
Windsor Sanitary Landfill site and the Fort Lupton Sanitary Land-
fill site be, and hereby are, approved conditional on certification
of a South County site and Colorado Landfill, Inc. following the
statutory procedure for notice of closure at such time as they
request closure.

The following business was transacted:
I hereby certify that pursuant to a notice dated September 17, 1979
and duly published September 20, 1979 and October 11, 1979 in the
Platteville Herald a public hearing was held on the request of
Colorado Landfill, Inc. for the closure of solid wastes disposal
sites and facilities. The solid wastes disposal sites and facilities
which were the subject of this hearing are the sites known generally as
the Windsor Sanitary Landfill and the Ft. Lupton Sanitary Landfill.
Mr. Warden reviewed the study made by himself, the Planning Staff
and the Weld County Health Department of the existing landfill sites
in Weld County.
Kenneth Lind, legal counsel for the applicant, elaborated on the
study and his clients request. Lynn Keirns, president and Brad
Keirns, secretary, of Colorado Landfill, Inc. were present and
testified. Vern Nelson, of Nelson Engineering, a consulatant for
the applicant also testified.
Ron Stow of the Weld County Health Department elaborated on the
concerns of the Health Department and findings of methane gas tests
conducted at the Ft. Lupton site.
George Rosenoff, Jr. , owner of the land for the Windsor site, and
his legal counsel, Thomas Hellerich, related to the Board their
opposition to closure of the Windsor site.
Several other peolpie were present and voiced their opposition to
the closures of said sites.
After all testimony hadbeen presented and discussed Commissioner Roe
made a motion to approve the closure of the solid waste disposal sites
and facilities in Windsor and Ft. Lupton conditional on the approval
and designation of a south county site. Commissioner Steinmark
seconded the motion.
CHANGE TAPE 79-132
Commissioner Roe amended his previous motion to read closure to take
place conditional on the designation of a south county site, the sites
to be closed upon the opening of the south county site, in any case,
no sooner than 60 days according to the statutory requirements.
The motion carried unanimously.

CLOSURE OF SOLID WASTES DISPOSAL SITES
AND FACILITIES (WINDSOR AND FORT LUPTON
SANITARY LANDFILLS)
DOCKET #79-84
NOTICE IS HEREBY GIVEN of a hearing before the Board of County
Commissioners of Weld County, Colorado, on the 24th day of
October, 1979 at the hour of 2: 00 p.m. in the Weld County Com-
missioners ' hearing room, first floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado, for the purpose of
considering the application of Colorado Landfill, Inc. for the
issuance of an Official Notice of Closure for two (2) solid
wastes disposal sites and facilities located within Weld County,
Colorado. The proposed Official Notice of Closures, in the event
that the operator has properly posted the property, will provide
for official closure of the solid wastes disposal sites and
facilities. This procedure is in accordance with the Solid Wastes
Disposal Sites and Facilities Act, Section 30-20-101, et seq. ,
CRS 1973 , as amended, and regulations promulgated thereto at
6 CCR 1007-2 , Section 7 b.
The solid wastes disposal sites and facilities which are the
subject of this hearing are as follows :
1. The site known generally as the Windsor Sani-
tary Landfill which is located on Southeast
Quarter Northeast Quarter of Section 32, Town-
ship 6 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado.
2. The site known generally as the Fort Lupton
Sanitary Landfill which is located on a por-
tion of the N1 SE; of Section 19, Township 1
North, Range 66 West of the 6th P.M. , WELD
COUNTY, COLORADO, described as follows :
Beginning at a point 1340 feet North and 1287
feet West of the Southeast corner of Section
Nineteen (19) , Township One (1) North, Range
Sixty-six (66) West of the 6th P.M. ;
thence North 36° 10' West 723 feet;
thence North 10° 10 ' West 286 feet;
thence due North 428 feet, more or less to
the North line of the SEa of said Section 19;
thence due West 844 feet, more or less to the
West line of said SEa;
thence due South along said West line 853 feet;
thence due East 264 feet to tract owned by Weld
County as a gravel pit;
thence due North 88 feet;
thence South 88° East 510. 6 feet;
thence due South 511. 8 feet;

Copies of the applications for Official Notices of Closure are
on file in the Office of the Clerk to the Board of County Com-
missioners located on the third floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado and may be inspected
during regular business hours.
Following the close of the public hearing, the Board of County
Commissioners will consider whether or not to issue Official
Notices of Closure for the two (2) solid wastes disposal sites
and facilities.
All interested parties under the law will be afforded an oppor-
tunity to be heard at said hearing.

In reference to the sanitary landfill north of Brighton along Hwy. 85
northbound, the agreement Hr. Ralph Rohweder had with the County and the
State Highway Departments to bring the State right of way back to original
form as near as possible, but has not been done. After many contacts with
Pir.. Rohweder and Mr. Herb Osborne by myself, my Foreman, Mr. Joe Vickers
and my Senior Maintenanceman at Fort Lupton, Mr. Remi Van Hole, I felt
that it was necessary to notify you of this situation.
Listed below are some exact dates of contact and others within a day
or so.
July 3 , 1975 - Met with Mr. Straub, Weld County Engineer and
Mr. Rohweder at the landfill to come to an
agreement to get something done.
September 25, 1975 - Met with Mr. Straub and Mr. Osborne; nothing
done.
October 1 , 1975 - County meeting with Mr. Deane Stipp, Assistant
Maintenance Superintendent, Highway Department
and Mr. Rohweder, County Commissioners.
February 9, 1976 - Joe Vickers stopped at landfill.
February. 10, 1976 - I called Mr. Rohweder.
February 13, 1976 - Ph. . Rohweder called me.
February 13 , 1976 - I called Mr. Rohweder back.
February 19, 1976 - Mr. Van Hole, Mr. Vickers and I talked to Herb

The following items are to be completed as soon as
possible at your Ft . Lupton Sanitary Landfill .
1 . Right of Way restored to its original condition .
2 . Side slopes constructed to a grade which will
allow proper mowing and maintenance , approximately
3 to 1 . Good fill dirt is to be placed over sand
and other debris to allow grass to grow.
3 . The State Highway fence which has been removed
is to be replaced along the entire length of the
landfill . The replacement fence must be the same
type in construction as existing adjacent State fences .
The State Highway Department will survey the Right of
Way line prior to setting the actual fence .
4 . All disturbed areas are to be sown in crested wheat .

corning our reaction to making a sanitary land fill from an old
gravel pit, which is adjacent to and within our right of way
along U.S. 83 approximately two miles north of the Weld-Adams
County Line north of Brighton, more nearly described as the South-
east quarter, Section 19, Township 1-North. Range 66 West. ith
P.M.
After reviewing the pit site. we have no objection to making
• sanitary laud fill out of this area. if the following provisions
tea be adhered as far as the portion that lies within State High-
way Right of Way.
1. No dumping will be allowed from Highanmy 85 into the pit.
2. County will be responsible for no trash or litter blowing
onto Highway Right of Way.
3. County will be responsible for removing present right-of-
way fence and replacing after land fill is complete.
4. Pinal pit elovntiase will be such that drainage is away free
Highway Right of Way.
5. County will be responsible for seeding and mulching area
