HomeMy WebLinkAbout20153992.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION AGAINST ROSA MELINDA CHICAS-ARRIAZA, DBA BULLDOG TRUCKING, LLC, FOR VIOLATION OF THE WELD COUNTY CODE -ZCV15-00155 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rosa Melinda Chicas-Arriaza, dba Bulldog Trucking, LLC, ZCV15-00155, are allegedly in violation of the Weld County Code, specifically the storage of equipment without a permit, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 21st day of December, 2015, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Rosa Melinda Chicas-Arriaza, dba Bulldog Trucking, LLC, were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation, and Cam. 1°L. (The legal description is Part N2 SW4 Section 35, T6N, R66W of the 6th P.M.; Situs Address is 4699 F Street.) Background Information: Bulldog Trucking LLC is a trucking company that consists of 17 dump trucks, 1 belly dump, 1 service truck and a storage container. Bulldog Trucking operates their concrete and construction business out of state the majority of the work season (Nebraska). The applicant would like to utilize the property for storage of the equipment during the winter months. The property sits on 1 acre; the northwest side of the property is recycled asphalt. The trucks are parked on the recycled asphalt. The majority of the north lot is a dirt driveway. Operating months are March/April—October/November(weather permitting). The hours of operation are dependent on weather conditions and the job. The dump trucks can leave as early as 5:30 a.m. and return at 8:00 p.m., seven days a week. The property may have approximately 1 —3 part-time employees on site at any given time for general truck maintenance or repair work such as tire replacement, oil changes, etc... They have a 50-gallon tank to store used oil that is removed from the property. Applicant stated approximately 2 trucks per week are on the property for repair during the construction season. There is a house and shed located on the property. The applicants live in the home. They have two wells and a septic system. Applicant would like to build a shop in the future that will be used for maintenance of trucks, storage of tools,tires and drums of oil. The proposed size of the building is 50 feet by 30 feet. Applicant said he met with Tiffany for a pre-app meeting in 2014 prior to purchasing property. Building Department Commercial Building and Electrical permits will be required for any new construction, production equipment tanks or alteration, or addition to any building on the property per Section 29-3-10 of the Weld County Code. Currently the following has been adopted by Weld County: 2012 International Codes; 2006 International Energy Code; 2014 National Electrical Code. A building permit application must be completed and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report or an open-hole inspection performed by a registered State of Colorado engineer shall be required. All manufactured structures must adhere to RESOLUTION #35 for Factory Built Nonresidential Structured CRS 24- 32-3305 Every Factory-Built Nonresidential Structure manufactured after the effective date of these regulations that is manufactured, sold, or offered for sale in this state must display an insignia issued by the Division of Housing certifying that the unit is constructed in compliance with the standards adopted in schedule"B"which is incorporated herein and made a part of these Rules and Regulations by reference, and all other requirements set forth by this resolution. Building Staff suggested prior to permit submittal, applicant should set a pre-submittal meeting with Building Department to verify all requirements are present. A Fire District Notification letter shall be submitted to the Fire District with jurisdiction for review and comments and submitted with Commercial Permit application to Weld County. Currently Plan Review time is 20-25 working days. All permit application and plans must be complete prior to review submittal. A complete code analysis prepared by a design professional, for the proposed uses should be submitted with the Building Permit application and engineered plans. All building permit requirements can be found on the Weld County web-site: htto://www.co.weld.co.us/Departments/BuildincDepartment/BuildingPermits/Commercial.html. Health Department Waste materials shall be handled, stored, and disposed in a manner that controls blowing debris, and other potential nuisance conditions.The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. Will be washing trucks, so will need to have a properly permitted well permit that is appropriate for the business. May have fuel storage which will need to have secondary containment and comply with State requirements. Chemicals must be stored according to manufacturer's requirements. No painting is done on site. The new building will have a floor drain and has to be self contained in a vault and fluids disposed of properly. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. Include in application how sewage disposal will be accommodated. A portable toilet will be provided. G19710930 is sized for a 2 bedroom house. Include in application how potable water will be provided. Bottled water will be available to employees. House is on an individual well, applicant will need to get a copy of the well permit if the well will be used in conjunction with the business. Noise will be restricted to a residential level. EH policy allows portable toilet for 2 or less full-time employees on site and employees on site 2 hours or less per day,for example truck drivers. Please contact Lauren Light at 970-304-6415 ext. 2211 for further direction. Public Works ROADS AND RIGHT OF WAY: Fst. is owned and maintained by the City or Town (municipality) of Greeley. The municipality has jurisdiction over all accesses within their jurisdiction. Please contact municipality to verify the access permit or for any additional requirement that may be needed to obtain or upgrade the permit. TRAFFIC REQUIREMENTS: 1. Describe how many roundtrips/day are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV(Roundtrip= 1 trip in and 1 trip out of site) 2. Describe the expected travel routes for site traffic. 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30%from the east, etc.) 4. Describe the time of day that you expect the highest traffic volumes from above. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. 20 to 50 passenger vehicle round trips/day or less than 4 truck round trips/day: • Access onto paved roads includes 100 ft of road base or recycled asphalt. The applicant indicated there is currently recycled asphalt on the driving surfaces which meets and exceeds the tracking control requirement. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT(IRMA): No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. PLANNING/ENGINEERING DEPARTMENT DRAINAGE REQUIREMENTS: The drainage code is available on the Planning-Engineering website at the following link http://www.co.weld.co.us/Departments/PlanningZoninq/Engineerinq.html. A list of professional engineering consultants is also available on the webpage if you need help finding an engineer to assist you with your project. Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23-12-30 F.1. 1. Detention pond requirements: A drainage report and detention pond design shall be completed by a Colorado Licensed Professional Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must include a certification of compliance stamped and signed by the PE which can be found on the engineering website. A general drainage report guidance checklist is available on the engineering website. More complete checklists are available upon request. or 2. Drainage narrative requirements with exception from detention pond. The drainage narrative must describe at the minimum: 1. Which exception is being applied for and include supporting documentation. 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property DRAINAGE CODE REQUIREMENTS(informational only): Section 23-12-30. Drainage Policy. F. Exceptions. 1. EXCEPTIONS TO STORMWATER DETENTION SHALL NOT JEOPARDIZE THE PUBLIC HEALTH, SAFETY, AND WELFARE OF PUBLIC AND PRIVATE PROPERTY AND SHALL BE LIMITED TO THE FOLLOWING: a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 1) Use by Right or Accessory Use in the A(Agricultural)Zone District. 2) Zoning Permits in the A(Agricultural)Zone District. 3) A second dwelling permit in the A(Agricultural)Zone District. 4) Towers including, but not limited to, cell, wind, and telecommunication towers. 5) Pipelines or transmission lines. 6) Gravel pits if the stormwater drains into the gravel pit. 7) Residential developments where all the following conditions exist: A) Nine (9) lots or fewer. B) The average lot size is equal to, or greater than, three (3)acres per lot. C) Downstream roadway criteria are not exceeded. D) The total post-development imperviousness for the rural residential development does not exceed ten percent (10%), assuming that all internal roads and driveways are paved, or will eventually be paved. 8) Development of sites where the change of use does not increase the imperviousness of the site. 9) URBANIZING areas where the total project stormwater runoff of less than, or equal to, 5 cubic feet per second (cfs)for the 1-hour, 100-year, storm event. 10) NON-URBANIZING areas where the total project stormwater runoff of less than, or equal to, 10 cfs for the 1-hour, 100-year, storm event. 11) Parcels with total area less than, or equal to, a 1.0 gross acre. 12) Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. 13) A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a onetime exception for a new 1,000 sq ft building or equivalent imperviousness. 14) A parcel greater than 5 gross acres in size is allowed a onetime exception for a new 2,000 sq ft building or equivalent imperviousness. 15) Approved by a variance. Section 23-12-150.Stormwater Drainage Criteria Variances. The following variance procedures are intended to allow additional exceptions to the code explicitly listed in Section 23-12-30 provided certain requirements are met. Subsection A below is intended to be a lower cost option which allows anyone to apply for a variance with or without stamped engineering documentation. Subsection B below is intended to be used when more detailed analysis and engineering support is required. A. An applicant may request a variance for their site when conditions do not meet the drainage exemptions described previously and impacts to the site and offsite properties are insignificant. Requests will be reviewed by the Planning Director or his/her designee. No variance will be considered if it may jeopardize the public health, safety, welfare and public and private property. In order to be granted, the variance request must: 1. Demonstrate that granting of the variance will still adequately protect public health, safety, and general welfare. 2. Demonstrate there are no adverse impacts, from stormwater runoff, to the public rights of way and/or offsite properties as a result of the project. Any engineer's supporting documentation or analysis has to be signed and stamped by a licensed PE in the state of Colorado. If the applicant's variance request is denied for not satisfying the above criteria and in the sole discretion of the planning director or his or her designee, the applicant has the option to follow the variance request in Subsection B below or appeal the denial to the Board of Adjustment. B. The applicant's engineer may request a variance. The variance request shall be stamped and signed by a professional civil engineer licensed to practice in the State of Colorado. Requests will be reviewed by the Planning Director or his/her designee. In order to be granted, the variance request must: 1. Describe the design criteria of the Weld County Code of which a variance is being requested. 2. Describe the proposed alternative with engineering rationale which supports the intent of the Weld County Code. 3. Meet the design intent of the Weld County Code. 4. Demonstrate that granting of the variance will still adequately protect public health, safety, and general welfare. 5. Demonstrate there are no adverse impacts, from stormwater runoff, to the public rights of way and/or offsite properties as a result of the project. An applicant can appeal to the Board of Adjustments the Director of Planning Services decision regarding the variance per Article VI of this chapter. C. Variance requests, if accepted, are not precedent setting and are based upon specific site constraints. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT: A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (map recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. SITE MAP REQUIREMENTS: A Site Plan will be required identifying the following (if applicable): o Show and label location of existing road Right-of-Way,future road Right-of-Way, and Easements o Show and label location of drainage related features i.e. detention pond(s), ditches, etc... Detention ponds shall be labeled as"No Build/Storage Area"and include design volume if applicable. o Show and label the drainage flow arrows showing how the stormwater flows across the property o Show and label location of the access(es)and label with access permit number o Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property o Show and label the access turning radii (25 feet for passenger vehicles/60 feet for trucks) o Show and label the approved tracking control Planning Department Additional fees may be included with the Building Permit such as Road Impact, County Facilities and Drainage fees. Please refer to the handout provided. Screening of the parking area or outdoor storage may be required from any adjacent landowners or public rights-of- way. The site is currently in violation (ZCV15-00155) for not having the necessary land use permits before operating a commercial business. The applicant is scheduled to meet with the Board of County Commissioners on Monday, December 21, 2015 at 9:00 a.m. The Board will determine how long the applicant has to file a USR application. There is not an investigation fee at this time, but that will be determined by the County Commissioners. Prior to submittal of the County land use application, please submit evidence of State permits as in the case of Mining permits. Applicant needs to specify what kind of equipment he stores on the property. Applicant is required to have a neighborhood meeting with any neighbors within 500 feet from their property line. Staff explained the USR process. The applicant shall submit 1 packet for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as many of the referrals as possible. At that meeting the Planning Commission hearing will be scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks after the Planning Commission hearing. The above notes are provided as a courtesy to the applicant. While we strive to help identify as many potential issues upfront during the pre application meeting we cannot anticipate every issue that may come up during the formal application process.
