RESOLUTION RE: GRANT ZONING PERMIT FOR A SECOND SINGLE-FAMILY DWELLING, ZPSD14-0015 -WILLIAM AND SHARON MCKAY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 12th day of January, 2015, considered the request of William and Sharon McKay, 420 Peregrine Place, Eaton, Colorado 80615, fora Zoning Permit fora Second Single-Family Dwelling, and WHEREAS, said second dwelling is to be occupied by family members in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot B of Recorded Exemption, RE-5046; being part of the SW1/4 of Section 29, Township 8 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-4-600 of the Weld County Code. 2. It is the opinion of the Board that the applicant has shown compliance with the following criteria listed in Section 23-4-610 of the Weld County Code, as follows: A. Section 23-4-610.A.1 —Compatibility with surrounding area, harmony with the character of the neighborhood and its effects upon the immediate area. B. Section 23-4-610.A.2 -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. C. Section 23-4-610.A.3 -- Availability of adequate water and sewage disposal facilities. D. Section 23-4-610.A.4 — The general health, safety and welfare of the inhabitants of the area and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of William and Sharon McKay for permission to place a second single-family dwelling on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is, granted subject to the following conditions: et; cnolj �2v 2015-0171 7 PL2322 ZPSD14-0015 -WILLIAM AND SHARON MCKAY PAGE 2 1. A Building Permit will be required for any new construction or set up manufactured structure, per Section 29-3-10 of the Weld County Code. A Building Permit Application must be completed and submitted. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently, the following have been adopted by Weld County: 2012 International Codes, 2011 National Electrical Code, and Chapter 29 of the Weld County Code. The structure will require ICC/ANSI A117- 1-2009 Standards for Accessibility. A plan review shall be approved and a permit must be issued prior to the start of construction. 2. Prior to receiving a Certificate of Occupancy, the home shall be connected to an approved sewage system and a legal water supply. 3. The second single family dwelling shall be occupied by a family member or a primary caregiver. Failure to comply will result in revocation of the permit. 4. The second dwelling will not be used as an income source by the applicant for rental purposes. 5. All zoning permits for a second dwelling for family members or a caregiver shall be transferable by the applicant and/or owner to any successor; as long as the use remains for family or caregiver. 6. All proposed or existing structures will, or do, meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 7. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2006 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 8. Any future structures or uses on the site must obtain the appropriate zoning and building permits. 9. Effective April 25, 2011, Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. 10. Effective April 25, 2011, Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County Facility Fee and Drainage Impact Fee Programs. 2015-0171 PL2322 ZPSD14-0015 -WILLIAM AND SHARON MCKAY PAGE 3 11. A Weld County Septic Permit is required for the proposed home septic system and shall be installed according to the Weld County On-site Wastewater Treatment System Regulations. 12. County Road 88 is a paved roadway and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall verify, and delineate on the plat, the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. 13. An Access Permit Application was submitted and approved for two accesses off CR 88. (AP14-00501). 14. Pursuant to Chapter 15, Articles 1 and II, of the Weld County Code, if noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All other vegetation, other than grasses, need to be maintained at a maximum height of 12 inches until the area is completely developed. 15. The applicant shall maintain compliance with Section 23-4-600 of the Weld County Code at all times. The current service provides a 3/4" meter that should provide adequate service to the proposed second residential dwelling on the same property. The current Meter provides a Water and Plant Investment Allocation of 1 which yields 228,000 gallons per year without surcharge rates. Surcharge rates are detailed below. Water purchased through the District shall be 70% delivery of an Acre-Foot of water (228,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage reservoirs. The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If usage exceeds the number of Plant Investments that were purchased, an additional Plant Investment Surcharge will be applied to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the Plant Investment Surcharge. Refer to table below for current Plant Investment Surcharge schedule. Water Surcharge Surcharge will be assessed when an account's year to date usage exceeds their annual allotment. Currently surcharge is $1.50 per 1,000 gallons. A letter witch I never received from the planning office although I own the neighboring property. I am adamantly opposed to the proposal for a number of reasons. 1. I used to own the subject property in its entirety. I sold to the current owners a little over a year ago. I sold because I wanted a new home. I was told by the Weld County planning department, that the only way that I could put a second dwelling on the property was to go through the exemption process and follow Weld County's Master Plan. I did a 5-acre exemption, which I still own with intentions of building a new home on. Had I known this was a possibility I would have split the property differently and or not sold it at all. That left 30.22 acres with the original home. I was told by the Weld Planning office that the parcel would no longer be eligible for further exemption or dwellings, as it had to be over 35 acres to be eligible for the exemption process. I do not understand how the new owners are now eligible to put a second dwelling on it when I was told I could not. 2. If it does not fit Weld County's Master Plan for me (the previous owner)? How does it lit Weld County's Master Plan for the new owner? 3. If weld county allows the new dwelling or an additional single family home on this property. The/owner circumvents the cost associated with the exemption process I E the cost of the survey the fee paid to the Highland School District, road impact fee and the fees to Weld County itself. 4. What happens to the property in the future eventually if it split with its own legal description if so, therefore, we generate another lot once again not following Weld County's Master plan. 5. I know numerous individuals who own larger farms that have been told they can not do the same thing. Larry Dill on county road 43 did an exemption a year ago. He needs his sons help on the farm and was told he has to wait four more years and do another exemption to build his son a home. Molly on county road 41 was told a similar story last month when she inquired about building her daughter a home. Weld County has a master plan in affect. This plan needs to work the same for all Weld County residents. Putting two single family residents on a 30.22 acre property dose not comply with the master plan.
